. >> let's dig into all of it with nbc news national correspondent gabe gutierrez and legal analyst danny suvolose. we got this unsealed indictment but there still doesn't seem to be in blank and white why he's being charged with these felony counts, what the basis is for those counts. does that matter? >> it's because prosecutors don't need to. the statute does not require it. the prosecutors do not need to charge him separately with the crimes they're using as a predicate to take what is otherwise a misdemeanor and bump it up to a felony. the statute only requires that the false statements and the business records be made with the intent to defraud, but if in addition they are also in furtherance of a crime, and it can be virtually any crime, there are a list of the crimes but it's not an actual list. it's a very broad definition of what constitutes a crime. so the state doesn't need to actually plead and prove additional crime as a separate count. they just need to allege it, put some proof about it, but they don't need to commit to it right now. as long as they have a crime, they can

i will go to nbc news national correspondent gabe gutierrez who was inside the courtroom. just came out. what can you tell us about the proceeding? >> reporter: lester, this indictment is not a speaking indictment. i can tell you what happened inside that courtroom. definitely had a lot of speaking in it. it is unlike any arraignment i have ever seen. it went on for at least 45 minutes and it devolved into open arguments in this trial. just within the past few moments we learned that the prosecution wanted a trial for january of 2024. just next year. that would place it snack in the middle of a presidential election. since then, the defense came back and said they want a little bit more time and wanted to push it back to the spring. new information we have, it is that over the next few months there will be discoveries and basically the next time a scheduled court appearance for the former president is december 8th. many months from now. still, lester, i can go through this quite a bit. it basically started with the prosecution laying out its case right here. as my colleagu
