and former new york prosecutor and civil rights attorney, charles coleman. charles, are in an msnbc contributor? >> i am. >> there we go, everybody is here. i'm going to start with you charles. what stands out to you about the judge's ruling on mark meadows request? >> simone, for anyone who is paying attention, this should not have come as a surprise. you cannot be the chief of staff to the united states of america and simply of the executive branch and make calls about a state election and then tried to say that you are acting in your official capacity. the argument itself did not hold water and the judge got right to that and made it very, very clear for mark meadows that his argument was not going to have any traction. i think it is important to understand the larger implications here for anyone else who would seek to use that as an avenue to try to get that case transferred out of georgia on to the third level, it is not going to work. and so i think the judge made very quick work of that argument and did it in such a very specific way that it can't be u

charles coleman prosecuted civil cases on behalf of the u. s. overnment and now a civil rights criminal defense attorney and they both join me now. charles, let me start with you and incivility geisha, parties wise for summary judgment, motion to dismiss summary judgment. how often does plaintive get a summary or a judge being like i have seen enough? >> it is extraordinarily rare that this occurs. summary judgment has a decision we were just talking about is one of the things that routinely is filed but is not always granted. when you find it being granted, it is almost the equivalent of hitting a home run on the first pitch. it is that significant eludes on summary judgment and so i think there is something to be noted there. of course, what is also important and noteworthy is a fact that there were sanctions for trump's attorneys attached to this order. that in and of itself is incredibly significant because judges are very much so low to give out sanctions and they make a very compelling case as to why sanctions were issued here. >> i want to

joining me now, charles coleman former brooklyn new york prosecutor, i mustn't legal community analystu both, ladies first year christy. what does this report tell you about how fani willis whittled down who got indicted? and why would she have decided not to take the grand jury's recommendation, to charge lindsey graham, or epstein for example? >> when i think this grand jury report tells you is fani willis was not acting based on political motivation here. if she were, she would have charged the three republican senators that the grand jury recommended she charged. instead, she merely exercised restraint here. an independent judgment. she looks at the proposed recommendations for the grand jury, and then she assessed based on the evidence known to, her what she understood of the possible defenses. and she came up with her own charges in her own defendants. so i think it is a good report. as for why she would have charged, certainly, i think it's interesting if you look at the votes with respect to senators graham, purdue. senator graham there were 13 votes in favor of charging him, w

charles coleman is an msnbc legal analyst. charles, so far, the judge has gone below what prosecutors have asked for. they want 33 years. they got 17. 25 for rhodes. he got 18. would you expect to see the same pattern with tarrio or is this a different case all together? >> i think the answer is both. i think we can expect to see the judge go below the 33 years that the prosecution is going to ask for but still go higher than the minimum of what they can give. i expect that tarrio will receive a sentence that's higher than anyone else we've seen so far. his profile, role of what went on and the fact he was convicted of seditious conspiracy, the most serious charge we've had for anyone connected to january 6th. all of those factors will make the judge go higher than the minimum but not as far as the 33 years that prosecutors are asking for. >> so tell me about something called the terrorism adjustment. what is it? >> what that does is allows judges to move beyond the sentencing guidelines where they might necessarily be capped s
