. >> nbc news correspondent ron allen joins us and also with us, laura jarrett. ron, let's start with you. i understand we've got some new information. >> yes, according to three sources familiar with the situation with the grand jury, we now know that the grand jury is not going to meet tomorrow. their usual days are monday, wednesday and thursday and we also understand that thursday when they meet they are not going to deal with the trump matter. there are other matters that the grand jury is looking at. new york is a busy place and that means we are not expecting a vote by the grand jury this week. it's now been some ten days or so since we first got that signal when trump's attorneys were offered the opportunity for him to come and testify before the grand jury and it's been about a week or so before trump said he was going to be arrested on tuesday of last week. >> that is a week from today. >> meanwhile he continues to blast the whole process on social media and on tv last night on fox calling it the new form of election interference. >> laura, let me bring

nbc's dasha burns is outside mar-a-lago in west palm beach, laura jarrett is nbc's senior legal correspondent. and glen kir in kirschner is a federal prosecutor and msnbc legal analyst. garrett, what's the latest what have we learned today >> reporter: chris, as you pointed out, the grand jury voted to hand up this indictment yesterday. it remains secret and under seal, but we've been able to report there are some 30 separate charges in this indictment, mostly relating to document fraud now, most of what's going to happen between today and tuesday are behind the scenes negotiations with trump's attorneys and the d.a.'s office as well as some planning by secret service and the various security apparatus in new york city you can hear some of that behind me, an ambulance coming behind me as they try to prepare for what will be the second sort of truly historic day in this process that will be the day where donald trump has to come into the city to be arraigned he will stand before a judge in the courthouse behind me after surrendering, after being fingerprinted, after having his mug shot and a d

joining us is nbc news senior legal correspondent laura jarrett. issues. what's at stake here? >> a lot is at stake for this tribe obviously. 30% of the residents in this community do not have access to running water. so this is obviously critical for them. as you mentioned, the argument is just getting under way now. you already see the justices pressing the government about how can you say -- if you have to provide access to this land, whichever one agrees that the government does have to provide access to the land, how can you provide access and not say that includes a right to running water. justice warren saying if you have to provide access to the land, how are you supposed to provide for cattle, animals that need access to drinking water. that can't place unless you have access to water. our lawrence hurry went up and spent time with the tribe, saw how folks not only don't have access to water, but going miles to get it, filling up buckets, taking it back to their communities. it's obviously a case that has deep social justice implications.

laura jarrett, thank you for your reporting. for more on this, let's bring in msnbc legal analyst lisa rubin and paul henderson, a veteran prosecutor and trial attorney. pence gets this narrow victory here on the speech or debate clause. he may not have to talk about what it was like in the chamber while he was acting as president of the senate. how valuable is his testimony more broadly in the special counsel's investigation? >> anybody who's read "the wall street journal" piece that pence excerpted from his book, garrett, knows just how valuable pence is of a witness. he met multiple times with donald trump alone where trump tried to persuade him to go his way with respect to the events on january 6th. he also had a meeting famously with trump and john eastman where they also tried to persuade him that he didn't have to reject the electors, or i'm sorry he didn't have to accept the fake electors. he could reject the ones that were legitimately sent, which would effectively freeze the presidential election and create a new open

joining us now is laura jarrett. she is nbc news senior legal correspondent. laura, it's really nice to see you. thanks so much for being here. >> absolutely. thanks, rachel. >> let me just ask you a threshold question that a bunch of people have asked me today. i just want to clear it up because i feel like you understand this stuff as well as anyone. when former president trump said this weekend he is going to be arrested on tuesday, meaning tomorrow, and he called for protests in response, is there any reason to believe that was based on anything real? is it in fact clear to us that he was -- that he was just spitballing, that nobody knows if or when any indictment might actually happen? >> it is our best understanding based on reporting that that was not based in any substantive conversation or any sort of tip-off from the district attorney's office to trump's attorneys. it is our understanding that if in fact there is an indictment, if and when that should happen, the district attorney's office would inform trump's defense attorneys that their client need

senior legal correspondent, laura jarrett, and nbc news correspondent vaughn hillyard in west palm beach near former president donald trump's mar-a-lago home. how is robert costello, i was going to say corcoran, so many c names. robert costello, relevant? >> the idea is we expect him to attack cohen's credibility. you might wonder why is that necessary given that cohen pled guilty. the credibility issues there are basically well known at this point. >> they have been talking about it in court papers repeatedly. >> exactly. and you would think that the prosecution has laid that out for the grand jury, and cohen has probably already sort of previewed the issues of why his story has changed. it doesn't stop costello from providing that context for the jury, but the grand jury can decide what weight to give that if any at all, and so it's interesting to see why do it this late in the game. train may have left the station. >> is that at the request of donald trump's team? >> that's our basic understanding. instead of donald trump testifying himself, you can send in this witness. query whether
