ktvu's christien kafton is live at the scene., you were pushed back from the scene because of the investigation. >> reporter: yeah. that is right. we were pushed back. they were telling us the off ramp here at 164 avenue is a crime scene at this time. a couple moments ago we saw chp driving the wrong way, unfolding right here on the other side of the trees. you can see the whole incident happening right now on 580. zero traffic westbound as chp is doing a evidence search, looking for shell casings. in the last 20 minutes i got a chance to speak with the driver of the black suv. i got a chance to see the bullet holes. we talked with the driver. he says had suspects were driving erratically, weaving in and out of traffic, speeding up and slowing down. he passed that vehicle and that they pulled up on the left side of the suv, he says that seemed suspicious. he said something seemed odd so once that happened the suspects pulled out a gun, opened fire. i saw at least two bullet holes in the suv. one in the hoot, one through the winds

ktvu's robert handa joins us live.lost. >> reporter: that's right. it is supposed to be dry and quiet around south bay creeks during the drought but today we saw water being pumped into the creek for hours and found out almost all will go to waste. >> reporter: water gushing into the creek is a rare site during the drought especially after the water district decided it would no longer release water. after seeing water being pumped out for hours, some people called ktvu to ask why so much water was being released into the dry creek. we came out, saw the same thing and heard the same concerns. >> that side of the creek is dry and that side is cascade of water. what is going on? >> surprised to see water. >> reporter: the water district said it had nothing to do with the water release. it was a city project. a city well needed repairs so the water had to be purged to avoid contamination. they acknowledged 1 million gallons was. ed out, most -- was pumped out, most of the water was lost. 1million gallons is a significant a

ktvu's robert handa is now at the scene. police are saying this wasn't an accident?porter: that's right. police tell me this was an intentional act. and the person who was driving the car, you saw earlier, a picture of it, that he was driving with a female and two children, they say these are family members. they don't know the relationship but they call them one family. he took that car and was driving and hoowas basically driving that car -- he was basically driving that car in the neighborhood, looking for a house to drive the car into a home. this is the one he picked. you can see this live picture. it is part of a "t" intersection. a straight away. police say that is why he ended up at this house. he took the straight away and drove it into this house. it was apparently a house picked at random. police say he was driving at approximately 60 miles per hour when he hit the house and that is why she being charged with attempted murder and he was also driving under the influence of drugs. not alcohol but drugs. he has been taken to the hospital along with the other

ktvu's allie rasmus has been talking with investigators and learned b.a.r.t. already ruled out one possible cause. >> reporter: investigators have ruled out train operator error as the cause of the derailment but it will take several days to figure out what went wrong. let's show you the new pictures that show the mangled tracks and debris after the derailment friday evening. we learned they will be looking at whether wear and tear on this section of track may have caused the problem. it happened friday evening where two sections of track crossed ov. each b.a.r.t. car has two sets of wheels. friday the first set of the wheels, the back set did not crossover and the train jumped the tracks. why that hap established the focus of the -- happened is the focus of the investigation. in 2011 the same issue happened with where first wheels went one direction, the back set went another knocking the train off track. >> i think it is concerning it happens anywhere. whether it is the same spot at all. whether it happens at all is concerning. >> reporter: b.a.r.t. and cali
