in fairfax county, i'm tracee wilkins.servers at a local cheesecake restaurant are accused of stealing credit card numbers. the restaurant is located in the 5400 block of wisconsin avenue in the chevy chase pavilion in friendship heights. the secret service said the servers were working for a larger fraud ring from june of 2008 to may of 2009. former server nicole ward was arrested last week on bank fraud charges. court papers said she recruited two other servers to use skimming devices to capture the card numbers from their customers. authorities began their investigation last year after a citibank investigator traced several fraud complaints back to that cheesecake factory location. >>> some members of congress are heading from capitol hill to west virginia today. they are holding a hearing there to investigate whether poor safety led to last month's mine disaster that killed 29 workers. tracie potts live now on capitol hill with more on this story. good morning. >> reporter: good morning. the worst mining accident in 40

these are tough times in the fairfax -- and the fairfax county school board had to make tough decisions. they will begin to charge students for some things that used to be free. here is how it breaks down. next year's budget will be $35 million less than this year. according to the "washington post," about 200 positions will be eliminated because of those cuts. students that play sports will have to pay a fee as will students that take advanced placement or other tests. the board meeting went well into the night before passing the budget. funding has been cut to some students at risk but some of the most controversial changes will add new fees for a variety of activities. students that want to take advanced placement tests will pay a $75 fee. anyone who participates in school sports will pay $100 per student per sport. some parents objected but some board members say there was no choice. >> i like to look at the big picture. we have not, after tonight's budget, it will be two years that we don't give employees raises. as much as i don't like fees, we need the community to help pay this.

a bicyclist and a driver have been killed in a crash in fairfax. the driver struck a bicycle less than an hour ago. right now, the highway is closed for the police investigation. we have a crew on the way. >> a construction worker was shot in front of his son in northeast washington. the sun had quick thinking and a can of white paint. we have the details. >> this happened early this morning. one of the men's sons took a bucket of white paint and threw it at one of his father's attackers. he tried to talk his father out of working in that area because it was so dangerous. the phone rang while we were talking. on the other end, relatives told his son that his father made it through surgery. the son says the sheik father was shot 11 times this morning. -- the sun says the father was shot 11 times this morning. >> [unintelligible] >> two men came running into this apartment complex. inside, the 64-year-old was working and a man opened fire on him. police found a semiautomatic weapon on the ground outside. >> you cannot seriously preside over here. --

fairfax county police say the accident happened just after 4:00 p.m. the sawf was headed -- the suv was headed northbound on lee highway when for some unknown reason it lost control. it went dieing a neal to the left cross -- diagonally to the left. went straight up a bike path and hit a 17-year-old on a bike before crashing into a tree. the 17-year-old cyclist did not survive. the driver of the suv was also killed. >> we're all upset. i learn -- [ indiscernible ] >> i heard a very loud noise when i was inside the store. then i come out and i see there was a young, young girl. >> reporter: that young girl was a teenage cyclist who was with the teen. fortunately she was not hurt in this accident. >>> to another accident this one in maryland. take a close look. that is a family car on the roof of their house. the accident happened last night in frederick county. turns out the driver and her young son were inside the suv when it slammed into the roof of their own home. they were apparently headed home down the hilly driveway when the suv flew off the road

we are learning more tonight about the two victims killed along the highway and forum drive in fairfax county. lindsey mastis has more on this tragedy that left two people dead. >> reporter: he was just about to graduate high school. the 18-year-old wrestling star was riding his bike with a close friend possibly waiting to cross the road. >> hard to imagine him not being here. >> reporter: anthony thorne would have turned 32 today. he was driving a dodge durango. somehow his suv crossed six lanes hitting chad lee and then hit a tree. today the families of these young men are grieving. >> it is a big loss. a big hit. but thank god. >> reporter: chad lee's family laid him to rest today. his father says it must have been his time but he would have liked to see his son become a vet. >> he liked animals. he wanted to be a vet. i said okay, go for it. >> reporter: the 18-year-old wrestler's coach says everyone miss him. >> if you had a bad day, you wanted to smile you go talk to abdul because he could put a smile on your face. >> reporter: thorne stepfather says their family is overwhelmed.

these are tough times for fairfax county school board. for the third year in a row, it has reduced the amount of spending per student. $2.2billion budget passed last night making deep cuts and adding new fees for students. here is what it looks like. next year's budget is 35 million less than this year at a drop of more than 50 million from last year. that means more than 200 positions will be eliminated, most from the central offices. and new fees will be added for student athletes and advanced placement and ib tests. to make it up, the board cut funding to some problems for at risk students, eliminated summer school accept for mandatory programs and froze 's they fought to eliminate 4 million in new fees but failed so students that want to take ap tests will pay $75. students athletes $100 per student per sport. parents argue that is a hardship they can't afford. >> it means not only school work, not only the academic side of the house but also rounding the child out to become a team player which they experience through sports activitie

fairfax police say the accident happened just after 4:00 p.m. this suv was headed northbound on lee highway route 29 when for some unknown reason, it lost control. >> went diagonally to the left, crossed the six lanes of forum drive, went straight up a bike path that parallels southbound 29, up a slight incline. made contact with a male bicyclist. >> reporter: the 2001 dodge durango crashed right into a 17- year-old boy who was riding on the bike path before slamming into a tree. these two men work at the rug shop across the street from the fatal crash. >> i heard a loud noise when i was inside the store. then i come out and i see there was a young girl crying over there. >> reporter: that young girl was another teen cyclist who was with the victim. she was not hurt. the 17-year-old cyclist did not survive. the driver of the suv was also killed. investigators spent the afternoon talking to witnesses who may have seen the accident and may be able to give some clues about what caused the driver to run into the bike path path. >> [ indiscernible ]
