claudine wong is in fremont. >> reporter: i just got new information from police. they tell us the victims in this case were not in the crosswalk when this accident happened. they are still piecing together exactly what led up to this accident. it happened here at the intersection of mallory and piseo parkway. here's what we know. last night before 10:00 a 17- year-old girl and 19-year-old woman were walking west across the parkway. the 19-year-old was killing a three-month-old boy and all three were hit. the 17-year-old suffered nonlife threatening injuries but the three-month-old boy and 19-year-old were critically injured. >> the 19-year-old was carrying a three-month-old baby when they were struck by a vehicle. >> reporter: the driver was questioned overnight and has been released. all we know about him is he is 64 years old. he did stop at the scene and has been cooperating with police. the roadway was shut down for several hours but it is now back up. its still you can clear at this point if charges will be filed. live in fremont claudine wong ktvu channel 2

"today in the bay's" christie smith is live in fremont. this is one of those terrible stories, christie. it is developing as we speak. what's the latest? >> reporter: good morning. it is a terrible story and a horrible start to the new year for one family. right now, the intersection has cleared. there are quite a few flares left here in the street. a 19-year-old woman is dead. her three-month-old baby boy clinging to life in the hospital. the woman's 17-year-old sister was hit. they were hit by a 64-year-old man driving a pickup truck. he tells police he didn't see them. it was dark late last night. they were crossing paseo padre. the baby thrown into the air by the impact of the hit. as bad as it sounds, there was a slight silver lining. a passer by saw what happened, picked up the child, and drove him to washington hospital nearby. the baby being taken to children's hospital in oakland for treatment. the 17-year-old sister suffered minor injuries in all of this. police are telling us they don't believe alcohol was involved and the drive

to the hospital last night along with her three-month-old baby after they were hit by a truck in fremont. the woman was carrying the baby in her arms and walking with her 17-year-old sister on the parkway when all three were hit by a truck. the baby was thrown from the mother's arms. someone driving by took the baby to a nearby hospital. the child has severe injuries. the 17-year-old was treated for minor injuries. the driver of the truck, a 64-year-old man, said he did not see the three walking and is cooperating with police. no alcohol is involved. we will continue to keep you posted. a setback for the family trying to keep their brain dead daughter on life support. a judge has denied the request to force a breathing tube into her. another facility has agreed to take her. she has been on life support since she went into cardiac arrest following tonsle surgery. they have ordered that they keep her on a ventilator until january 7th. welcoming 2014 is also welcoming a series of laws for californians. new rules and new safety measures to protect the wildlife. >> a big change for k through
