districts so only one of seven congressional districts in the state is majority black.t was too racially discriminatory, even for this hard right conservative united states court. so the court ordered alabama to redraw the lines, so black voters would make up the majority or something quite close to it in two congressional districts, not just one. to that, alabama republicans just basically said no, we won't do it. they did draw new lines for new districts but the new lines don't include anything like a new majority black district. so what does this mean? i mean, the sort of best case terrible scenario here is that alabama republicans are trying to stretch this out as long as possible to try and give themselves another shot at holding another election with illegal racially discriminatory maps that favor republicans. that's the best case terrible scenario. the worst case terrible scenario is that alabama republicans are just deciding that they don't recognize the authority of the federal government and federal courts. and that of course brings back all sorts of bad memor

that number has held for so many years, but it was a congressional decision. when it comes to funding the supreme court or the basic rules of conduct and we have that role in history and we still do and showed last year we had a bipartisan bill by senators cornyn and coons related to stock ownership and decisions by the federal courts involving defendants or plaintiffs who represented the stock ownership, judges were asked to recuse themselves from cases where there are conflicts of interest. it was passed on a bipartisan basis in the congress, it was sent to the supreme court and all the other federal courts and they abided by it. they said we're going to live by that standard so it's not a radical idea that congress comes up with an ethical standard and the court follows it. >> why, you know, justin roberts has said that the court is adept at policing itself, that it doesn't need to adopt additional ethics rules. how does that differ, i guess? there's ethics rules like you said in the lower court, ethics rules for senators as well and for elected officials.

the chair of the congressional black congress, congressman steven horsford. joining me now is a new york university law professor melissa murray. professor, very busy week for the supreme court of our nation, and we need you to help us with some analysis of the major rulings. six conservative justices, all six, were appointed by republican presidents, voted to undo race based affirmative action in university admissions thursday. and i argue, that precedent can be used in other areas. my first question is who will be most directly affected by this ruling, and how? are the implications for this ruling beyond just universities, and for example, in the workplace. >> so, truly this ruling will be -- attempted to be used in other venues. we are already seeing conservatives lining up to extend the ruling to other venues. but it's really important to understand what was at stake here. the race based affirmative action policies that were dismantled here, the court talked about it as the race was an entirely determinative feature of the admissions decision. but that wa

this comes as congressional republicans argue that there is a two-tiered version of justice. what you are seeing is that there -- essentially the white house is trying to duck and cover here and stay above the fray, but the legal proceedings play themselves out. they do not see any benefit to trying to politicize this any further. host: we have been talking with our viewers about the focus of the campaign. it has been totally about focusing on the economy, and the slow recovery that is beginning to show in someplaces, the lessening of inflation, and the president pushing hiso bidenom ics theme. guest: that is more of a communications-forward strategy. they have put in place the strategies necessary, especially -- the bidenomics push is a communications-first push. you look at growing gdp, the recession that a lot of people feared never came, and things are much better postvaccination. the fact of the matter is americans do not yield that joe biden has done a good job on the things that people like him who always have complaints with have not. this man is another catastrophe.

>> congressional committee and to the congressional advisory board that would be set up under my plan. this would be helpful in simply allowing transparency. it could be through the privacy and civil liberties board that is doing good work that's out there. it can also be the congressional committees, the gang of eight, which they would review from an intelligence standpoint exactly what the fbi activities are. the third reform is, you might consider in the weeds, but anybody who's practiced law in federal court understands this. and that is to increase the transparency and accountability as the fbi by recording interviews. if you look at local law enforcement, if they interview a subject or a witness, it is normally the rule that it would be recorded. and when you go into court there's a recording that you can have that as the best evidence. the fbi has always had a different rule and the general rule is that no recording. the fbi agency takes the notes, they're later recorded on a 302 and the summary of the interview is what that agent relies upon a year, two years later as they go

so in every state that has more than one congressional member, you've got to decide how you're going to elect them. congress passed a law saying they have to be elected from a single member district. you've got two members, you have to divide the state in half. even though the supreme court has said since the 1960's that you have to have equal numbers of people in those districts, there are lots of ways of drawing those lines. there are ways of drawing those lines to get partisan advantage or to give advantage or disadvantage to one group or another. since 1982, when congress amended the voting rights act, there's a part of that act called section two, it requires in certain circumstances district lines be drawn so minority voters can elect their candidates of choice. and so these districts oftentimes referred to as minority-majority districts or minority opportunity districts are drawn in such a way so that black voters or latino voters who are geographically concentrated when there is what we call racially polarized voting, meaning white voters prefer one set of candidates, the min

so those were the congressional lines that we used in 2022.have now argued that that was fine for 2022, but we really need to go back to the redistricting commission. and that's what the court agreed with. this intermediate -- intermediary upheld court. it was a split court, so it's going to go to the highest court in new york state, the new york court of appeals. and they will have the final word. the issue is whether or not the redistricting commission should draw new lines for 2024 and the cost of the decade. if they say that the redistricting commission should do that, they will draw lines, it will go to the legislature and the legislature will either approve or draw their own lines. and then we are back to square one. because those who don't like those lines, and the democrats control the legislature in new york, so presumably if republicans don't like those new lines, they can go to court again. the clock is ticking. >> what's a way to solve this, though? again, this sounds a little circular. it sounds like one could get stuck in this wh
