julie carey has our report. >> reporter: exhibit a, baxter, exhibit b, baxter's poop.axter's dog walker. her accusers, the next door neighbors. the cornell sisters, virginia and christine. in april they went to file a complaint that kim failed to pick up baxter's poop but kim and her lawyers say it wasn't about it at all. they said the sisters had an ax to grind. >> wasn't really about picking up after baxter or not picking up after him, it was, you know, just another charge against me, another, you know, call the police on me to try to cause harm to me and my family. it really, it was a waste of the court system's time. >> reporter: the cornell sisters came to court with photos taken of kim and baxter and what they claimed was baxter's unscooped poop taken at the penderbrook apartment complex where they all live. some came from a camera they have mounted in their third floor window to keep an eye on the ground below. they said kim didn't scoop baxter's pop on purpose to make them angry. not the first time they accused her of misdeeds. in 2009, kim was acquitted of cha

julie carey has the exclusive report. >> reporter: he's 20 years old and already he had a record that landed him on virginia's sex offender registry. now, he's accused of using facebook to find his latest victim, a 13-year-old girl. he has been arrested for some kind of sexual activity. search warrants say the latest occurred a few weeks ago, inside his apartment at this building. the court documents say he was free from jail a few months. he began communicating with a 13-year-old on facebook where he was using an alias. on september 21st, he convinced the team to come to this apartment where he lived with his parents. he told her to disrobe and took photos. he video taped her performing a sex act. he was arrested, charged with knowledge of a minor. he was also arrested back in april and convicted of sexual battery and contributing to the delinquency of a minor. they question whether he should have been freed from jail at all. rose didn't want her face shown. she encountered him last november when she broke up a sexual encounter between him and a 13-year-old girl taking place in an of

julie carey has the latest on the story. >> reporter: that is one of the four choices in front of the jury right now. guilty of first degree murder or second degree murder, not guilty or not guilty by reason of insanity. an even choice is how prosecutors describe her decision to throw her 2-year-old granddaughter off a sky walk. prosecutors told the jury dela rosa was angry at her place in the world, especially her son-in-law. the prosecutor said when things don't go her way, she gets rid of the problem, isolated herself or gets rid of the person. in this case, she threw the person off the bridge. in her video taped confession, she told detectives she saw jims in the little girl. they urged jurors not to find her not guilty by reason of insanity. her deepening depression produced psychotic-like symptoms. this is not something she chose to do. it's going on inside her head. she could not control it. before closing arguments, the prosecutions mental health professional said it was geared at jealousy, not insanity. that's a conclusion after the psychologist spent ten hours interviewing t

julie carey is live. >> reporter: her worsening mental health and suicide attempts were the focus today a call from the patient a few months before the murder, she said she felt like she was losing her mind. two national park rangers carried pictures to the stand of her van in the trees down an embankment of skyline drive. she tried to commit suicide there in late september 2010. the incident occurred two months before she threw her 2-year-old granddaughter off a tyson's mall walk way. i'm so, so sorry for all the wrong i have done. i love you all from the bottom of my heart. it was the second suicide attem attempt. she's pleaded not guilty by reason of insanity. she killed a little girl to get even with her son-in-law whom she resented for getting her teenage daughter pregnant out of wedlock. her worsening meantal health led to the crime, she was insane. a former public defender recently won a guilty by insanity case. >> the best way to explain it was she was in sane at the time of the offense. a grandmother wouldn't do this out of evil. we live in a world where she was suffering. i'm

julie carey has more on the newly released tape. >> reporter: a video tape confession is the most powerful, critical piece of evidence. defense attorneys argue that carmella was insane and unable to control her actions that night. prosecutors used this video tape to show a cold, calculated killer bent on revenge. the evening of november 29th, the tyson's mall security cameras capture the most retune of family moments. they headed to the food court for dinner. she was in her grandfather's arms. her mother and carmella walk beside. 90 minutes later, an unimaginable horror. the family leaves. this time, carmella carries the baby and carries out the plan to drop her off a walk way. a few hours later, with detective steve needles, he confesses she just lost it. >> are you saying i just lost it meaning, what did you lose? did you lose your purse? >> my mind. >> you lost your mind, okay. when you say you lost your mind, what do you mean by that? >> i did a terrible thing. >> reporter: as detectives probed her motive, she hashed her plan when her son-in-law called that night. she long resented jam

julie carey is in manassas with more on this. >> reporter: the case created a furor when it revealede was in the midst of deportation allowing him to commit a deadly crime. today's conviction is unprecedented. the first time a felony murder charge has been used in this fashion. 24-year-old carlos came to court and immediately pleaded guilty to most of the charges against him, including manslaughter and his third dui. felony murder, they argued the crash that killed one nun and severely injured two others was an accident. there was no malice or intent to kill. >> he had no intention of causing the accident. he did not set out purposefully to injure himself or the sisters involved in the accident. >> reporter: the two nuns were both left with permanent d disabilities. one remembers the car coming at her and hearing a sister moaning. the other sister lost her thumb in the accident and broke 14 bones. sister denise mosier died on the scene. this was the first to arrive on the scene and gave aid to the victims. >> seeing the ladies whose lives are now changed forever. another life lost be

julie carey is outside the courthouse in fairfax with more on this story. >> reporter: an expert says dela rosa says she knows who she was and where stheefs and she had her grand daughter in her arms that tysons night and says what she didn't understand was the consequence of dropping the 2-year-old to the ground below. clinical psychologist michael hendricks didn't come out and say carmela dela rosa was insane. but he did conclude that she couldn't distinguish between right and wrong when she threw her 2-year-old daughter off the tysons walkway. that meets one of the definitions of insanity under virginia law. hired by the defense to evaluate dela rosa hendricks said she suffered from major depressive disorder with psychotic features and says her deteriorating mental health, including two suicide attempts, left dela rosa to experience a type of psychosis that night. forensic psychiatrist ryan sugarman examined many defendants for the courts. >> those that successfully pleaded insanity are found to have psychotic symptoms at the time of the crime, that being said it is not a prerequis

julie carey is live outside the course at this hour ands that latest on this case. julie? >> reporter: the last week and a half we heard carmela dela rosa's friends and families, doctors and psychologists, treat her and talk about her deteriorating mental condition last year. it was up to the defense team's expert psychologist to tie it together and reveal whether or not he thought she was legally insane at the time of the crime. carmela dela rosa couldn't distinguish between right and wrong when she threw her 2-year-old granddaughter off after tysons walkway last november 29. that's the conclusion of michael hendricks, clinical psychologist who evaluated dela rosa for the defense. that's also one of the definitions of insanity under virginia law. hendricks diagnosed dela rosa with major depressive disorder with sigh kotdic features and says her deteriorating mental health including two suicide attempts in the month before the incident left her to experience a type of psychosis that night. hendricks says she believed her family was isolating her, secretly communicating wit
