we're going to begin with nbc bay area's kris sanchez, live outside of the courthouse in san jose. a much different scene than we saw a month ago when we dealt with elizabeth holmes' sentencing. >> reporter: yeah, it was a very different scene outside the federal courthouse here in san jose, as sunny balwani arrived for sentencing, than it was a few weeks ago when we saw elizabeth holmes come for her sentencing. far fewer people, far fewer members of the public. another big difference is that though he was convicted on more charges, his attorneys are asking that he do no prison time. this was him arriving this morning with his attorneys, and, again, fewer people out in the crowd. balwani was found guilty on 12 counts of wire fraud and conspiracy against investors and patients, because theranos claimed that its blood testing technology could diagnose more than 200 disease frs a single drop of blood. elizabeth holmes was convicted on just four charges. the reason his lawyers are asking for probation is because he invested his own money, $5 million, and they claim he never used theran

this marks san jose's 31st deadly accident involving pedestrians this year. the city's highest number on record. kris sanchez will join us with a live report in our 5:00 hour. >> sunny balwani will serve 13 years in federal prison. the former theranos president was unemotional in court yesterday when he learned his fate. jurors in july found -- they convicted him on 12 counts of criminal fraud. prosecutors were asking for 15 years. balwani's attorneys argued for no time. >> we respectfully disagree with the result in the case. we're disappointed in the outcome and we plan to appeal and keep on fighting for our client. >> the sentencing comes weeks after the ceo elizabeth holmes was sentenced to 11 years in prison. so why is balwani's sentence longer here. we ask one expert about that? >> i think what played in the judge's mind is that balwani is the adult in the room or he was during this whole affair. he was 37 when he met elizabeth holmes. at the time, she was an 18-year-old high school student. he had extensive business experience. he should have known better and he should have shut this thing down before
