kristy seifkin is in san francisco to explain why the state stakes are so high.d morning. >> reporter: good morning. in a couple of hours supporters of same-sex marriage will line up on the steps here at the state building. they will be here staging a sit- in that they are calling, no standing for prop 8. that's going to be coming just before 10 a.m. today when there will be a hearing inside the state building on that measure. it was just about a year ago that judge walker ruled that proposition 8 was unconstitutional because it violates the constitutional guarantee of fairness and equality. but the supporters for prop 8 are now trying to appeal that ruling and the federal appeals court wants the state court to weigh in on the matter before it makes any sort of decision. so at today's hearing the court will be hearing oral arguments for perry versus brown, which questions whether the sponsor of prop 8 can legally depend that measure at the ninth circuit court of appeals. this comes after both the attorney general and the governor have both refused to defend that
