allie rasmus, ktvu fox 2 news. >>> call for change in the oakland unified school district. this followings the beatings of two students by security guards. protesters are demanding justess for the students -- justice for the students. ktvu's noelle walker is live. >> reporter: this isn't just a matter of one beating but several that have them concerned about student safety in the place where they are supposed to feel safe. an hour and a half ago 12 protesters gathered outside before the meeting to demand the firing of security guards who beat three students as well as the firing of principals at the schools and they want the superintendent removed. take a look at this. this is one example. one of the beatings got media attention last may after this surveillance video surfaced. a guard pushing a wheelchair bound student out of his chair, kicking him in the head and pulling him into an elevator. another angle shows him being slapped in the head and tossed out of the chair. he has been in a wheelchair most of his life for cerebral palsy is still a junior at oakland high school

. >> allie rasmus in napa county, thank you. >>> police in napa today discovered a man's body inside a freezer. they say it may be a case of suicide. police say they went to the apartment to do a welfare check because the man hadn't been seen since february. after they entered the home they found the body inside a large freezer. the man was 54 years old. police say he had a history of mental illness and may have put himself in the freezer on purpose. >>> new developments in the case of a mother shot and killed while trying to shield her children from stray bullets. two of the men appeared in court and charged with murder. they killed chyemil pierce before 5:00 p.m. last monday night. ktvu's gasia mikaelian joins us with more on today's developments. >> reporter: we reported the arrests yesterday. police say two men were taken into custody over the weekend and booked. today they faced a judge. shelton mcdaniels and jerry harbin, 29 years old, were charged today with murder. the complaint shows shelton mcdaniels and jerry harbin have long criminal histories. both are held without bail.

ktvu's allie rasmus is in napa county.earned learned the men were involved in a string of lawsuits? >> reporter: yeah. i want to show you where we are. the area next to us is an area operated by robert, the people in the orange shirts, they are with the sheriff's department, they are searching looking for evidence related to the case. although they won't tell us what they are looking for. it was on the brink of falling apart and when one investor confronted him about it he ended up dead. >> reporter: row after row of grapevines searching for evidence in the murder that happened here yesterday. sheriff's deputies say around noon he called 911 for help. saying his business partner had shot him and was chasing him through the venyard. deputies arrive -- vineyard. deputies arrived to see him die. when the case ended police say he turned the gun on himself. he had been running the winery since 2013. this is video of him talking to fox news in august. >> scary. >> reporter: before the earthquake his business was in shameables. >

ktvu's allie rasmus is live to put this together for us. >> reporter: this started before noon when ditch patchers gotyish dispatchers got a call -- dispatchers got a call. when deputies arrived they found two men in a venyard. one man was -- vineyard -- vineyard, one man was dead, the other man led police on a chase. the suv took off on highway 29. the driver crashed into gate in a wooded area and sheriff's deputies say the man locked himself in the suv. a s.w.a.t. team was sent in. >> ultimately s.w.a.t. teams arrived. they went up and cleared the vehicle and at that point the s.w.a.t. team from the sheriff's office here found the suspect inside the vehicle dead from a self- inflicted gun shot wound. >> reporter: sheriff's deputies say none of their officers fired their weapons so it was clear to them the man in the suv was killed by self- inflicted gun shot wound and they are not disclosing the identities of the men who were killed here today. we don't know a motive but outside the sheriff's office i talked to a man who identified himself as a friend of one of the two men killed, he sa

let's go back to allie rasmus who's been there at the scene all morning long with the latest. >> mikearrived probably about half an hour ago. you can see the front of the apartment building where this happened is roped off. investigators are still on the scene here. this is where the fire started around 3:00 this morning. oakland firefighters say this is an old armory building that had been converted into apartments and firefighters say two people who lived in the apartment unit where the fire started died in that fire. at its worst this was a 3-alarm fire that took between 40 to 50 firefighters almost an hour to get it under control as flames soar through the roof of the building. investigators aren't releasing the names of the two people who died. according to several people who live in this building, one of the victims is a pretty well- known multimedia artist who lived and worked in his apartment on the top floor. the other victim his roommate who according to neighbors had just moved in a few weeks ago. now earlier this morning, a neighbor took us into her yard to show us the dam

. >> allie rasmus live in san jose with how joe bell is being remembered. >> reporter: he's going to be remembered at this race. the race that happened last year in which that video you just mentioned took part in. this is the san jose 408 race for the row. we're standing in front of the starting line. this is some of the people, runners bundled up. it's a little chilly, getting ready for the race to start. doesn't start until 8:00. it benefits the pat tillman foundation. a lot of the men and women in the armed services usually take part. it was done last year as well. that is why joe bell, 95-year- old world war ii veteran during last year's race decided to put on his old uniform which he still fit in, go in front of his house on the race route and thank the men and women in uniform passing by. that gesture of gratitude from the video, was captured on video, it went viral and he became a late in life celebrity. you always knew you wanted to make joe a part of this race this year even though he passed away in january. >> we were hoping to have him in the lead vehicle or to make somet
