officer baker said that he asked mckenna to open his hand. he was worried about what might be inside. but when mckenna refused and did not open his hand, that is when officer baker says he took action hitting him several times with his baton which was all caught on tape and shown in court. this all went down after the duke-maryland basketball game in march 2010. they say they were celebrating but police say they were rioting. 33 people were arrested in total including mckenna although charges were later dropped. mckenna, the student involved in this trial, because of those two officers' actions, he suffer add mild concussion but that's about it. for that reason the judge dropped the first degree assault charge. he said the prosecution had not presented enough evidence to prove that the student's injuries were serious enough to warrant such a serious first degree assault charge. now, these two officers on trial today are still facing two other charges, second degree sought and misconduct in office -- assault and misconduct in office. the jury
