i'm jon kelley. >> i'm laura garcia-cannon. the b.a.r.t.xtension in the south bay is back on track this morning, but with progress comes the cost for commuters. christie smith is live in san jose where work on the first phase will impact traffic. >> reporter: good morning to you. that's right. the work begins in just a couple of hours near where we're standing this morning. to ramp up for the b.a.r.t. extension. what this means is if you are going to be around the san jose flea market area, at least the main entrance, that this could affect you if you're driving at least for the next ten days while work is going on. in the long run it will be a major improvement for public transportation. there will be a temporary lane change to know where utilities are before they start. traffic will be impacted around berryessa road and mayberry road. use the road to the north armckee road to the south of where the work is going on. the b.a.r.t. project is a 16-mile extension, the first phase, the berryessa extension, is a 10-mile, two-station extension.

i'm jon kelley. >> and i'm marla tellez. we begin with a key decision on gay marriage in california. the 9th circuit court of appeals announcing a short time ago it will not rehear a legal challenge to the ban on same sex marriages. nbc bay area christie smith is live in san francisco to show us the impact of today's decision. christie, good morning. >> reporter: good morning to you, marla. there were no crowds outside of the courtroom as there have been in the past. no cheering. only a seven page document that was handed out just before 10:00 this morning, basically saying the 9th circuit court of appeals refused to reconsider a ruling from february that struck down proposition 8. there was one lone demonstrator outside the court in san francisco. many say they basically expected this decision for an 11 judge panel not to rehear a ruling that found the 2008 law unconstitutional because it strips gay and lesbians from the right to marry. they now have to look to the supreme court for answers. supporters say this is the next

i'm jon kelley. new this morning fire investigators at the scene of two suspicious car fires on the peninsula. they happened on lydon street in redwood city. the two cars were about a block from each other. one in a driveway of an apartment complex t other on the street. crews were able to put the fires out before the flames spread to nearby buildings. >> also new this morning, a destructive house fire in hayward, a home still standing thanks to quick work by firefighters. the blaze broke out off mission boulevard. bars covered the windows. they had to use a saw to get inside. investigators say the fire started in the kitchen but spread to the attic. luckily no one was hurt. >> friends of a family lost -- that lost a father and daughter 18 deadly crash are demanding justice. they created an online petition asking to prosecute the driver suspect fd killing the two. police recommending the teenager face vehicular manslaughter charges. police say he was speeding when he jumped a curb and hit the father

. >> good morning, everybody, i'm jon kelley. and new this morning, police investigating a deadly overnight shooting in east palo alto. bob redell is live at that scene right now with the latest developments going on there. bob. good morning. >> reporter: good morning to you, jon. we just got done speaking with east palo alto police. they are getting ready to clear the scene. the shooting took place on the 2,500 block of gloria way. you see that silver suv right there. on the other side is where a man was shot and killed around 11:44 last night. they're so precise on the time is because they found out about this through shot spotter technology. that's the technology set up here in east palo alto where you've got microphones that are able to triangulate the shots, according to the technology indicated there were nine shots fired, police were on the scene within one minute. they describe a scene of a lot of people out front with a man on the ground, shot several times very hysterical people while the man was somewhat responsive. th

i'm jon kelley. new this morning we can tell you about two fatal crashes on south bay roads a few hours ago a motorcyclist killed on north first street and nortech parkway in san jose. police found the 38-year-old driver down in the middle of the street. investigators at this point don't know exactly how this happened but they don't believe any other cars were involved. speed suspected as cause of another crash in san jose, a driver died after being thrown from his car in a rollover crash. the off ramp shut down for several hours for that investigation which included using infrared technology. >> all eyes on the supreme court this morning. in one hour the highest court in the country will issue a ruling on president obama's affordable health care act. it's a decision that touches millions of americans. christie smith joins us live with how it could impact the golden state. good morning. >> good morning. there is a lot at stake here where the state has moved aggressively to implement this law. more th

i'm jon kelley. >> i'm laura garcia-cannon. new this morning a bizarre internet post from someone claiming to be sierra lamar catches the attention of investigators. it prompted deputies to check it out. good morning, marla. >> reporter: good morning. sheriff deputies here tell us this post was noticed just before midnight. it has been removed but we can give you a look at it. we must say it is extremely disturbing. take a look, you can see an instagram photo of sierra and a message attached to it. deputies say it is only a hoax. the message reads please call the police he's coming back. then it goes on to list an address in saratoga. investigators say they spent the morning checking out the post and location but it turned up nothing. what is interesting is the street itself does in fact exist in saratoga. about two months ago someone hacked the missing 15-year-old's twitter account, that was determined to also be a false alarm. lamar was last seen in morgan hill more than three months ago. less than a month ago deputies arrest

i'm jon kelley. we can tell you two key players in the saga of the san francisco suspended sheriff ross mirkarimi will be testifying. christie smith is live in san francisco where more drama is expected in a few hours from now. good morning. >> reporter: good morning to you, jon. embattled sheriff ross mirkarimi will continue his testimony today. yesterday, he testified for about an hour, and he did admit that he grabbed his wife's arm and bruised it. he also said that he took responsibility for that and that he regretted it. mirkarimi is being questioned by the city attorney's office as he fights to keep his job. the city attorney is trying to prove that the domestic violence altercation on new year's eve with his wife is official misconduct. first focusing on the sheriff's code of conduct that says a felony or misdemeanor conviction reflects poorly on the entire department. san francisco mayor ed lee charged him with official misconduct back in march after he pleaded guilty to misdemeanor false imp

. >> i'm jon kelley. this morning a major ruling on health care coming down from the supreme court in a couple of hours from now. this one is a decision that could affect millions of californians. the latest from christie smith live in san francisco with what all of this can mean to you. good morning. >> reporter: good morning to you, jon. there is a lot at stake with this, particularly here in california where the state has moved aggressively to go ahead and implement this law that was signed in 2010. already about 400,000 low income californians receive some sort of service through this. the law contains a number of consumer protections. we spoke with one woman among million who is have health insurance because of the affordable care act that many call obamacare. it was signed into law by president obama in 2010 and at least 26 states are among those challenging it. a key question for the supreme court, can congress require americans to buy something. under the law everyone will have health insurance or

i'm jon kelley. and today a pivotal one in the high profile trial involving a south bay man accused of beating a retired priest. the judge could declare a mistrial after only four days of court. marla tellez joining us in studio with all of the latest details. >> the case of william lynch versus father gerald lindner started a week ago today in san jose and could come to an end today. lynch does not deny beating father lindner, about two years ago. he says he did it out of retaliation for the sexual abuse he suffered at the the hands of the priest in the mid 1970s. the priest took the stand and denied the allegations despite the fact that the church paid a settlement to lynch and a few others a few years back. the father's testimony comes after the prosecutor told the jury the priest would likely lie under oath, so the defense is asking for a mistrial. here's the lead defense attorney. >> this is what's known as suborning perjury. you could be a defense lawyer, you can be any lawyer, you can't get aw

i'm jon kelley. >> i'm laura garcia-cannon. the man at the center of a high profile south bay trial is expected to take the stand this morning. william lynch is charged with assaulting a retired priest but he says it was in retaliation for the priest molesting him. bob redell joins us live in san jose with what is next in the trial. good morning. >> reporter: good morning to you. yes, while the defendant will lynch is expected to take the stand later today at the hall of justice, he will be limited on what he can tell the jury. in other words, it's not clear whether the judge will allow him to say anything about the alleged sexual abuse he and his brother suffered at the hands of father lindner when the boys were young. lynch is accused of beating up the priest two years ago at a jesuit center in los gatos, allegedly in retaliation for the molestation from more than 30 years earlier. in wednesday a worker at the center testified that she saw lynch punch lindner twice and heard lynch yell that lindner ruined the lives of him and

. >> i'm jon kelley. a major victory for the mayor of san jose and blow for city employees. measure b passes overwhelmingly. as a result, the lawsuits, let them begin. we have bob live right now in san jose where a news conference is about to start launching the battles. >> reporter: good morning to you, jon. some affected by measure b are not wasting anytime after the courts open here in downtown san jose. lawyers representing the san jose police and firefighters union asking for an injunction to stop the implementation of measure b. a hearing is expected on that action within the next two-to-four weeks. it is conceivable that this fight could drag on for months if not years. mayor chuck reed has been arguing for the measure to help close the city's budget deficit. saying it will save the city $25 million the first year. enough to begin hiring back police and firefighters and reinstating like libraries and community centers. that's where the unions have the biggest problem. they argue the city is breaking a promise made to their workers. >> we would rather not be here. we w

i'm jon kelley. weir we jump in this morning with decision 2012. this morning, it looks like the verdict is in on prop 29. that would slap another dollar tax on cigarettes. >> it certainly will. close one after being ahead in early counts. now falling behind by about 60,000 votes. taking a look at the leaders. marla tellez is live in san jose with an update for us. >> reporter: good morning, laura and jon. it looks luke $65 million spent by big tobacco to see proposition defeated almost paid off. lance armstrong's live strong foundation and the american cancer society. now one of the authors of prop 29, former state lawmakers says it is essentially a user fee. if you don't smoke withdrew pay. it would tack on a dollar tax to a pack of cigarettes, bringing the total tax to $1.87. money generated, we are talking close to $800 million a we are, would have been used to fund cancer and tobacco related research. our very informal opinion poll out here, we are finding mixed reaction. >> hrts the guys that smoke. i don't see that hurting anything. >> that

. >> good morning, everybody, i'm jon kelley. we start with the nation's employment look. job numbers for may coming out this morning, and we can tell you they're ugly, dismal. the markets not responding well to the news. down about 250. that's getting ugly as the day goes, dropping all day. business and tech reporter scott mcgrew has a look behind the numbers. >> good morning. if the jobs numbers were an economic speedometer, we are in no danger of getting a speeding ticket. the labor department says the american economy added just 69,000 jobs in may, unemployment ticked up 8.2%. huge jobs in construction were lost. participation rate, the number of people looking for jobs is low as well. so few jobs, people stopped trying. the number is now lower than during the recession. the most important consideration here is how our friends and neighbors are doing without jobs, but there's a little aspect to this as well. here is video of president obama, heard from him a few minutes ago. >> as we learned in today's jobs report, we're still not creating them as fast as we want, and

my name is jon kelley. >> and i better leave it there too because i'm laura garcia-cannon.re in the states with decision 2012. in just a few hours, voters will be heading to the polls for today's primary election. it's also the first big test of the state's two -- top two system. good morning, marla. >> good morning. the top two system means majority no longer rules. this pertains to state offices. it does not apply to presidential nominations. the two candidates with the most votes will face off in november even if one earns an outright majority today. it will pit two candidates against each other. another factor is redistricting. new legislative districts have been drawn and this could dramatically affect incumbents. also, voters can support any candidate regardless of affiliation. now, one of the biggest factors according to a political analyst we spoke to is for the first time in california independent voters can vote in today's primary. >> independent suddenly, i guess if they care feel like they sort of won the lottery on this one because now they're suddenly relevant

. >> i'm jon kelley. we start off with breaking news this morning. firefighters dousing two separate fires at the san jose high school in the past few hours. live at the scene right now and all the latest developments. what do you see? >> well, the fires are out. thank goodness for fire and smoke alarms because the fire set beyond that gate there against the wall might have done more serious damage to the building. the library here. the fire department believes it was intentionally set because it happened overnight and not the only one. there was a second fire set in that dumpster not far from the other fire. fortunately, the fire alarm did alert the fire department. this was a little after 2:30 this morning. san jose firefighters were able to distinguish both fires fairly fast. the dumpster fire didn't threaten any structures. but the other, it was a pile of debris outside the library. it did scorch the wall. it started to get up on ton of the ceiling, but we understand that it is superficial damage. and it did send a small amount of smoke in the bu

"today in the bay's" marla tellez live at san jose's municipal stadium, the panda recuperating from surgery. good morning, marla. >> reporter: good morning. certainly has been a tough month for pablo sandoval who has you mentioned has been recovering from an injury. he had surgery on his left hand at the beginning of may and as you also mentioned, he's now in the minor leagues playing with the san jose giants. now he is being investigated for sexual assault. now a woman is claiming that sandoval sexually assaulted her friday morning at the beach resort. santa cruz sheriff deputies say the two met thursday night. sandoval voluntarily met with investigators on friday to talk about a "consensual personal relationship of a sexual nature that took place earlier that day." now, before the cameras, sandoval is keeping it together, seemingly unfazed by these allegations. >> right now i'm happy bec

i'm jon kelley. >> i'm laura garcia-cannon. lots to get to. let's check the forecast and say good morning to meteorologist christina loren. >> good morning. one day closer to friday. 55 degrees right now in livermore, it's comfortable out there. throughout this afternoon another day with unseasonably cool temperatures. this morning you might have to turn on your windshield wipers up and down the peninsula, even in the north bay a little drizzle from thick fog. i'll let you know when the sun's going to break through. first, see how your drive is. >> we have to slow it down a little bit. 680 south of that walnut creek interchange, highway 24, we're looking at a disabled truck in lanes. we don't see slowing but it has been there about 20 minutes. and reports are it's in the middle of the freeway so one of your second or third lane. watch for activity. no reports of problems as far as the sensors go. further south, more flashing lights, your typical closures for off ramps for 680 both directions for the next hour. we'll watch as those clear up. >>

it is now 6:00, i'm jon kelley. >> and i'm laura garcia canon. a man accused at shooting at a sheriff deputy is now in custody after a long standoff. the suspect surrendered around 3:00 a.m., seven hours after barricading himself inside a house on high street in oakland. now initially the suspect had held a man, woman, and a child hostage, but all three were released safely just before midnight. oakland police tell us the suspect spent most of the night inside the home pacing with a gun and a cell phone. police say the suspect is one of three men who fired on sheriff deputies then led them on a car chase near 41st avenue and international boulevard last night. two of those suspects are now in jail, another is still on the loose. >>> on now to decision 2012. yes, it is election day and the polls will be opening about one hour from right now. this year, the ballot a little different this time around. california voters testing a brand new system in selecting those candidates. marla tellez is live in san jose with more on this major change out there.

it's 6:00, i'm marla tellez in for jon kelley. >> and i'm laura garcia-cannon. we begin with breaking news this morning. right now police at the scene of a deadly early-morning shooting in san jose. good morning. >> good morning, laura. it appears a coroner has arrived here in the 2,100 block of center road. this is a trs is a strip mall, industrial area. the shooting happened at about 2:34 this morning and police arrived, pronounced the victim dead at about 2:53 this morning. all we know is that he is a 24-year-old male. he was outside of a karaoke bar. one witness told me that he heard there was a fight outside that karaoke bar, and then the shooting. i did go out to the parking lot area and there is the body still lying out in that parking lot area. however, the coroner has arrived and so the crime scene should be cleared, i would say within the next hour or so. they have not identified the victim. they are still waiting to notify kin before they do that. but i asked one of the commanders out here if the suspect was still at large or if he was in custody. all

. >> i'm laura garcia-cannon in for jon kelley. prevention and protection. after a spike in homicides, the city of san jose is rolling out a new strategy to stop gang violence. nbc bay area's damian trujillo is live in san jose with details of a new plan unveiled this morning. good morning, damian. >> reporter: good morning, laura. for the last six hours the city leaders have been talking about how to address the growing gang problem. today they heard first hand from a grieving family right here in san jose, how difficult it's been for them. a family met with me outside of city hall before the news conference today. their son, alberto reyes, was beaten to death at roseville park a couple months ago. he was playing a game of pickup basketball with family members when he was attacked by gang members. police say the 14-year-old was not a gang member and was attacked for no reason. the family told me they're even afraid to return to the crime scene, roosevelt park, to drop off flowers or light a candle fearing for their lives. of the 19 san jose homicides this y
