john rawlins is at the beach in delaware another spot starting to see the effects of josÉ. latest word from the national hurricane center tonight. >> hi, rick. we just got the latest update. hurricane jose remains a weak category one hurricane and fortunately it is pretty far off the eastern seaboard. the center of the storm is currently about 250 miles east of the outer banks and you can see that we are beginning to see the outer cloud bands of josÉ moving in but the good news is with this storm as it tracks up to the north, the sustained tropical storm force winds, you can see that in yellow, they will stay offshore. so the national weather service has canceled that tropical storm watch but it's still going to be a very gusty day along the coast. this is what we expect. not sustained winds but wind gusts along the beaches 40 to 45 miles tomorrow as josÉ gets closer inland towards philadelphia about 30 to 40, northwest suburbs wind gusts about 20 to 30 miles per hour but the big problem with josÉ at the fact that i

john rawlins live now with more. >> reporter: hi rick, the basic facts of this case, known to all of us. eight people were killed on the night of may 12th on amtrak 188 traveling in the 50 miles per hour zone at the time but traveling over 100 miles per hour at the time of the crash. brandon bostian the engineer in court today. he is, as you say, charged with involuntarily manslaughter and reckless endangerment for the eight people killed. the state prosecution started to put on evidence and testimony in an effort to convince the trial judge that this case should go forward and indeed it was a crime as to what happened and brandon bostian committed that crime. and they called first responders and one injured passenger, a young woman by the name of blair ber man. she testified she had interaction with bostian after the crash and asked to use his phone to call her father and he refused and finally won the argument but at the time she did not realize he was the actual engineer of of the train just an injured passenger. and a question raised by the prosecution that bostian may have had a

live in west chester, john rawlins channel6 "action news." monica. >> thank you, john. >>> the ntsb trying to figure out what caused a plane crash in montgomery county. that crash happened yesterday afternoon in whitpain township. the plane hit some trees and bushes here before slightly damaging a house. officials say the plane had just taken off from nearby wing's field. a witness to the crash who did not want to be shown on camera saw the plane struggling before takeoff. >> noticed that it didn't seem to be getting the amount of rpm's that it should be getting and then it started to roll down the runway i knew it wasn't getting the full rpm's that it should get because it took most of the whole runway to take off and that plane's a light plane and it should have been off the ground sooner. >> the person who lives at this house where the plane hit was not injured. the pilot has been identified as philip beckner, a 29-year-old from maryland. right now he's in critical condition at penn presbyterian hospital. >> ♪ >> all right, developing news

let's get caught up with john rawlins live in west chester with today's new developments. hi, guys. well, the authorities set aside time to pick a jury today but as you say new evidence turned up over late last week to the defense altered the landscape here. that prompted the two guilty pleas, one for assault the other for fleeing arrest. as for the man who was the target of that assault he is relieved that things are winding down. >> yeah, just happy it's over. you know, every now and then -- the fact that it's over. >> reporter: in this video from last may michael ryan who has cerebral palsy in the gray shirt walking out of a 7-eleven. he is mocked and then punched in the face by barry baker. until today, baker had claimed while the attack was wrong, the video didn't tell the entire story. his defense, he and michael ryan had traded insults earlier at this nearby pub barnaby's but a check of barnaby's surveillance video and a system that records all patron's photo id's dashed that claim.

rawlins is accused of shooting and killing john lee in haverford township back in july. the apparent random shooting shocked the community. he also allegedly fired shots at two people in the overbrook neighborhood hours before the murder. >>> a deadly crash caused big backups during this morning's commute on i-95 in wilmington. sky force 10 flew over this crash around the frawley stadium around 7:30. one car was smashed and looks like it caught fire there, clearly. the other car also has front end damage and its door was ripped off. southbound lanes were closed for hours while crews cleaned all this up. at least one person died in this crash. state police are investigating. >>> a live look over the controversial statue of frank rizzo. the monument was the scene of another flare-up today as the city works to figure out its feat. police blocked the statue with their bikes this morning after several people showed up with flyers. there have been renewed calls to tear the statue down. those calls coming from people who say that rizzo treated the black community unfairly durin
