i want to start with the attorney's reaction to the clip you just saw kelly, officer kelly's attorney dancing around. what is your reaction, and why do you think he was so gleeful? >> look, i think what's really important here is not so much the reaction of an attorney, but the fact that at the scene of this horrible tragedy, the police officer, kelly, admitted to drinking six to eight beers to investigators. his eyes were bloodshot. he was speaking with a slurred voice. he refused to take a breathalyzer test and refused to let blood be taken from him until a court order had to be obtained. now, there are three police officers who have been disciplined for their action with regard to what happened here. one police officer was in the car who fled the scene. another police officer, who has been suspended for giving kelly two glasses of -- two bottles of water and gum. what was his motive, right before the blood test. and a third officer was transferred, a sergeant, for at least an hour delay in transferring kelly from the precinct house to the hospital for the blood test. >> i want to a

officer kelly refuses a breathalyzer at the scene. five hours later a warrant is issued for a blood test. then 7:00 a.m. kelly leaves the station and finally goes to the hospital, finally, an hour later at 8:00 he has his blood drawn. seven hours and 20 minutes. what was going on all the time that kelly was at the station? why the foot dragging? and of course his blood alcohol came up 000. which is one of the reasons why this attorney's dancing. it's going to be hard to prove this case -- >> well, i'm not is sure that it's going to be hard to prove this case. because the prosecutors have enough evidence based on the own statements of kelly of six to eight beers, based on investigators on the scene, to get a conviction in this case. >> i don't know about that, sir. the reason i don't know about that is because whereas you're alleging that there's a possible cover-up at the scene, so if those officers, some of whom were allegedly engaged in some kind of cover-up, are the ones testifying, they're the ones who could very likely say he did

kelly o'donnell joins us in the studio.hat will happen and has anything changed the last two weeks? >> it is nice they're taking a quiet day so i can be here with you. thing have changed. there is momentum with. the more conservative version, what happens next, they're waiting on what is known as cdo scoring. the congressional office will look at what they have done for the price tag of each of the elements of the blueprint. that's a big, big deal when they find out how much it costs. the next step is for the committee to vote on it. we've seen these folks thrash it out and having these conversations. they have to vote. the full senate begin to look at it. and a lot of what will happen next will not be on camera as we're able to watch these hearings. harry reid, the majority leader, will be doing a lot of negotiating with top democrats and the white house to put together everything that has been done on the senate side to create yet another version of health care. so we have a ways to go. >> a lot of the progressives, frust

nbc news congressional correspondent kelly o'donnell is live on capitol hill. kelly, this is a timing issue, but it is a setback. >> really all about managing expectations. i think there were a lot of hopes and predictions that things could happen right at the beginning of this week, but in real-life practice. this is a huge undertaking for the congressional budget office to look at the baucus blueprint and to run the numbers. what will it cost? will it come in under the $900 billion target that the president has set out? what are the questions about growth of cost over time and will it have any effect on the deficit? these are big questions that need precise answers as close as they can get and we expect from senior democratic aids that it will happen probably later this week and then max balk whose chairs the finance committee who has been at the center of this says he wants to give his committee members time to read it and then they will vote. it has been a long, hard slug already and this could be so crucial because when the cbo score comes out a whole new

kelly o'donnell joins us from capitol hill brand-new information on the timeline for the vote. >> perhapspatients got the best of us because the real work that needs to go on at the congressional budget office, which is tap would the responsibility of looking at everything that is in the baucus plan, the blueprint for health care that was put through last week. they've got to come up with the big number, a score for what it will cost and what's the effect on taxation and all of that. that's not something you can get done in a weekend, what i'm being told by senior democratic aides chairman baucus expects to hear from them later in the week. once they get the figures and they get to lock at what it says the chairman wants to give all the members of the committee some time to digest it and swaul tow and look it over and then schedule a vote and we thought it might come more quickly and now we know it won't be today, probably won't be tomorrow and we just don't know when the vote will happen. we have to slow down a little bit. >> fair enough. we've been hearing once the cbo gets its hand on
