correspondent bryan llenas live once again for us in harrisburg, pennsylvania. hi. >> hi, martha. ania republicans, the trump campaign and ten attorneys general from red states have petitioned the u.s. supreme court, urging them to take this case up. under pennsylvania's act 77, mail ballots must arrive by 8:00 p.m. on november 3rd to count. pennsylvania's supreme court bypassed the legislature and extended the deadline by three days, which meant as long as mail ballots were postmarked by november 3rd and arrived by 5:00 p.m. november 6th, the account. republicans argue the extension is unconstitutional. pennsylvania's department of state estimates approximately 10,000 ballots arrived within this three day extension. even if the u.s. supreme court decided that all of these votes are invalid, it's not enough to overcome biden's lead, which is over 49,700. and the lead is growing as 45,000 mail ballots are still being counted. republicans are also eyeing provisional ballots. there are some 94,000 provisional ballots, four times more than in 2016. provisional ballots are cast by voter

i have reporting from harrisburg, pennsylvania an open race going there and big delegate hall for obviously, whichever candidate can win the electoral vote. chris jansing reporting. what are you seeing? >> reporter: we have new numbers for you. we watched the race tighten throughout the day. still the president leading but by a few hundred thousand less than he was when we woke up this morning, if anybody ever went to bed and not that biden came out saying he believes he'll win pennsylvania. here is the way the numbers are right now. there is still 110,000 votes around pittsburgh. in fact, they think they are going to finish voting by the morning. they will keep working through the night. the pittsburgh steelers say they'll send dinner to the workers. in philly, they don't want to tell us when they think they'll be done. they have 120,000 outstanding votes. when you talk to commissioners, they think it will be as late as friday when the last of the mail in ballots will be accepted. at a 78% rate for joe biden, the mail in votes so far, that's the reason the campaign feels good about it beca

we want to begin with dasha burns in harrisburg, pennsylvania, with a look at those provisional ballots that are still being counted today. good morning. >> reporter: peter, good morning. according to the secretary of state, at least 100,000 provisional ballots in the state of pennsylvania, this number is higher than usual. why is that? well, it actually comes back to those absentee ballots. there are voters who requested a mail-in ballot but changed their minds, wanted to go vote in person. these rules vary by state. here in pennsylvania, here's what you had to bring to the polls with you if you wanted to bring in person instead. you had to bring the absentee ballot, the secrecy sleeve, the voter declaration envelope in which you should have sent your absentee ballot, and the envelope in which all of these materials came to you. you had to bring all of this to the polls. none of this could have any sort of markings on them. if you did that, the election worker could then officially spoil your absentee ballot and give you a regular ballot. but if you forgot any part of this or maybe you

i'm in harrisburg, pennsylvania.f a line here at this voting location, but it's not too bad. things have been moving pretty quickly, so all in all, i think people had a lot of concerns about how things would be going today on the ground, and things have been going pretty much according to plan in the counties we've talked to. of course, the big x-factor is what's going to happen to these mail-in ballots? it wasn't until 7:00 a.m. today until this county could start counting the ballots. they had to take them out of the secrecy envelope, flatten them, put them in the scanner. they'll be working 24/7 to move this county along. we know there are some counties who don't start this process until tomorrow. when they started earlier today, she said, this shouldn't really impact the vote. it's these big counties that will have the brunt of the more than 2.5 million mail-in ballots that have already been returned. we just don't know when we'll get the results. the polls close at 8:00. it may take a while to count these ballot

let's bring into the conversation msnbc senior national correspondent chris jansing live in harrisburg, pennsylvaniathe count there? >> reporter: so, it is been tig tightening all day long and heading toward joe biden this morning around 9:00 it was about 160,000, now you look at the difference and it is just over 90,000. that is exactly what was expected. and then there was a big headline from kathy book var because she suggested in an interview there could be a winner tonight. well as you heard her, she seems to be backing off that a little. but the one thing that century chasing is the basic numerology. because she talked about provisional ballots, in pennsylvania this is one of the states with the lowest number of provisional ballots, unlikely to make i big difference. she talked about the military and foreign ballots, those are always by law allowed to come in until next tuesday. again, a number in the fairly small thousands of those. the big number is those several hundred thousand outstanding mail-in ballots. and this morning i talked to a couple of democrats who had just gone into a briefing

pennsylvania. she's in harrisburg. dasha, what do we know about when we could expect another update there? >> reporter: i'd love to gif you -- give you a good answer to that, craig, but the reality is we don't know and we likely won't know until we actually get an update. philly has been teasing some drops, but those tend to be delayed, and most counties in the state took a break overnight, and so it's unlikely we'll see any update or any new numbers until at least mid-morning. it's interesting, craig, i got here yesterday from michigan. i've been covering both of these states. both states have their first presidential election this time around with no reason absentee voting. it's now in both places. in michigan we got those results on wednesday and it's largely because they were able to do what's called free canvassing. they could start opening those envelopes on monday which saved them a whole lot of time. here we are in pennsylvania, still around 100,000 mail-in ballots left in this state. we know those tend to favor joe biden. there's also those 100,000 provisional ballots mark was jus

here in pennsylvania i've been talking to election officials for months. looking at harrisburg and saying, please, let us touch those ballots earlier. let us get a head start. that did not happen so here we are now. everything that has unfolded in pennsylvania so far was frankly as expected. it's what we're reporting. it's what democrats have been hoping for. as soon as i landed here i met with democratic sources. they continue to be optimistic, hopeful. they are just playing the waiting game. the majority of absentee votes as we've been hearing from mr. kornacki over and over again, they are overwhelmingly favoring joe biden. there are several lawsuits here in pennsylvania. i asked my democratic sources about any of those, if they are a concern. they said no. so far, several have been dismissed. other rulings that have come out haven't necessarily changed the game here. even last night justice alito issued an order. the republicans had been asking the supreme court to get this state to stop counting ballots that arrived after election day. the state right now has allowed any b
