. >> reporter: yeah, that's right, andrea. the hospitalization rate here in alabama has increased more than 300% since july 1st, and at this hospital where we're at right now, the university of alabama at birmingham, they've seen a sharp rise in covid patients over the weekend. they had 35 on friday, 48 on sunday, and just now i'm hearing that it's now up to 54 covid patients at this hospital. andrea, that is much less than what this hospital and others were seeing back in january, but it is, as you mentioned, a very concerning trend line, especially as we go into the fall and back to school season here in alabama, which as you mentioned, only about one-third of people are vaccinated. the vaccination rate here 34%, the lowest in the country, andrea. we just spoke with one of the doctors here about that. take a listen. >> there's no question that transmission here of the delta variant is really out of control. all of the viral isolates we've looked at are the delta variant in these patients. so it's really taking advantage of u

kpix 5's andrea nakano joins us live from vallejo where the second suspect was arrested, andrea?>> reporter: liz, ian rogers from napa has been in custody since january, but authorities just arrested jarrod copeland from vallejo here yesterday. according to the doj, not only did these men talk about it, but they had enough fire power to carry out their attacks. authorities already caught up to this man, ian rogers, from napa on january 15th. they searched his home and his business, british auto repair, where they seized a collection of guns, thousands of rounds of ammunition and five pipe bombs. the indictment describes how rogers communicated with 37-year-old jarrod copeland on multiple messaging platforms. authorities say rogers wrote i want to blow up a democrat building bad. copeland responding, i agree, plan attack. >> the rhetoric that he's espousing on his chat that, you know, talked about all the hate and discontent he had for if, you know, if trump didn't win the election. i mean, those kind of things, people take that real seriously today. >> reporter: kpix security ana

cosby did not commit this act against andrea constand or against any of the other accusers. the court ruled on a procedural ground that the state of pennsylvania is bound by the decision of a former prosecutor not to prosecute. and the court reasoned that mr. cosby relied to his detriment on the public statements of that prosecutor that he would not prosecute. and that mr. cosby, therefore, testified in civil cases in a manner that incriminated himself. and so the court held that it would be an injustice and a violation of his due process rights to prosecute him at this point. but that doesn't say anything about whether he's guilty or innocent. and i think that's an important fact for everyone to understand. the silver lining, in my opinion, about this disappointing decision, is that there are a number of civil cases that have been on hold while criminal charges were pending against mr. cosby, including during this time that the criminal charges -- the criminal conviction was on appeal. and i believe that there is no more reason to keep those civil cases on hold anymore beca
