but one plan for tomorrow at uc berkeley is causing quite the controversy. kristy siefkin is live at the campus with why the pastry prices are being called offensive. >> reporter: good afternoon, grace and frank. if you come to the bake sale, being held by the berkeley college republicans, the price of a cookie or cup cake fends on your gender and -- depends on your gender and race. for a white male, you can get a pastry for $2 but a latino female, you only have to pay 7 a cents. the reason -- 75 cents. the reason is the bake sale is in protest in direct protest to a bill on the governor's desk that would allow california public school campuses to factor render, race and ethnicity in the school admission process. and this many argue is a step backward from prop 209. and students are upset and denouncing the bill and denouncing the bake sale, saying on facebook, it is offensive and racist. i spoke with several campus leaders and students earlier about the bake sale happening tomorrow and found a real variety of reaction. >> we saw the bake sale, we were frank

>> reporter: uc-berkeley is open obviously. a whole bunch of crimes including the most recent ones involving two male students who were robbed of their iphones and cash and police also making arrests in a series of sexual assaults. the rites of passage for a new school year are visible all over the cal campus. ♪ [ music ] >> reporter: a noontime school spirit rally on sproul plaza and thousands of students finding their way around campus for the first time. but along with the new school year comes something else police are seeing again this year, a rise in crime. >> typically anytime the semester starts we see an increase in activity. >> reporter: since august 21, both university police and berkeley city police have investigated a string of robberies and sexual assaults. one occurred here at the university's unit 3 residence hall at 10:15 on a sunday morning. police say the parent of one student was outside watching over personal belongings when this man, identified as 42-year- old rubin, walked by and groped the woman. the wom

it's set for uc berkeley this week. and ali rasmus joins us live from the cal campus with more on the message behind it and the strong reactions it's bringing. ali. >> reporter: the bake sale is organized by the uc berkeley college. they're calling the increased diversity bake sale and the organizers say this title is meant to be satired. here's why. here's a look at the price list for the baked goods that will be sold. and you'll notice the price is different depending on your race or ethnicity. it will cost $2 for whites to buy baked goods, 1.50 for asians, a dollar for latinos and so forth. it's also gender based. women gets a 25-cent discount. the college says their event is meant for satire, they're doing this to protest a bill on governor brown's desk which would allow but not require the uc system to consider race and ethnicity in admissions. some of the students we talked to say having a bake sale to protest that bill is not the right approach. >> especially in a community such as berkeley, like known for being

berkeley graduates that have been imprisoned in iran for two years. they made a surprise announcement. nick smith mass more. >> reporter: good news, iranian indeed. they told an american news outlet that the two americans have been given eight year prison sentences for spying will be released on two days on humanitarian grounds. iranian lawyer representing the americans said the bail amount of $500,000 had been set and after payment they will be released. they insist they were hiking in northern iraq they inadvertently strayed over the border. two men were with a third american, sarah shourd she was released in september of last year. the trial for the two americans took place behind closed doors and no evidence against them has been made public. under iranian law it can carry the death penalty. they are awaiting statements from the families. >>> following developing news in the eastern contra costa county, residents in discovery bay are being told to stay inside their homes with the doors and windows locked until at least 5:00 this morning. sheriff's

but that's the case at uc berkeley right now. we're live on campus to explain how these baked goods are fueling the debate over a diversity bill. low >> reporter: on the surface, it looks like cupcakes and cookies. but the deeper issue is the bill that would allow gender and race to be considered for admission. you can see quite a crowd at the bake sale table. some students buying the colorful confections to support the organizers, those against sb-185. the price structure includes $2 for white students, $1 for students 75 cents for black students and 25 cents discount for all women. >> this is not to attack or make an individual feel uncomfortable for who they are as a person or what eth kniss tick they are. but certainly the free speech is -- it's meant to get people's attention. [ chanting ] >> reporter: but many students here are offended. some organized a counterprotest, condemning this. the school says they have the right to make their point across but they could have made it differently. >> we don't think this particular c

berkeley students have been released from the prison. that word has not come in yet. bauer and fattal are expected to be handed over to swiss diplomat who represent american interest because u.s. has no diplomatic relations with iran. the iranian attorney for the two men says he was finally able to get a signature from a second judge in the case. that was the last obstacle standing in the way of their freedom. something required by the iranian courts. this release is not going to come without a price. bail, as iranians are calling it, half a million dollars each. it's not clear who is paying that money. last week, iran's president mahmoud ahmadinejad announced the two would be freed within days but the iran judiciary saying he didn't have the authority. in interview with abc news, ahmadinejad denied the courts were standing in his way. >> translator: we said we will release them, we will release them. as a humanitarian gesture. >> reporter: it is believed that fattal and bauer when they are released from prison will follow the same path back to the united states. fell

. >>> dangerous attacks by dogs raising tensions in a park at berkeley, kraig debro here to tell us about the recent attacks and why some are saying they don't feel safe right now, craig? >> reporter: a man just came with his dog and i asked him if there were problems with not just or only big dogs attacking smaller dogs but he said it is the breed. he says he no longer comes here for that reason. now it's on hoist between sacramento and dr. martin luther king, jr. and apparently there is a published report that another neighbor was quoted as saying, his dog has been attacked over the past six months. if you look at the sign there are a number of rules and they even have quiet hours so it seems fairly well organized. when i talked to the man you saw a second ago. i said where are owners aren't they supposed to intervene he said yes but it does not always happen. one person no longer comes here and a man who complained went to the city council and he is recommending splitting the park in two or in thirds so that dangerous dogs or bigger dogs can be separated from smaller dogs. he lives her

i just got off of the fault with the berkeley police departments. now that the sun is up, we can see tires that were / for tuesday to wednesday. we're at the exception of california at russell. tityras office, of course. the older prole does not know about that yet a most likely they simply do not have the money to fix their tires. a lot of people already here are on fixed incomes. look at this suv, you can see the back left tire was also slashed. 50 look around the neighborhood you can see that all of the other tires are intact. according to the berkeley police department ever did this tell-all with a knife or a screwdriver and slashed the tires which means you cannot even fix it. this higher cost hundreds of dollars to fix. some people have all four of their tires slashed. been with not only that, they were out of the day's pay because they could not get to work. most of this neighborhood, 99 percent of the tires are still intact and not a problem of many people overnight did not get a lot of sleep. i am sure they were peeking out of their windows

student protesters and uc berkeley police clashed after a day of protests. a group of about 50 students occupied the building for several hours and when police closed the doors at 9:00, thinks turned ugly. protesters inside screamed as officers made an arrest. graduate student cally madoff says the group is protesting the ever rising cost of higher education. >> this is day one. that doesn't necessarily mean that tomorrow is day two. >> reporter: police say it's an aggressive tone. earlier in the day, pro-testers cornered a female officer and grabbed at her gun belt. >> they physically pinned this officer between two of these and one person grabbed at her gun belt and was able to pull one of the magazines for her firearm out of the pouch. >> reporter: protesters say it was chaotic and claim police were too forceful. >> it was a very confusing time, but more importantly, the police were at that moment literally grabbing people by their arms and tossing people out the door. and using pepper spray. >> reporter: uc berkeley has some cleaning up to do. graffiti i

and it's telling governor brown that berkeley students support this bill. so the reason for the tone of our event, for possible sarcasm of the event is certainly to draw an attention. it's not an original idea. the forum is slightly original. previously over the past 10, 15 years, bake sales have been had on a random day of the week or just to get some controversy started. ours is at the same time and location of this phone bank. it's to make a point we don't have one political view here at berkeley. >> he said what about working towards -- you're not holding a bake sale for socioeconomic issues. you're holding a bake sale about admissions. >> exactly. >> so you want to address that part, as well? >> the reason that we're having a bake sale strictly on race and gender is because that's what the bill does. that's the bill that governor brown is deciding on. it's not affirmative action because it doesn't have a quota system because that's unconstitutional right now. but what governor brown is deciding is whether to let universities consider race in the admiss
