christie smith is on the scene there. one of the questions i have is as a result of the fuel spill, is there damage to the roadway over there? >> reporter: you know, i just spoke with the chp a minute ago and he said because this is cement that as far as he knows there is no damage. it would be more likely that it would be damaged if it was made out of asphalt. that's the good news. the other good news we have is that he's telling us now it looks like northbound 880 will reopen in its entirety at 6:00 a.m. earlier they had said 7:00, but it looks like things are moving along. they have got quite a few crews out here working to clean up 200 gallons of diesel fuel that spilled all over the road. it's rather slick. they butt putt down an absorbent. what started this? they say a hit and run accident around midnight near 7th street. they say a driver hit a car with four people inside and then plowed into a big rig. the driver of the big rig lost control, hit both sides of the freeway. apparently he had just filled up both hio

that's the latest from here, reporting live in san francisco, christie smith, "today in the east bay.>> breaks your heart. thank you very much, christie. >>> firefighters are saying this morning that diamond heights fire was especially dangerous because of a sudden ignition that caused a room to burst into flames. firefighters call those types of bursts flashovers, which can cause temperatures to sky rocket to 1,000 degrees or more. today in the east bay's george shows us how traumatic and dangerous flashovers can be. >> reporter: if you've never seen a flashover, this is what it looks like. a fire so hot, everything in the room just bursts into flames. >> the flashover is really the end of the fire phase, where it's almost spectacular in some ways, where it reaches its maximum ignition, maximum burn, and what happens is all those particles that are in the smoke, all the furnishings, products in the room, are simultaneously heated to a point where they completely come bust. it's unpredictable. >> reporter: the fire chief says a flashover can happen in seconds. >> flashovers can reach

reporting live, christie smith, "today in the bay." >> thank you very much. closely following this one. call it an all nighter for dozens of people camped out at san jose city hall. they want a seat in the chambers for this afternoon's special meeting addressing pension reform for city employees. mayor chuck reed and the council decided to do today it could set the groundwork for how much money it could save from retirement reform. earlier this week san jose's police and firefighters union agreed to a framework for negotiation through october for pension reform. the mayor wanted to put a fall ballot measure before voters but now is going to hold off until at least march. today possible language for the ballot measure will also be discussed. >> this morning the faa and the national transportation safety board will continue investigating the crash of a plane near palo alto's airport. it crashed last night in the bay lands not far from the airport. the plane originated in concord with three men on board. all remarkably walked away. one was taken to the hospital

christie smith is live in concord with more on the fire. christie, you said that it came close to some homes. >> reporter: yeah, that's what we're hearing. good morning to you. we're also hearing that firefighters are still keeping an eye on this overnight because it's rather windy at this hour. they want to make sure that this fire is indeed out. it was quite scary for some homeowners here. this fire crept right up close to their homes. in fact, firefighters had to do structure protection overnight. fortunately, no homes were damaged. this broke out just after 11:00 in the hills behind discovery way near cal state's contra costa center off ig nashia valley road. flames came close enough that some gathered important things. this was a two-alarm fire and in the end burned two acres of grass before the fire was knocked down in a little over 30 minutes. there are reports of some neighbors saying they heard what they thought might have been loud fireworks before the fire broke out. i talked with a dispatcher this morning to see if she heard anyt

christie smith has the latest. >> reporter: good morning. i wanted to start by saying the location of these fires is right down these railroad tracks here, kind of hard to get to, sort of a remote location off francisco boulevard west. haven't had a chance to look for ourselves. now, this string of suspicious fires might not be a big deal except for this isn't the first time it happened. there were three last night when firefighters arrived. they found them behind rab motors and old borders book store near a possible homeless encampment. the cause is under investigation. there have been several similar fires like this in recent months. in june a 38-year-old transient was arrested on suspicion of starting two fires in may there were several suspicious fires in the area. no one hurt in this but all of these quite suspicious. i have calls to san rafael fire and as soon as i hear from them i'll bring that information to you. reporting live in san rafael, christie smith, "today in the east bay." >> thank you. also this morning a 4-year-old boy is

christie smith is live in san rafael with the look at some of the damage. these are vegetation fires, right? >> reporter: yes. that's exactly right. we're not talking about one but three suspicious fires in just one night. i wanted to show you how close this came to a car dealership over there. if steve can swing around you can see the ashes. this is all that's left this morning. it burned almost all the way up to a fence where there is also an old border's book store. there are two other burn spots along the railroad tracks this morning that run behind buildings in a mostly industrial area. the san rafael firefighters were called out after 9:00 a.m. and found tall grass burning in spots. this is near a possible homeless encampment. there are clothes and shoes left here along the tracks. the fires were put out quickly and the cause is under investigation but 3 are all considered suspicious. this follows a string of fires in the past month on june 14th. a transient woman was arrested on suspicion of setting fires near a homeless area. before that on may 22,

"today in the bay's" christie smith is at the b.a.r.t. station where a huge protest is expected. >> reporter: good morning. johannas mehserle was sentenced to two years in prison but he didn't serve the entire thing in part because of credit for time served. for oscar grant's family, the release is a sad and frustrating reminder of what happened on that b.a.r.t. platform january 1, 2009. how in their minds the criminal justice system failed. the officer served 11 months 18 jail and walked out a free man at 12:01. he had been locked up since a los angeles jury found him guilty of involuntary manslaughter. he said he meant to reach for his taser but fired his handgun instead. hundreds of protesters rallied in oakland, they were loud but mostly peaceful. some business owners boarded up windows worried there might be a repeat of damage that followed the verdict. grant's uncle was in los angeles, he was ready but upset with the schedule t notification and the release. >> here we are expecting a hearing on june 13 at 8:30 and yet again we've be

reporting live in san francisco, christie smith, "today in the bay." >> scary night. thank you, christie. >>> coast guard pulled another man near the bay from the san mateo bridge. take a look. this happened yesterday morning around 7:15. a 21-year-old man ended up in the water. the coast guard said he jumped from the bridge. someone driving on the san mateo bridge saw him and called 911. it took crews about 45 minutes to get to him but they were able to get him out of the water. >>> a market owner in fairfield is dead this morning after he was robbed last night. fairfield police say they received a call from the market owner asking for help. emergency crews responded and they found a man on the ground. the victim told officers three suspects had taking back our neighborhoods him inside his store. he was taken to a hospital where he died from his injuries. witnesses reported seeing three black men in their late teens enter the store at the time of the robbery. >>> this morning police are looking into a spree of robberies in san jose. there were four robberies all over

christie smith is live with the latest development. good morning. >> reporter: good morning to you, laura. she was last seen on may 27th. here it is monday june 6th. simply put, family and friends were getting frustrated with the slow pace of the investigation. the 26-year-old was last seen when she went out to her car during break in hayward. her family believes ha hayward police don't have the staff to take it on. they didn't search her apartment until four days after she disappeared. it would take two weeks to get results back from the search of her car. in a statement, the family says, we have been assured they have personnel working around the clock and only six personnel are assigned to the team. of those, three recently went on vacation. the hayward police department said they contacted the fbi early on and utilized some of their reserve. they served search warrants in the case and are committed to solving it. >>> thank you very much, christie. >>> now to the peninsula where a 3-month-old baby is dead caught in the cross fire af

reporting live in hayward, christie smith, "today in the bay." >> thank you. 6:03. in days the suspect in the brutal beating of giants fan bryan stowe could walk out of jail a free man. attorneys for the suspect giovanni ramirez are going door to door to businesses hoping to find surveillance video from march 31st. lawyers are targeting businesses close to the comfort inn where ramirez was reportedly staying the weekend of the beating. lawyers are trying to prove that ramirez was not at the ballpark the day stowe was beaten. and they say ramirez did not look like the man in the police sketches at the time of the beating. >> formally because there is no case for businesses to preserve their videos. hopefully we can show him on april 1st, the day after the game with hair because everyone agrees that the person who did this had a shaved head. >> ramirez has not been charged with the beating but has been held in jail for parole violation. his parole hearing is coming up on monday. >> this morning a bay area woman is guilty of killing and torturing her 15-year-old niece.

today in the east bay's christie smith live in antioch where jaycee dugard was held against her will. good morning, christie. >> reporter: this home looks exactly like it did when the story broke except for the windows are now boarded up and the front fence is starting to fall down. now, of course this is the home where young jaycee dugard was held for many years, captive in a backyard shack and there are questions this morning as the garridos are sentenced as to whether she might appear in court and give a victim impact statement but she doesn't have to phillip and nancy garrido have become a negative curiousity to media worldwide, scheduled to be sentenced today in el dorado superior court, nearly 20 years after they kidnapped 11-year-old dugard near south lake tahoe and held her as a sex slave. philip garrido is now 60 years old, expected to be sentenced to 431 years to life. his wife, nancy, 36 years to life. the couple pledded guilty in april. it's unclear at this point whether the garridos will make a statement as well but we are told that media worldwide is expected to be there

christie smith has more on the details. >> it's three weeks since michelle le disappeared. police say they fear the worst. but her family and friends, they are still hoping that she's out there and in need of help. they are going to be gathering this morning, they are launching a three-day search. they need volunteers. this is where they are going to be, they are going to be starting at 8:00 this morning on cypress avenue to try to cover ground in the hopes that they will locate the young nursing student. le was last seen when she went on a break from kaiser meds cal center on may 27. she went to the car in the parking lot. police say they questioned at least two dozen people but made no arrests. they believe she was likely killed but her family says they can't give up hope without knowing what happened to her. police have searched the nils canyon area and southern alameda county. le's extended family from san diego has come up to help in the search and we're told that they are teaming up with class kids to train volunteers, volunteers can check in at 2535 cypress avenue be

christie smith is live. >> reporter: good morning to you, laura. this is certainly not the news anyone wanted to hear. hayward police coming out and saying they believe the missing nursing student was likely killed in the kaiser permanente parking garage where she was last seen. they believe this was very likely someone who intentionally went after the nursing student, that was not a stranger jumping out of a bush. police conducted a number of searches in the east bay hills. while they aren't releasing details, based on evidence collected from the garage, they believe she was killed. >> during the course of the discussions, during the course of questioning a number of people, we have had persons of interest come up in this case. whether or not we focused on one individual person of interest or not, i can't say at this time. >> reporter: she vanished may 27th. she told colleagues she was going on break to get some items from her car. when she failed to return, they got worried and called police. her family has been critical of the hayward police dep

christie smith is live in hayward with more on the story. good morning. >> reporter: good morning, laura. you know, it doesn't sound good. police say that they have blood evidence from michelle le's car and several other pieces of evidence to suggest that she was killed. but her family is not giving up hope. in their mind they have nothing concrete to say she is dead. as grim as it sounds, that includes having her body . until that happens they'll assume that she's alive and in need of help. they put up new billboards in hopes of bringing the nursing student back home. she disappeared on may 27th when she went to her car on break at kaiser permanente med center in hayward. the car was found a few blocks away. hayward police have surveillance video, interviews with at least 25 people and good information taken from at least five searches, but police say they just can't share every detail. >> we tip the hand and commonly we give people the opportunity to rehearse alibises, obtain evidence, there's a whole slew of things that could happen by un

christie smith is live in oakland to show us what's happening right now. we are expecting it to open up. do you know how close they are? >> reporter: well, the best guess i would say is any minute now because we've been here basically all night and all the action was right down here. they had sweepers and emergency vehicles cleaning up this diesel fuel spill. they have been gone for maybe seven minutes now. now, when it does open up, we're going to see traffic moving this way. we haven't seen that happen yet, but they told us 6:00 this morning, so that's now. we're expecting them to start rolling any minute now, reopening after a hit and run accident. this is really critical to get back open because it's a straight shot right to the bay bridge. the cleanup was quite a big effort, because this was 200 gallons of diesel fuel all over the roadway. caltrans had to put down quite a bit of absorbent to make sure it was all clean because this was really slick. we may have more rain coming. they certainly don't want another accident. overnight a driver hit a car,

christie smith is live in oakland with more on the story. good morning. >> reporter: good morning, laura. we are where the oakland fire department and coast guard each have boats in the water looking for a car that may have gone under. they put a dark buoy out there. they marked a spot where they located something hard in the water. they have long poles and they are poking them down to the bottom and believe they may have hit something. a couple driving by here spotted what they saw was the rear end of a car, possibly a honda floating in the water with the dome light on. they called 911, whipped their car around and what they thought was a submerged car was gone. there are no signs of an accident like skid marks or broken railings. just a boat ramp as a possible way in. >> yeah, there is a launching ramp here for boats. given, you know, there's no outward signs of an accident. if there is a vehicle, that's how the car wound up in the canal, through the boat launch area. >> reporter: police say there is a homeless camp nearby on interstate 88
