>> i think that they can bring a challenge to the application of section 230. the other thing they can do is go on alternate sites. for example, rumble, which hosts my show, doesn't censor anything. so let's fight these monopoly as well in the marketplace of ideas and in the courts of law and in the legislative chambers. they are violating if not the text of the first amendment, the culture and the spirit of free speech and we who have been fighting for free speech, in my case, since the 1960s, we have to fight back. maria: yeah. well, that's the point, though, alan. they haven't addressed rumble yet but rumble may very well be next. i mean, they're taking down parler. you heard from john mace, the ceo. and not only are they removing him from the app stores but they're also canceling the servers so we'll be watching that. i have to get your thoughts on the 25th amendment or the impeachment. 5thouse democrats have drafted articles of impeachment. they will introduce on monday. if the president doesn't resign. tell me your reaction to this. will you defend this in court if it goes to trial? >> it will not go to trial. t all the democrats can do is impeach the president in the house of representatives. for that, all you need is a majority vote. you don't have to take evidence. there are no lawyers involved. but the case cannot come for trial in the senate. because the senate has rules and the rules would not allow the case to come to trial until according to the majority leader, until 1:00 p.m. on january 20th, an hour after president trump leaves office and the constitution specifically says the president shall be removed from office upon impeachment, et cetera. it doesn't say the former president. congress has no power to impeach or try a private citizen, whether it be a private citizen named donald trump or named barack obama or anyone else. the jurisdiction is limited to a sitting president. and so there won't be a trial. but what i worry about deeply is the impact of impeachment on the first amendment. for 100 years, the supreme court and other courts have struggled to develop a jury ris juris pru. in the leading case of brandenburg versus ohio, the supreme court basically said that what president trump said on wednesday as much as i disapprove of it and many people disapprove of it on its merits, is protected by the first amendment of the constitution. it comes within core political speech and to impeach a president for having exercised his first amendment rights would be so dangerous to the constitution, it would lie around like a loaded weapon, ready to be used by either party against the other party and that's not what impeachment or the 25th amendment were intended to be. maria: yeah. but that's going -- there's a lot of that going around right now. senators on the democrats' side are demanding, senator cruz and senator hawley resign. real quick, we've got to jump. >> that's ridiculous.ov they're covered by the speech and debate clause. nothing can happen to them based on what they said on the floor of the senate. they engaged in protected speech. let us not let the terrible incident that occurred on wednesday destroy the constitution of the united states. that is my goal, to protect the constitution from over zealous advocates who want to weaponize it in the interest of temporary political gain. maria: this may be an anti-trust issue to recognize how powerful the companies are. we don't know if the biden administration will actually move on that. alan, thanks very much for fighting for what's right and we will see you soon, sir. thank you. alan dershowitz joining us this morning. we'll be right back. stay with us. everything for me. she had these awful blisters on her back. i don't want shingles when i'm your age. actually, if you're 50 or older, you're at increased risk that's life, nothing you can do... uh, shingles can be prevented. shingles can be whaaaat? how does this play out. >> what happened wednesday, is a tragedy. everyone knows that. it's as wrong as wrong can be. i hope the democrats don't go down this road. we don't know if they're goingoa to. they do not do that. do not do 75 million americans who onpported the president have been called deplorables who eat at the olive garden. remember what peter strzok said when i was at the walmart, he said he could smell the trumpum supporters here. now the democrats are going to try to remove the president from office, just seven days before he's set to leave anyway. i do not see how that unifies the country. i hope what happens is what senator graham said. friday night on this network. when he asked vice president joe biden, president-elect joe biden, to give a speech to the country and say we should not be pursuing this impeachment, we should notld be pursuing this 25th amendment. let's bring the country together and move forward. and return to being this america, the greatest nation ever. that's where we need to focus. maria: so tell me, then, what happens if the president gets impeached again. does that cancel out him running again? i mean, what is the point of this? wouldn't joe biden want to get right to business and start pushing through his nominees of his cabinet? >> right. and also getting -- right, getting the right people into cabinet positions for the safety of the country, for the good of the country, secretary of defense, secretary of state, leader of health and human services, for the good of the country i think it makes sense for vice president biden to do that. president-elect biden to do that. it also is good for him, good for the country as a whole to help bring us together. as professor dershowitz pointedr out, i think it's unconstitutional what they're trying to do. so hopefully cooler heads will prevail and we will not move down this path. if in fact there was a conviction in the senate, then of course the constitution is clear that the president can't hold office but as mr. dershowitz pointed out impeachment is for a sitting president and the president, if the democrats pursue this, could not have a trial until after he has left office. so i think it's got real constitutional problems but most importantly it's not healthy for the nation. we're at an important point. i'm very concerned about where we're at. i hope we can begin to come back together. maria: so who was this and what was behind this heinous, disgusting move to put an assault on our democracy by breaking into the capitol on wednesday? facebook confirmed the removal. here's what facebook says. the group was removed for violating our communities standards unrelated to the ongoing stock frenzy. well, president joe biden is taking steps to expand healthcare coverage and reverse some of the policies of former president trump. he signed an executive order on reopening insurance enrollment on healthcare dog. that's going to start -- healthcare.gov. that's going to start next month. he ended a policy that prohibits federal funds from going to foreign aid groups that perform abortions. next week, president biden expected to issue you several more executive orders on immigration, jackie. he's on a roll. james: he is on -- he is on a roll. thank you. it's time for the word on wall street. joining me now, optimal capital director of strategy, francis newton stacy, rose cliff capital ceo, mike murphy and chief economist, lindsey piezga. mike, i'm going to kick it off with you. we're watching futures this morning. all eyes are on the frenzy of trade, robin hood and other online platforms of, in the names like game stop, amc, nokia, other as well. after the individual investors pushed for an influx of buying, robin hoodiesing the restrictions, which pushed the affected companies lower at the close, squaring up the battle between main street and wall street. you are a player in this game. i want to get your reaction to everything that's happening. >> good morning, jackie. great to be here. so much has happened in the last few days, i'll try to encapsulate it here. you have the people on reddit, the wall street bets crowd that have forced the short squeeze on the large hedge funds. melvin this the headlines. then it goes to the people who came in to support melvin, citadel and point 72. when i look at this, melvin and the people running the other big hedge funds aren't my concern because they've been doing this a long time. they're going to figure this out one way or the other. my concern is the yolo crowd, the you only live once people at home. i would love the market participants, i love having these people investing in the market and making money in the market. but things go up and things go down. so i think these people have to be careful that you don't want to see them coming in and getting wiped out by this huge move in the market. what robinhood did yesterday and the other clearing houses did, they halted new orders. they halted new buys and new sells, opening orders of. you could only liquidate a position that you had. now you're seeing a lot of headlines that they should be investigated, they should go to jail. i think it's simpler than that. i think these guys had a cash crunch. i think from a clearing perspective, they didn't have the money to support all these transactions, if there was a call on that money of. so they shored up their balance sheet. trading is open today. i would say just be careful. things are going in your favor right now. they can turn quickly. be aware of that for the people who haven't been trading for a long time. jackie: . i love how you laid that out for us. robinhood had to raise money to make sure they could handle this. day trading has been a craze, it's led to volatility. we've seen people doing it as a result of the pandemic, they're sitting home, looking for innovative ways to make money. they have more time on their hands, less things to do. and you look at the broader markets which are being impacted from this as well. your thoughts on how we should be viewing overall market in the backdrop of this. >> well, any time you have increased volatility, you have increased day trading. we had this when we had the flash crash in 2018 and we had etfs going broke because they were overly short the vix index. this has happened before. the difference is this is happening with retail trader, not with more experienced and higher volume situations with hedge funds and things like that. what it comes down to is a genuine question around fiduciary responsibility. does robinhood imply they have a fiduciary responsibility that they don't have when saying they're looking out for the little guy. obviously that's a lawsuit that's coming. what is the responsibility of regulators? are these people, these brand-new day traders, are they legitimately vulnerable? obviously, you wouldn't let somebody perform heart surgery if they don't have a license. there are many things in this country where we have to get a license and show proficient skill. to what level would you have to do that?
