my favorite justices john marshall. -- justice is john marshall. justice,te current justice breyer. i would put down john marshall because he did more than pitney. he was a great judge. but he was also sometimes a fastest upper -- fast stepper. and i do not like fast stepping. my favorite was the one that set out a perfectly comprehensive view of the commerce clause which has been mauled into nonrecognition. when people -- this is what i do not like about judicial interpretation. they changed the words. -- they change the words. the justice says that comprehensive is the word. it is restricted. done, thee it is first clause disappears and we are told the commerce now extends to those things that involve more states than one or affect more states than one. the word restrict is removed. why is this important? he was writing in 1824. that, the changed federal government could outlaw slavery. i'm in favor of that. but the entire constitutional convention recently had to have a compromise over slavery. and one of the pieces of that was limited federal jurisdiction. in terms of how they d

in response to that decision and for years particularly the opinions by john marshal the amendment really was construed very narrowly to apply only to cases in which the state itself was concerning sovereign immunity. he basically construed it anyway that relief had been granted against other state offices the amendment would be no obstacle. that was basically the state of the law until after the civil war and during the period of reconstruction process reinterpreting the rules began and particularly in cases rising out of louisiana. the court first held that's louisiana could not welch on an obligation. a few years later after there had been a change in administration and the northern troops have been removed from the south the clerk took the opposite view and cited a case which really is inconsistent with marshall's early ruling. i really think there's a connection between the reconstruction of states rights attitudes that developed in those years and the doctrine of sovereign immunity which later on became not only detected from paying their debts but it developed over the years and th

i would love to write a really great biography of john marshall. the problem is he destroyed all his correspondence. you don't have the same level of information that you have -- you have all of this legalistic information about his cases and the papers have been published at the college of william and mary. but, this is a guy who was a real stud. [laughter] this is a guy who like at valley forge was known as -- high jumper -- he won all the athletic competitions. he was the leader of the equivalent of a special forces team throughout the war. he had six or seven platoons from under him. and then goes on to be a major figure in virginia politics and then secretary of state for a brief time under adams and in the greatest chief justice in american judicial history serving from 1802 1835, 1836. i used to tell a story when marshall died he was visiting his daughter in new york and they carried the body down to his home in virginia and when they passed through philadelphia, they rang the liberty bell and it cracked. this sounds very much like the rhetoric, the kinds of arguments that were marshalled before the iraq war and the reaction as john showed us this partisan split after the iraq war. but this isn't the iraq war. this is the spring of 1999, and we're talking about kosovo, right so, the party of opposition of republicans, party b, the party supporting the president noted hawk paul wellstone. we have these kinds of arguments here marshalled in the iraq war and also marshalled in support of the kosovo intervention but by the different parties. so this gets at what jason was saying, yes, we need to consider in theory the kinds of arguments people are making, but the argument i'm making in my book is if we just look at who says it, not what they say or how they say it, just who is taking the position, who's supporting the war, who's opposing us, that can get us to explaining the majority of support for war. so in my book, the central argument i'm making is that what we learned in about 65, 75 years of study of american public opinion can and should be applied to foreign policy a well. not just about domestic politics. op
