a lanny davis with me. and of course, now elie honig joins me. our senior legal analyst, former assistant u. s attorney for the southern district of new york. what do you make of the way he sees it. very interesting interview. so first of all, mr davis is correct when he says that the motives here can be mixed. it's enough for a prosecutor to show that he had multiple motives. as long as one of them was political. you can also have a family or a humiliation type motive, but he is not correct when he says 1% is enough. the law says that the political motive has to be some substantial part of it. they don't put a number on it. 1% is not going to hack it. the other problem for the prosecution here is that mr davis client, michael cohen in 2018 said to the fcc federal election commission so punishable by perjury. these payments were entirely unrelated to the election entirely unrelated to the campaign and therefore totally legal. now the comeback will be while he was lying for trump then and as mr davis just said, he's come clean. now that'll be up t

what do you make of it, let me read lanny davis' statement. mr. cohen was available for over two hours today, and we are pleased to report that mr. cohen was not needed. once again, we repeat the fact the documents speak for themselves, facts do matter. what do you make of the fact while he was available, the grand jury did not call him or the prosecutor did not call him as a rebuttal witness? >> well, it sounds like the grand jurors were not as impressed with mr. costello's testimony as mr. costello was. to hear him speak, he had completely just eviscerated michael cohen's veracity, his truthfulness. if that was the case, you might expect the grand jurors would have quested as they're entitled to, to hear again from mr. cohen. the fact that they didn't suggests that there weren't major concerns. of course, we don't know for certain how that went, but the reality is the grand jury will be asked by the d.a.'s office to vote on returning an indictment, and they are authorized to do that if there's probable cause to believe a crime was committed. so

i want to add that his attorney, uh, lanny davis just issued a statement as well, saying that cohen made the brave decision to speak truth to power and accept the consequences. and he has done so ever since. i'm proud to be his lawyer and his friend, and so you know, this has been a long journey for michael cohen. he did go to jail. ah as an attorney. he's talking here about presumption of innocence. um, which you know, michael cohen does not like donald trump in any way, shape or form. so you know, i think he's trying to say look, you know he's got to go through what i went through. he's he's got a he's got to go to a trial. he's got to be convicted or not convicted and, you know, i think from michael cohen, um this is a certain amount of vindication. i would have to say, but again, we don't know what the indictment is. we don't know what it says. and of course, donald trump has been denying this affair was stormy daniels so we'll have to see what what his response is and how he makes it somehow. larger than himself. let me get you wanna get katelyn polantz reaction as well. go go ahead
