joining me now is katie phang, former florida prosecutor and host of the katie phang show.here you are, katie, i'm gonna have you roll up your sleeves for a second. if georgia does indict trump, what will happen next and will he have to fear it -- appear in person? >> he will, so once the indictment is unsealed, because the presentation of evidence that's going to be done by fani willis is to a grand jury, that is meeting in secrecy. the indictment will be unsealed, and all trump will have to appear for his arraignment. , now this is going to be -- usual for donald trump at this. point this is his fourth indictment. upon receiving that indictment he will have to appear in court, and europe lee, and his bond status will be re-addressed. not like he's going to be taken into custody. however, we do know that there is an intention to handcuff and fingerprint and mugshot donald trump when he goes to fulton county. if that is completely different than the experience he had in manhattan, under alvin, bragg and furthermore, in federal court, so once we have this indictment unsealed

back with me is katie phang. e, much has been made in the last few days that fani willis may be pursuing rico charges, conspiracy charges, group charges. explain that to lay people like me. what is the significance of that? >> well, rico charges are ones that we think about maybe when we think about the mob. we think about john goddess we think about these big criminal charges money laundering that sort of thing. but there's another way to apply the rico statute. in georgia it's specifically pointed towards charges that trump's cronies of nate. it allows for predicate offenses, for example computer trespass, we could've tell that new reporting from cnn about trump level high-level trump people, in terms of trump legal trying to coordinate the breach of election equipment. but things like falsification, false electors traffic it's. things can be used to build a rico case. why is that critically important right now? because i'm standing right in front of the fulton county courthouse, and tomorrow finding willis will

our blayne alexander and katie phang are staying on top of every new development from atlanta and alsous ta mar hallerman, former atlanta journal constitution. she's from the atlanta journal constitution, and joyce vance, former u.s. attorney from alabama. how's this going to go down when trump and his co-defendants surf anne arundeler? >> ana, good morning to you. we now have a place. that's something we've been wondering about for quite some time. a spokesperson says based on guidance from the district attorney's office and from the presiding judge, it's believed that all 19 defendants are going to go to the fulton county jail. that's about four miles or so away from here, about a 15 minute drive. typically that's a process that includes fingerprinting. that includes mug shots. a spokesperson confirms that to me. of course it's not clear whether that would happen here. there are a number of factors that go into this. certainly the sheriff has said that he plans to treat this just like he would any other booking unless he is told differently. but we know the presiding judge has a say.

let's go over to katie phang an hour for the state prosecutor, host of the katie phang show here on msnbcwas 24 hours a day. danny cevallos, similar timeframe. trial lawyer for nbc news and msnbc legal analyst. katie, to you first on this, this is a tweet. let's start with that. the tweet that led to this protective order, the judge setting that monday deadline for the trump team's response. but what is the issue here? what ultimately is the main concern of prosecutors, and why does the judge pushing for this five pm deadline in a very serious way. and what happens of the trump team doesn't respond by 5:00? >> immediately a total of thoughts, richard, number one, the protective order is not unusual to be had now what is being sought by the government specifically is the ability to limit defending trump's ability to disseminate the discovery that he is going to get a lot of it in this particular case, with jack smith. there is a subsection, though, on this particular protective order that deals with the idea that if trump is allowed to have a chilling effect on witnesses, further dissemina

i want to bring in nbc's blayne alexander outside the courthouse, trial attorney katie phang, host ofct attorney, rya gray house who worked with fani willis for many years. blayne, what's happening where you are. >> reporter: what we're seeing right now, chris is essentially a flurry of activity. just a few minutes after you saw those legal representatives for trump enter the building, we saw kind of walking from the corner behind me and into the courthouse, we saw attorneys for ken chesebro also entering the building. they say that they are here to negotiate the terms of surrender. there is movement. it means while we haven't seen any of the 19 defendants surrender of the fulton county jail, we know the terms under which they will surrender are actively being discussed. apply producer was at the d.a.'s office and saw the trump legal team being walked back in there about 15 or so minutes ago. we understand they are obviously meeting with members of d.a. fanny willis team to decide what the terms of surrender will look like. will there be a mug shot, finger prints, will he go to the ja

i want to bring in msnbc's katie phang who was in the courtroom for us. e, tell us what happened. >> reporter: so the long story short, ana, is that carlos de oliveira, the newest co-defendant in the classified documents case brought by special counsel jack smith was not arraigned today. he still does not have local counsel. the judge set his arraignment for next tuesday august 15th at 10:00 a.m. at the force pierce federal courthouse. it's interesting because there was a gentleman by the last name morel who appeared who may be local counsel but when questioned by the judge indicated, quote, the details still haven't been hammered out yet but we're ready to go indicating there's something left to be done to secure his retention. walt nauta did appear with his counsel and counsel for donald trump in the form of chris kise and todd blanche were here. mr. trump not here. fascinatingly, again and again, his counsel kept on referring to him, as, quote, plump. the magistrate jump referred to him as mr. trump. there was an attempt by this counsel for de oliveira,

solicitor general neal katyal, glenn kirschner and katie phang.l, let's start with the arraignment and what happens next. did we get a glimpse yesterday into how team trump is expecting to handle the case? >> yeah, absolutely. i think we did in two senses, one is the delay tactics that they want to use, one of trump's attorneys said outside the courtroom that jack smith has had three and a half years to investigate this case, so they should get three and a half years. it doesn't quite work that way. i mean, there's several problems with that. i mean, one is three and a half years ago was like january of 2020, well before the election. so nobody was investigating trump at that point in time. but, you know, more generally, there is no such symmetry rule and in deed the system would grind to a halt if there was. i don't think that these delay tactics are going to work. they might work better in florida in the stolen documents case where you have classified information and things like that, but not here. the other thing i think we heard a lot of yeste
