you were the da in the neighboring county, friends with fani willis. what do you make -- what can we make, if anything -- of rudy giuliani spending six hours with a grand jury today? >> i think it demonstrates that they were either a lot of questions or a lot of information to be gathered. and again, the special grand jury has a very big job. and i am [inaudible] being diligent, as is fani's team, in making sure that they get all of the evidence they need to make a very important and difficult decisions that we can expect to see, both from fani's office, and the special grand jury [inaudible] >> harry litman we know donald trump spent a similar amount of time in an under oath deposition in new york, with the new york state attorney general in a civil matter. but he took the fifth amendment 440 times. could that be a version of what happens today in georgia? >> definitely. so, typically, in federal practice and other criminal trials, when there was a target, they don't have to show up, they can just say, i am not going to talk, and the prosecutor gives

fani willis says you are the one stalling. he got subpoenaed three weeks ago.ho is more to blame here, the year and a half delay or the three-week resistance? >> that comes down to this investigation is the legitimacy of it threatened here? is it politicized? whatever the outcome are there going to be questions around it? >> there are going to be questions. it's grinding to a halt. this is part of what comes from having elected prosecutors. there are other systems around the world where they don't do it this way but for fani willis to go to a fundraising which is what an elected official does, that's sort of her night job, meanwhile the day job is now going to be sort of imperiled in part because the integrity of it can't -- i mean, it has to be questioned. so, look, brian kemp has a point. some of this could be negotiated, one would hope that all of these public servants after all the taxpayers are funding their salaries that they would sit down with a bunch of lawyers and say this is what we will do, this is what we are not going to do, this is what we will t

and in georgia, what do you make of lindsey graham's attempt to not testify and fani willis is sayingt but lindsey graham did? >> so on weisselberg, which i find quite interesting, i think it certainly doesn't help that -- when he sees what's going on, but i think the more important thing is these are state cases. no one can hope that a republican president is going to come into office and pardon somebody. if he is convicted, that's going to stick, and it's gonna stick for good. he he could try to cooperate. the other thing that the manhattan district attorney's office can do is if he doesn't cooperate voluntarily after the trial, they can just immunize him and put him in a grandeur in for some to testify, and then if he lies then, he will face additional time. so they have a lot of tools up their sleeve and they don't have to worry about the 2024 presidential election, and weisselberg doesn't have a possible out. so they're sort of things to come there. i wouldn't count the manhattan district attorney's office investigation just yet. and fulton is fascinating. lindsey graham, tense y

fulton county district attorney fani willis whose investigating possible election interference in georgia during the 2020 race wants to question graham about the calls he made to georgia secretary of state brad raffensperger after the election. this new ruling could now delay that not for weeks but for months according to some experts. joining me now is nbc justice reporter ryan reilly. ryan, welcome and tell us what have you heard about this reversal and now could this truly be pushback past the midterms? >> there is the potential for that but essentially what the appeal circuit was -- couldn't have them take another look at it. more narrow pathway available here. essentially, what senator graham's argued is that he's protected by a -- privilege as a member of congress and he's acting that capacity. this was in his home state. this was more in the realm of political -- rather than his job as a senator. this was as part of the campaign, party trump's campaign team. i think it'll get kicked back in the -- we're not quite sure exactly how this will play out over the coming months and what i

. >> reporter: fani willis is calling on mark meadows to testify before the special grand jury investigating effortses to overturn the 2020 election this georgia. in a new court filing the d.a. calls meadows a material witness this her ongoing criminal investigation and she is seeking his testimony on september 27th. meadows was on a call between trump and georgia secretary of state brad raffensperger in january 2021 in which trump wanted him to find exactly 11,780 votes that trump needed to win the state. meadows also made a surprise appearance at a location in cobb county, georgia where officials were conducting an audit of an sen san bern absentee ballots. and meadows wanted them to investigate allegations of fraud. and the d.a. is seeking testimony from sydney powell and also james wallwaldren. >> and so even more to talk about that the point. the fulton county d.a. is looking for testimony from trump's former chief of staff. pretty close to the center of his orbit at least while he was in office. what do you think this tells us or signals about the state of where her investigation is? >

down there, fani willis, doesn't also get, eventually, she hasn't made the decision yet, but eventually get to saying the same about trump. so, trump is also at great risk, even if it's not named yet. >> elie, you heard there from rudy giuliani that he says that he won't answer any questions that are covered according to him by attorney-client privilege. how's that correspond with the law? >> not at all. there's all sorts of wrong in the way that rudy giuliani answered that question. first of all, attorney-client privilege could only possibly apply to conversations between rudy giuliani and donald trump. all rudy giuliani's conversations with other people would not be covered by attorney-client privilege. second of all, even if there was conversations between giuliani and trump, if they had to do with an ongoing crime that they were committing together, and prosecutors may need to dig into this, then the privilege does not apply. the most ridiculous thing that rudy giuliani says is, a lot the statements i made, i did that because i was representing donald trump. okay. that is not an exc

>> so, what is clear about this investigation is that fani willis is intent on speaking with all of therelevant witnesses, in her moving papers in court, she has indicated that she needs to speak with some of the people like governor kemp, who has done everything he can to elude her, to make sure she is identifying all the witnesses. speaking with everyone with relevant information, that sounds like the sort of thing a prosecutor does when they are dotting their i's and crossing their t's, as they near the end of the investigation, trying to make sure that there is nothing out there that they are unaware of. whether or not she will end up subpoenaing donald trump, i think is wide open. part of the reason is that typically when you put a target in front of a grand jury, if the former president becomes a targeted in that investigation, then there are 15-minute implications. often, that come become very messy. i don't think it'll be very surprising to see the wrap without putting donald trump in a grand jury. she has certainly made a good faith effort to get testimony from everyone who can
