and she herself, karen said that she was seeking clarity. she was talking to the judge. and i'm not quoting here, but so, in essence, what she was saying to the judge was that, um, she was kind of surprised by this today and that. hold on. i'm sorry. i'm just losing. let me go back. she says she's seeking clarity about the situation between the federal district and state case. and she says she was prepared to go in arraignment on the state charges today in state court. and according to our producer in there, she suggested karen agnifilo suggested that bragg's office. this is the district attorney of manhattan who brought those state charges that he may have not known that there were federal charges being brought against mangione. you know, we've been speaking all morning about just how unprecedented all of this has been. we all were gathered outside the state court, the media, because we were expecting that mangione would appear in state court. and then at the last minute, the fbi and the u.s. attorney's office here are announcing that they were taking custody of mangion

karen agnifilo and mark agnifilo. saw them coming here a couple of hours ago, and now they are meeting with him and we hope to get started here soon. this will be his first appearance. it will be a presentment where they're going to tell him. the judge will tell him what he's charged with. he'll see a magistrate judge. and then we go from there. they will set a future date. but i think what will happen here, obviously will be our first chance, really, to hear from his attorneys. it will be our chance to hear, sort of hear anything they may say about the case. and then we hope once they're done, they'll come down and speak to reporters coming in. they said they didn't want to make any comments, but i think given the sort of last minute surprise here with the fbi swooping in and charging him and sort of taking him away from the state court proceeding, that we all expected today, the way in which he was brought over, helicopters and planes and that very long walk surrounded by dozens of law enforcement officials with wit

i will say one thing and i give karen credit.own karen for many, many years as a prosecutor. this is not to take away from that argument, but i'm wondering if those same arguments were made during her tenure for countless other cases where we hear sort of a publicity and press releases and a lot of action outside the courtroom. >> yeah, there was in this case, though, so much especially as social media exploded, although people were there. and we'll talk about it to praise him in many ways. let me talk about what we saw in court, because this is the first time i've disappointing. yeah, this first time we've seen him in court, because of course, you can't have cameras in federal court. and it was hard to miss that. i don't know if it was by accident or a coincidence or something else or a plan, but agnifilo had matching outfits and you noticed that, you know, she was talking to him, sort of touching him on the shoulder. what do you make of some of these gestures, and is it something that, you know, a good defense attorney will do

karen has a very good reputation, but i can't see it.hink the case here, the evidence, will be overwhelming. so the only chance is some kind of defense. i see two possibilities. the first is an insanity defense. that's a hard one under new york law because he'll have to show that he didn't appreciate his act was wrong. and his confession itself says i didn't use bomb. i didn't want to hurt others. it's too bad i had to do this but they're parasites. i think it's a very, very hard case. and then the second would be to take a second degree murder charge to a first degree manslaughter charge if they can show he was acting under extreme emotional disturbance. and we're hearing a lot about his terrible back pain and his operation and this eight-month period when he disappeared. i don't see that as a very strong possibility, but it would be that. in terms of he's not the guy. are you going to believe your own eyes or not, there's no defense there and someone as sophisticated as karen recognizes that. >> okay. my friend, please stick around bec
