burwell, the oklahoman has standing to proceed upon a case that the i.r.s. has acted beyond its intent to have federal exchanges. we have 36 states that have federal exchanges. these exchanges are -- well, first of all, the administration had a motion to dismiss and it was overruled 11 months ago. so this is a real case, and the state has asked for a summary judgment. success in this case would mean the dismantling of the obamacare employer and individual mandates for all 36 states that have at least a partial federally facilitated exchange. i guess you can say that it might end up being that our attorney general for the state of oklahoma is going to be the one that's going to be the most successful in doing something about this thing that we should have learned a long time ago was not going to work. i have a personal interest in this. having had -- there are states that have, or countries that have socialized medicine. we have canada, we have great britain, we have many other countries. in making a study of these, you find that there is limited coverage for

secretary of homeland security jeh johnson, the head of department of health and human services sylvia burwell, and both tell us that their agencies run out of funds by september. so we must respond, and this is the response today. for not only are they managing the humanitarian crisis at our border, but they're also charged with protecting human life and homeland security. earlier today, i met with immigration judges from the united states department of justice's executive office of immigration review. they informed me that they are desperate for increased resources with which to handle not only the influx of children's cases but also a current backlog of 375,000 cases. now, listen to this: due to there being only 243 immigration judges across the country, immigrants today wait 587age of days for a hearing -- average days for a hearing. that's a year and seven months before they have the opportunity to come before an immigration judge. with adequate funding from this supplemental, which provides for immigration judge teams, legal representation, and services, government immigration litigation

how often have you had a discussion with or burwell on this situation? what i'm looking for is, right now the microscope's on you. but there are some other players in this effort also. are you having discussions with -- with other officials of the cabinet? >> yeah. oh, yes, definitely. on june 1st, as i noted, the president established a -- a government-wide effort pursuant to the homeland security act to deal with this and set up a unified coordination group, which i oversee. administrator fugate is in charge of it, which brings to bear the resources and assets of not only dhs, but hhs, doj, department of defense. and so we have an effort which fema, day to day, craig and his staff day to day coordinate and support. in addition to that, we're in routine -- i'm in routine conversation with my cabinet counterparts about this issue. i'm having a meeting with my cabinet counterparts right after this testimony, as a matter of fact. last friday i brought a group of interagency colleagues down to mcgowan and langley myself. not langley. lackland myself to see
