the families gave me this, kristen. i really believe that it's time for the israeli government and the united states government to work out a fair deal to bring some of these hostages home. the torture these families are going through is extraordinary and they need to get their family members home. there are some children who are hostage. there are some folks in their 70s that are being held hostage. their health certainly must be at risk especially for the older folks and we need to get these people home, kristen. i would support a deal that is fair and equitable and one that gets these people home now. >> let me ask you, broadly speaking about how israel is carrying out the war. the u.n. human rights chief has said that israel is, quote, committing war crimes in gaza. based on what you learneded on your trip, do you believe that israel is following international law? >> yes, i absolutely do believe israel is following international law, kristen, and i will tell you unlike a lot of other people who are expressing opini

>> that's right, kristen.rett mcgurk, the president's top adviser will go to israel, and his mission is to focus on the release of hostages. he's also going to qatar, which has been key to these negotiations over the release of hostages and they're exploring multiple options, the administration is, and one of those options is securing the release of 80 women and children who are being held hostage and in exchange for that the release of palestinian women and teenagers being held by israel. it's one option. there's no guarantee that any of this is going to succeed, but brett mcgurk is going to travel there to try. this all comes out as this administration is trying to weigh its support with israel, and its growing concerns about how israel is carrying out this war in particular. there are concerns, officials tell me, that is reeling is not doing enough to try to minimize civilian casualties. there are officials that don't believe that israel cares that the israeli government cares, that public opinion is turnin

>> kristen, this is a great question. know is that there are three americans who fall in the category of the first deal. that is two women and a child, as i said before. we know that those three have been missing, presumed hostages, but we have not gotten proof of life on any of them, and we do not know for certain that all three of them are still alive. that being said, we do believe, we are hopeful that there will be additional americans released. and remember that there is another day to this deal, so we will see another list tomorrow. and then we are working with all sides on the possibility that this deal gets extended to additional hostages beyond the initial 50. that ultimately is up to hamas. if hamas is prepared to release additional hostages, israel has indicated as part of this agreement that it is prepared for additional days and pause to a fighting, and so the ball really is in hamas' court in terms of its willingness to step forward and release additional hostages including releasing additional americans. >>

what did you make of those numbers, kristen?this poll tells me that the two most popular politicians in america are generic republican and generic democrat. it really just shows that voters do not like the two choices that they're being given. trump, when he is up against a quote, unquote generic democrat, anyone who's not biden, he loses by, i believe, eight points in this poll. similarly, if you flip out donald trump and put in a generic republican, that generic republican does great against joe biden. so, voters are looking at this trump/biden and going oh, please no, and they're begging the parties to give them someone different. it does not look like they're going to get their wish. >> i do think a generic republican sometimes -- i think kay bedingfield called it a fever dream for voters where they think of this perfect candidate that obviously doesn't exist if you look at the field. karen, one of the things that stood out so much to me as someone who covered president biden, is talking about democracy, the soul of the nati

kristen, what's the political fallout? do we even know at this point of a former president on the witness stand >> it's a great question, and that's what's so stunning, lester this is the first time in more than 100 years that an ex-president has testified in court in his own defense still, one trump ally tells me it's a chance for him to fund-raise and to make his case to his supporters that the trial is a part of a broader political persecution despite the fact that there's no evidence of that. mr. trump has commanding lead in the primary and his legal battles have only emboldened him lester, it could be a different story in a general election where independents and moderate republicans could be turned off by all of these legal battles. >> let's talk for a moment about the sitting president. president biden right now, some bad poll numbers. >> that's for sure democrats are looking at this. the latest "new york times"/siena college poll shows that president biden is trailing trump in five out of six swing states that mr.

cnn's kristen holmes is outside the courthouse in new york. and gangel is here with me. how do trump's dramatic antics, whatever you want to call them, how do they coincide with his presidential campaign? >> reporter: jake, this is all part of a strategy in order to really shape the political narrative around these ongoing court cases. one, it's just lumping them altogether, even though this is brought by the new york attorney general and the other are state and federal criminal cases. this is to paint himself as a victim, a political martyr who is essentially only getting quote, unquote, persecuted because he's running for president because democrats or whomever his rivals are don't want to see him win his presidency again. i will tell you yesterday donald trump flew into new york, he had a prep session with his lawyers ahead of the testimony. the top of the conversation all day yesterday, and that's from sources who spoke to him, was all about those poll numbers, "the new york times" poll numbers we've been talking about all day. the reason that's important is when the

kristen, trump is set to hold a rally tomorrow. he's trying to counterprogram that third republican presidential debate. obviously some contentious moments on the witness stand yesterday. have you heard from his team about what we might expect? is that testimony going to come up tomorrow night? >> well, boris, that remains to be seen. we know donald trump isn't one to mince words, and likely he is going to bring it up because he is still very angry about it. but one of the things we've been really reporting on is how it's going to look when donald trump is bouncing between these trials and the campaign trail. and you're really getting a firsthand look at that right now. not only did donald trump appear all day in court in his own civil trial, he also then came home to mar-a-lago and made calls on behalf of two candidates for governor, one in kentucky, one in mississippi, at telerallies to try and support these candidates that he has endorsed. now, this is going to become less and less manageable. the thing to keep in mind here is w
