>>> good to be with you, i'm katy tur in for hallie jackson. and we're on the cusp of something, but what that something is still unclear. the fbi search of former president trump's mar-a-lago home has stood up a lot. republicans slammed the move as politically motivated with many of his allies claiming witch hunt and basically blaming president biden for the search. the white house said it was not given a heads-up for the events and found out with the rest of the country when the news broke. at this hour, we have more questions than answers. here's what we know so far. a source familiar with the matter tells nbc news that the search was tied to alleged removal of the classified documents from his home in 2021. according to donald trump the estate was searched by agents. the way this happened might be shocking but it didn't come out of nowhere. we know that the national archives asked mr. trump to return 15 boxes of documents they say were improperly taken from the white house. those were retrieved in january. and the justice department to look

let me explain that, katy. you can think about an affidavit as having sort of two general buckets of information. procedural one is the windup, the back and forth between the national archives and mr. trump's lawyers, trying to get ahold of documents that belong to the government, but that mr. trump had retained. right? all of that procedural history, why the government is interested, i think, is stuff we'll probably see in some detail. and it will confirm a lot of what we have already known from good public reporting, like katie benner's. the second part of the affidavit, the second bucket is the more interesting thing. that's the investigation itself. the basis for probable cause. why the government believed that a federal crime had been committed and why the government believed that they would find evidence of that federal crime at mar-a-lago. i don't think we're going to get very much of that. i would be very surprised if there was any detail with respect to witnesses or to investigative methods or techniqu

"the wall street journal" appears to have already seen both. the paper is reporting the fbi took 11 sets of classified documents from mar-a-lago, including one set of documents marked as tssci documents. that means top secret, sensitive, compartmented information. in other words, some of the most sensitive material the u.s. government says it has. stuff that is only meant to be seen in special government facilities. this would jibe with what multiple outlets have been re

i'm katy tur. if you were wondering now strongly the government feels about the records donald trump kept at mar-a-lago, you got your answer at 11:30 last night in d.o.j.'s 36-page filing. we learned the government believed donald trump's team was lying to them, that despite multiple attempts to get the presidential records back, trump's team kept on hiding them. team trump said they returned all of the records, including classified material, did a, quote, diligent search, the fbi said they did not and the fbi managed to find twice the documents with classified markings than the diligent search did. donald trump said they were in one storage room and the fbi said it wasn't and they shared this picture of documents into trump's office. they say the trump team delayed at nearly every stage and at one point stop d.o.j. from personally inspecting boxes in the storage room. team trump said the former president declassified the document and the government says there's no proof he did and the actions of h

i'm katy tur. judge reinhart has the justice department's redactions. it filed its report, here it is all one line of it "docket entry 88 restricted without seal until further notice. and the united states has filed a submission under seal for the court order of august 22nd. the justice department respectfully declines further comment as the court considers the matter. no surprise there. the question now is what will judge reinhart say? we could hear from him at any moment. we also could not. presumably he's going through the redactions right now, deciding whether what remains of the affidavit is even worth releasing. just don't hold your breath. he warned us on monday that what the d.o.j. proposes might render the affidavit gibberish, his word, and he's inclined to side with whatever the d.o.j. thinks is appropriate. some former federal prosecutors order judge reinhart could relean information about the lengths d.o.j. and the national archives went to get donald trump and his legal team to voluntarily hand over all those documents, that is if that info

i'm katy tur. it could be a pretty big day and it's all up to one man. federal magistrate judge bruce reinhart is hearing arguments on whether to unseal the affidavit behind the search of mar-a-lago. a coalition of news organizations, including this one, are asking him to do it. the department of justice is asking him not to do it. interestingly donald trump, who said on his social media site that he also wanted the affidavit released, is not making a formal request for it. one of his lawyers is in the courtroom today, but just to watch. team trump isn't arguing or filing anything. so how will judge reinhart rule? if fast is precedent, it is almost certain he will side with the d.o.j. and keep the affidavit under seal. and all, d.o.j. is arguing releasing it would do grave damage to their investigation. but here's the thing, there really isn't a lot of specific precedent here. a former president of the united states has never had their home searched by the fbi. a former president of the united states has never taken classified materials home and then not

katie, since we were just quoting you, the first question is for you. your new reporting says that this investigation poses an unparalleled test for the justice department. how about an unparalleled test for a president? >> well, it's an interesting question, because again, we've seen a little bit of this in the monograms evening you referenced earlier. so much of the conversation has been around merrick garland, and the choice he will make, and the conversation is around the former president and how he's been pushing this again and again. the justice department did nick not go into this investigation related to presidential records and classified information, i think it would get to the point where lead to a search warrant to make sure it had obtained all the information that it is sought. in past cases, it had worked with people whether it was general petraeus, whether it was former secretary of state hillary clinton, to obtain information that was classified, as to whether it was mishandled. in this case, the justice department officials felt again a

i'm katy tur. we're learning a little bit more about what happened on mara lago on monday and a little more of the political consequences of the justice department's decision to search the former president's private home and club. here is what we can report right now. donald trump's lawyers say federal investigators searched a bedroom, an office and a basement storage area, which they broke a lock to get into. they left with multiple boxes of evidence. what was inside those boxes we still do not know. we could know more. donald trump and his team could tell us more. they could release the copy of the search warrant, which they have. it would likely tell us the criminal statute the fbi relied on to conduct the raid and they could release a copy of the inventory they took. agents are required to leave one as a receipt. but donald trump is not doing it. instead he is using the search to his political advantage are calling the search a witch hunt and claiming without basis that the federal agents invol
