derrick ward in fairfax county this morning with the latest. good morning. >> reporter: good morning again. in about four hours, former fairfax county officer adamtortion will be arraigned -- adam torres will be arraigned and learn whether or not he will be released on bond. this is stemming from incidents that happened in august of 2013. officer torres was among the fairfax county police officers responding to a domestic situation that turned into a barricade or standoff. now, there was negotiation going on with another officer. torres apparently had his gun trained on the subject, who is now the person who died, john gear. and at some point, fired his weapon. gear was struck and killed. torres said that he thought gear might have been reaching for a weapon. other officers in reports preliminarily said they did not see the same thing. this happened almost ten days short of two years. the commonwealth attorney said it shouldn't have taken that long. let's hear from him. >> i obviously feel badly for the gear family. this case would have been ov

investigators say fairfax county police responded for a domestic call. geer said he had guns and police say one of them was on the floor next to him while his hands were up. torrez fired a shot that killed him. his defense attorney argues it's because geer was reaching for the gun. in court on wednesday morning, a judge denied bond for torrez, saying he could be a danger to the community. shortly after, the former cop fainted in the courtroom. and paramedic rushed in, but at this point, prosecutors say torrez will remain behind bars and will have chance to fight the charges when the case goes trial. the judge set the trial date for december 14th. meagan fitzgerald, news4. >>> a man who worked in a gravel pit killed a suspected robber and now the prince george's county police trying to find out if it was justified. it happened in brandywine when it man pulled up in a car. the suspect's name is rahim fenwitch, he talked to the gravel pit worker and then pull a gun and demanded his money. the worker fought back and killed him. although he has not yet been c

"difficult to work with." when he was dismissed he was escorted out of the building by security. fellow coworkers were so concerned about their safety. this official says that flanagan filed an eeoc complaint alleging that racial comments had been directed at him. station management quite frankly believed that these remarks by flanagan were actually fabricated. and that eeoc officials actually dismissed this claim. also, yankee said they receive -- also, abc news said they received wednesday morning two hours after the shooting what they believe to be flanagan's manifesto. now t

a former fairfax county police officer is on the other side of the law. adam torres waking up in jail after a grand jury charged him with murder in the death of john geer. news4's derrick ward has more on this case. good morning. >> reporter: good morning again, aaron. well, this case does indeed carry a second degree murder charge. that could carry from five to 40 years in jail for officer torres. he was let go from theers forc the 31st and in the interim the charges were brought by the special grand jury. it stems from the incident in august of 2013. there was a domestic call at john geer's home and it turned into a standoff of sorts with geer standing in his doorway. hands above his head for most of the time. a police negotiator had begun to talk to geer and about 40 seconds -- 40 minutes in to that exchange is when the gunshot was fired. officer torres said he saw geer make a move toward his waist band, but others had testified that geer's hands were indeed above his head. now a grand jury found that there was enough there to bring the second degree m

live in fairfax, jeff goldberg, abc 7 news. anchor: we are following breaking news from the district. police on the scene of asis basis death investigation in southeast washington. they were called to an area right behind the stanton glen apartments this morning. john gonzalez is there. reporter: this afternoon we still have an active crime scene, detectives have been using canine cameras to collect evidence and at this moment, the medical examiner has arrived to remove this body. this is at the stanton glen apartments, where residents reported shots fired this morning. police are still working to confirm that but what we can tell you is that a man believed to be in his 20's was found behind the apartments here on stanton road in southeast d.c. and police calling this a suspicious death investigation. he was found by a woman walking her dog around 7:00 this morning. according to the area advisory commissioner, it appears this suspicious death does include foul play. the body was found, a male, and it was found a gunshot wound.

he was unarm and shot to death by fairfax county police officer two years ago. tonight we are hearing from the father of johngeer. yesterday the officer torres was indicted on second-degree murder charge. jeff goldberg has reaction from geer's loved ones. what are they saying today? jeff: they are expressing deep emotion, relief and satisfaction and anger. adam torres turned himself into authorities last night and he remains here in the fairfax county jail. the family members saying it shouldn't have take then long. the chief prosecutor is expressing regret. we spoke today with john geer's father who said, "it's ridiculous" that it took this long to get to this point. they indicted him on second-degree murder charges. this happened in a standoff with police at geer's springfield town hill. torres was not named for 17 months following the shooter and the fairfax county commonwealth attorney said the county attorney and the police chief rosslere withheld information from the case moving forward. they have heard from friends and family to determine adam torres shou
