and gloria gomez is here with more on what is an unusual case. gloria. >> reporter: it is. this did have an appearance of a revenge killing and new details are coming out. it started on the 13th. the man killed in the case according to investigators started the trouble and the violence in the case. they say michael fuentes went into the house, broke in and that person did survive but fuentes, contacted the family saying he wanted to make the peace with them. that's when the defendant and two others went to meet michael fuentes and he pulled out a knife and that's when things turned for the worse. >> my client drove the ex-girlfriend the subject of the debate drove them. the victim reacted in the knife. the client reacted i would submit, judge and perhaps in defense of others by removing the gun. it was during that time he shot the victim and the victim passed away. there is evidence to support the knife fell out of the victim's hand at the time of the offense. >> and they say he is 20 and never been in trouble with the law. the judge listened to both sides and gave him $100

and gloria gomez has been following this. another death penalty on hold. >> this sis a big ruling this inmate and attorney argued before the state supreme court and they won their arguments. he was set to be executed february 11th. he argued to the supreme court that the execution should be put on hold after the u.s. supreme court ruling that said florida's death penalty procedures are unconstitutional. that the jury, not judges, should make the decision on life and death but the way florida works, the jury makes recommendations the judges have the final say. the supreme court said that is a violation of our sixth amendment. because of the death penalty chaos, it was ruled that the execution will be put on hold. experts say this is huge. now every death row inmate will make the same argument and expect the same results. back to you. >> gloria, thank you. >>> hillsborough police caught a man who shot and killed a person last year. he got into a fight over owed money. rogers pulled out a gun and shot the victim in the chest. he
