"today in the bay's" christie smith is live in oakland.ase is really raising questions now about the help for mentally ill and also police response time. >> yeah, good morning to you, jon. when you look at the case, it sounds like the suspect may have needed more help, and so did the victim. daniel dewitt, the suspect, is expected in court here in oakland this afternoon as berkeley police are sort of clarifying the timeline of how they responded to initial calls for help. we're also hearing from people who knew the suspect, a 23-year-old former alameda high school football player. that neighbor tells us it was not a secret that the young man had documented mental health problems and that his parents said he suffered from paranoid schizophrenia and had been neglected by what they saw as a broken hell care system. he's accused of killing a 67-year-old man over the weekend in his driveway in berkeley. >> we've lot of a terrific community member. peter was a wonderful man. then we have this young man who's suffering from mental illness and not

i zoom in to the bay bridge where oun other christie smith is live this morning. she's out there where you could get caught up in a very strong gust from time to time. how are the winds out there this morning, christy? >> good morning. you know, it's on again/off again. but this is the toll plaza this morning. there's not a lot of water kicking up from the tires like you see in the heavy storms that are just relentless but that's what can really catch you off guard about this storm. you think it is a light rain, then suddenly you hit a cell of heavy rain and you can't see. you grab the steering wheel and hold on tight. the wind is really there sometimes, sometimes it is not. there is a wind advisory up on the bay bridge and san mateo bridge. the chp tells us they have officers out there who are really keeping a close eye on the conditions. then the south bay, our photographer rob hughes has some pictures of heavy rain in the santa cruz mountains along highway 17 near the summit. he tells me that caltrans has some warning signs up this morning, some lit-up signs tha

christie smith has the latest information. good morning. >> rebecca: good morning to you, jon. some of the residents are standing around this morning waiting for word on when they might be allowed back in. this is an active scene. this could have been much worse. an apartment building with 16 units catches fire in the middle of the night when people are sleeping. the first firefighters on scene tell me they had to find the fire here on schuyler and custer. they couldn't see it from the street. a single alarm that started 18 bedroom, they tell me. firefighters say that smoke detectors did work, but it was the smell that woke up some of the people in the building. firefighters went door-to-door, moving people quickly at 3:30 a.m. >> that was our initial thought was that we needed to evacuate and account for everybody. that went quickly due to the crews doing an excellent job. >> rebecca: firefighters are saying at this point they still don't know how it started. fire investigator is on the way. firefighters are going to do overhaul on the building to make sure everything is out.

christie smith joins us with the latest. good morning. >> reporter: good morning to you. it's never a good sign when a lumberyard packed with wood and other combustible material has flames coming out of it. that's what happened here. firefighters ran into this overnight at the san rafael lumber and building supply about 2:45 this morning. a two-alarm fire on anderson drive. i spoke with the fire chief who tells me the flames were pouring out of the back of the building where there are small storage buildings, and not from the main building. this is an l-shaped configuration here. firefighters tell me they attacked it from all sides and all 35 firefighters here. what they say really was on their side was an automatic sprinkler system that worked. here is the fire chief. >> there was a considerable amount of lumber and materials that were burning on the outside of the structure and the fire had started to move to the inside. as you can imagine, great concern about a lumberyard and the amount of combustible materials. >> reporter: right now they are doing overhaul and trying

in antioch, christie smith. i'll send it back to you in san jose. >>> this morning, san joaquin county investigates searching through an abandons well for human remains. rain forcing crews to call off the search yesterday at a ranch near lyndon. investigators have uncovers more than 300 pieces of human bones. they were led to the location by one of two serial killers who claimed his partner dumped more than a dozen bodies there in the '80 and '90s about. the sheriff's office has gotten swarmed with calls from worried families. he's asking the crime lab to rush the test to quickly identify the remains. >>> hours from now an east bay teenager, who admitted killing his parents, is expected to answer to charges in court. 15-year-old is being tried as an adult. police say the boy confessed to strangling his adoptive parents at their oakland home last month and trying to set their car on fire with the bodies inside. investigators say there had been tension in the home over his repeated suspension from school. >>> fune

nbc bay area's christie smith live with a look at the key ruling expected today. good morning. >> reporter: good morning to you, jon. first, san francisco sheriff ross mirkarimi was not in court today, in fact he -- it wasn't a requirement for him to be there. instead, two attorneys are talking about some potential key evidence. one is a statement that his wife apparently made after this alleged domestic violence incident. and then a videotape of her also made after this alleged incident and whether any of this can be admitted as evidence. now i was talking with legal experts and they say this is critical whether this will proceed at all. the court was cleared except for the case of san francisco sheriff ross mirkarimi charged with domestic violence after an alleged fight with his wife new year's eve. he pleaded not guilty. the prosecution released images of a short video of lopez after the alleged fight where she shows a bruise on her arm. fr prosecutors say she described how he grabbed the arm but the defense says it was shot 18 hours after the alleged incident

christie smith is live in san francisco.ng the evidence we understand is a video. >> reporter: yeah, that's one of the key things. that san francisco judge spent the weekend getting up to speed on the case as he just got it handed to him friday. one of the things he's going to consider is what evident might be allowed including a photo of sheriff ross mirkarimi, showing what appears to abbruise. mirkarimi is charged with misdemeanor domestic violence and after an alleged fight with his wife. prosecutors show add photo of a video that a neighbor shot of mirkarimi's wife. prosecutors say that during the video she describes that he got mad at her and grabbed her arm, causing a bruise. the defense wants this video excluded because they say that lopez was talking as someone preparing for a possible custody fight and not necessarily as a recent victim. the defense wants statements by the neighbor who filmed it as hearsay. since then lopez has said this whole thing in her opinion is politically motivated. that squ also decided that

"today in the bay's" christie smith is live in oakland where b.a.r.t. officials say they'll run trains for 24 hours a day. good morning, christie. >> reporter: good morning to you, laura. that's right, b.a.r.t. will be offering 24-hour service, longer trains. they've done it before. but this time they're really getting the word out early. in fact, three people tied to b.a.r.t. just wrapped up a press conference here on the corner here in downtown oakland. now, the 24-hour service is going to be friday through sunday, then early monday they'll close overnight for their routine a minute nance. b.a.r.t. will stop at 14 of its 44 stations. coming from the city, though, keep in mind trains will only be running on the hour. last time b.a.r.t. ran overnight service was in 2009 and that was when bridge workers did some work there on the i-bars. this time, though, they think a lot of drivers are going to choose b.a.r.t. over road detours. >> we can with all the advanced notice about this and the tremendous disruption it's going to cause for automobile drivers, we

. >> the obama administration -- christie smith joins us live from ocean beach with the latest. good morning. >> reporter: good morning to you. how much is enough when it comes to being prepared for an emergency. the big waves that hit santa cruz and crescent city tied to the earthquake in japan cost about $58 million in damage in california. as you said with the white house is doing is looking at cutting funding for tsunami warning and preparedness programs, talking about $4.6 million including about $1 million for dozens of high tech buoys. what they do is let scientists know when big waves will hit and how tall they might be when they do hit. it could also cut programs used to educate the public. some of the administration say the proposed cuts wouldn't necessarily sacrifice safety. safety outreach programs are in place. and those buoys off the coast would remain. it's just they might take longer to repair if damaged. and the cuts are in the proposed 2013 budget. reporting live at ocean beach, christie smith, "today in the bay." >> firefighters in mountain view keeping an eye

reporting live, christie smith. back to you. >> thank you very much. the suspect in another cold case heading to court. william payne scheduled to be arraigned for a san francisco murder 30 years ago. payne was charged and then charged monday after dna linked him to the victim. he is accused of killing nicolas crumbley back in november 1983. william payne is being held on $5 million bail. >> a dozen demonstrators are expected to enter pleas. eight of the defendants are facing misdemeanor charges but four face felonies. stemming from clashes with police saturday night. all 12 defendants have been ordered to stay away from the plaza and the oakland convention center. >> in the meantime, oakland police released new surveillance footage they say shows occupy oakland protesters breaking into city hall and burning an american flag. >> this is footage of demonstrators after they stole an american flag from inside city hall, then set it on fire. city hall surveillance footage shows what happened earlier. you can see papers eventually start to fly as protesters

live in san bruno, i'm christie smith. >>> 4:33 right now. investigators have now identified bones belonging to at least two missing women. found in a mass grave near stockton in san joaquin county. so far searchers have uncovered more than a thousand bone fragments at the site. investigators say some of the remains belong to a 16-year-old chevy wheeler who disappeared in 1985. last week crews uncovered the skull of a 25-year-old woman who had been missing since 1998. the bounty hunter working on the case says there could be as many as 30 pod dbodies buried in tha area. we're learning mott abo ining m deal that led the death row inmate to reveal the site. the bounty hunter made a deal for $18,000. sherman asked for an additional $15,000 to pay for headstones for his grave and spending money for the prison commissary. the state department of corrections has not commented on the deal. >>> no secret it is election year and president obama is back out on the west coast. mr. obama arrives in los angeles this morning for a california campaign tour

christie smith is live at the scene. she joins us with the latest. >> reporter: good morning to you. oakland police are investigating a shooting that left a 40-year-old oakland man in critical condition. the scene is very active. i just spoke with police and they told me that the major crimes unit is coming out to 83rd and international where they have a person of interest in custody. that person inside of a house here for about 30 minutes while police did a search with their guns drawn. they are still piecing this together. what they tell me is about 1:00 this morning they got a call of gun fire on the street. when they arrived they found a man shot in the abdomen laid out in the middle of the sidewalk. what set this off they still don't know, but the victim was taken to eden medical center. he is in surgery right now, again in critical condition. i'm going to speak with the investigator, try to, when he comes back up this way because they are just arriving. as soon as i have that i'll bring that information to you. liv

christie smith is there with more. good morning. >> reporter: good morning. just got under way a couple minutes ago, we're standing outside so we're not too disruptive. we will swing the camera around so you can see what's going on. what's happening is negotiations have been going on since august for pg and e to pay san bruno restitution for the explosion. but last week, the city is saying talks broke off. that's why the mayor is coming forward. these negotiations had been private, but he wants the city to get paid. and that's why the mayor is talking to pg and e. he says they came up with a $70 million amount to be paid to the city, but they're saying that's only funded for $12 million. that's only one of the problems. in addition to that, they're saying they want more money. this is not compensation for the homeowners who were devastated by the natural gas pipeline explosion. as one city spokesperson says, it is really to make the city whole again. after the explosion in september of 2010 that killed eight people, destroyed 38 homes, damaged dozens of other

christie smith has the latest for us. >> reporter: good morning to you. i got off the phone with the coast guard. they tell me the search is ongoing right now with at least four boats near the richmond/san rafael bridge. we're on the marin side this morning. but what they tell me so far no sign of the missing boaters. coast guard got a may day call last night. then a second call a few minutes later from a boater saying his boat collided with another. he had four people on board, and the other boat, he believed that at least one person jumped into the water. so, at this point it's unclear exactly how many they are looking for. could be one, could be more. but that was it. they say after that no more communication. two boats were out here earlier, then two more, helicopters using night vision equipment and navigation lights. they are going to keep searching throughout the morning. that's the latest from here. live in marin, christie smith, "today in the bay." >> the westbound lanes of the bay bridge open thanks in large part to mother nature. the bridge was
