let's bridge in sunny hostin. sunny, what do you think?two justices remove themselves from the health care case? >> well, you know, if you look at the history, i don't think that's appropriate or necessary in this case. i mean, when you think about justice thomas, they're asking that he recuse himself because his wife virginia is opposed to the health care law. judges are allowed to have their own personal opinions and their families and friends are allowed to have their own personal opinions. i don't think that would affect justice thomas in any way. i think elena kagan's position is a little more tenuous, a little -- it's a closer call in the sense that she was the solicitor general for obama had when this law was passed. and my understanding is she sent an e-mail to harvard professor larry tribe expressing sort of her excitement over the law, saying, wow, we've got the votes. so when you look at that, that's probably a closer call, but the bottom line is, it's up to justice kagan to recuse herself. she's given no indication she will rec

sunny hostin has the case.nd was outside the courthouse and says the jury has come back looking for evidence. what does your gut tell you, will we have a verdict today? >> we may no i will tell you this had is a one-count case, i thought perhaps when they went into the jury room and took their initial vote after electing a foreperson that we could come back a quick verdict, that usually inures to the benefit of the prosecution. but as things drag on, that usually swings toward the defense. so, the fact they are now asking for pieces of evidence, asked for a break, taken a lunch break they can mean this is a jury going over the evidence, brooke, they are discussion things, the defense here to rained prosecution theory, which we know works so, so different, quite possible we don't get a verdict back today. >> was it a mistake, sunny, not to sequester the jury? can these jurors really resist reading, watching the news about the case? nch>> maybe i'm just not a trusg person, brooke, but they have been admonished no

sunny hostin is back on the case today. they took these kids away from parker's ex-fiance yesterday so why give them back today? >> i think it's pretty remarkable but the judge found in an emergency hearing that there wasn't sufficient evidence to keep them away from their father. remember, in these kinds of custody cases are, legally what is in the best interest of the children? and courts are loathed to take the children away from the primary parents even in cases where they are the primary suspect in a disappearance. so they are astounded that in such short order they were taken away and then given back. >> how unusual is it to then leave the children back in his care? >> i think it's very unusual there are not a lot of cases like this, quite frankly. but those that have occurred, it's very unusual for the prime suspect or in a violence or murder case to be returned to the purported perp. it's very unusual. >> michelle parker is dead. listen to what he said. >> statistics sadly suggest that when someone has been missing

let's go to sunny hostin.ith us yesterday, he could get up to four years. many predict that won't be the case. why is that? >> i think that's right because the new law has been passed to sort of realign the california system. the prison system because of overcrowding, many nonviolent offenders, and even though he was convicted of involuntary manslaughter, it's not deemed top violent, so he may not serve prison time. he could be transferred to l.a. county jail. they are also overcrowded. lindsay lohan got sentenced to 30 days and served 4.5 hours in county jail. it's likely that while this judge may give him up to four years, it is likely he won't serve that amount of time. >> i imagine the plan is to appeal, sunny. what are the chances of it working? of them being successful in that appeal? >> you know, people are saying that certainly they will appeal. the defense team has indicated that. there are always issues on appeal, but the interesting thing is again, by the time the appeal winds its way through the sy

let's go to sunny hostin.im, doubt with paterno out, and we know sandusky has been gone, will it be easier for them to come forward? >> you know, i certainly think that there is strength in numbers when it comes to this kind of thing and i think people are strengthened when they know that they're not alone. so i suspect that we will hear unfortunately about other victims coming forward. i think there's no question that those victim will be suing the university and all of the folks that were involved in perhaps the cover-up, involved in the allegations, helped enable sandusky to perpetrate these terrible crimes on these boys. and i suspect that these are cases that will be settled privately. i don't think that the university, given their stance, given that they have let paterno go, they have let the school president go, it is obvious that they are going to be aggressive in their internal investigation. these cases that i hope not to see tried publicly. i think these will be private settlements. there will be so

sunny hostin is on the case.t's next. you >>> a 17-year-old murder case that put these four teenagers in prison busted wide open because dna evidence points to a different killer, a man who was shot and killed three years ago. sunny hostin is on the case. those men were teenagers then, today, obviously adults, asking a judge to vacate their convictions. the judge was supposed to issue a ruling this hour. do we know anything? any word? >> no word yet but of course this is a case that sort of captured national headlines, everyone is looking at this case. the innocence project is involve ready. we know that they have been pretty successful and pretty successful in cook county in chicago where this took place. i have been told that the wrongful convictions at northwestern says there have been more than 100 exonerations in illinois since 1989, brooke. and of those, 31 involved new dna evidence. and that's the case here. interestingly enough, all of them were convicted. they all confessed but there was no dna evidence
