frank holland knew reports that the merger could be in trouble let's start with elizabeth out in london big deal between apple and qualcomm elizabeth. >> apple and qualcomm celtsing in a long-running legal battle just as opening arguments were underway in a trial between the two companies yesterday. the surprise settlement sending qualcomm shares soaring more than 20% marking the company's sickle biggest day gain in nearly 20 years. investors welcoming the end of this huge legal overhang on qualcomm's core business which is patenting and licensing chip technology the settlement ends all worldwide litigation between the two companies and essentially paves the way for kwaul come -- the deal includes a one-time undisclosed payment from apple to qualcomm and a six-year license agreement effective april 1st with the option to ek tend for two more years. it also includes a multi-year chip set supply agreement. qualcomm saying the terms will boost its earnings per share by glars 2. shipments ramp up. this is a huge vindication of the qualcomm business model. it suggests apple had run out of op

let's get to frank holland right away with details on this breaking story frank. >> hey, good morning, brian. just minutes ago authorities released a preliminary report on last month's ethiopian airlines crash. this was the second fatal crash involving a boeing 737 max in the past five months ethiopia's transport minister says the initial findings show that the plane itself was airworthy. she says the flights take-off appeared to be normal. the report also says that pilots repeatedly followed all the procedures, but ultimately, they were unable to control this aircraft it also says there was no foreign object damage to the plane. in a separate statement ethiopian airlines says the report shows that the plane persistently nose-dived before this crash the report calls on boerg to review the controllability of the 737 max. it also says that airlines should verify boeing's software fix before allowing that max planes to return to service. ethiopia's transport minister says a final report on this crash is expected within one year checking boeing shares right now, down just very slightly in

let's get nor on the details of this big story with frank holland. >> good morning, brian you know, boeingays it will now submit a software fix for those grounded 737 max planes in a few weeks confirming a statement from the faa the company had previously said it planned to deliver the upgrade to the government for approval by last week. boeing now says safety is our first priority, and we will take a thorough and methodical approach to the development and testing of the update to insure we take the time to get it right. more than 300 737 max jets have been grounded worldwide following two deadly crashes one in ethiopia last month, and another in indonesia last october. boeing is under a lot of pressure to prove the anti-stall system on that aircraft, which is believed to have played a role in both of those crashes, is now safe, and pilots have the necessary training to override it when necessary. the company showed some updates to pilots and regulators last week in a sign the 737 max may be out of service at least for a while longer southwest airlines is publishing a schedule for april an
