that's why we have to wait to see if this vote takes place this afternoon. >> leigh ann, there was a note that came out to the gop. mitch mcconnell said something to the effect of, we're all watching this unfold on the house side and we will reveal participants inside. that was a shortened version of what he might have said. mitch mcconnell is an interesting player here, because he was very outspoken against donald trump after january 6, although he did not vote to impeach him. what sort of position is he in right now with what is happening in the house and this committee? >> yeah, mcconnell is an extremely interesting character. he took a decidedly different path from leader mccarthy. while he also did not support the creation of a commission to investigate january 6, he swore off the former presidents. he doesn't mention his name. actually a year ago tomorrow is the last time he spoke to the former president, and it's also the same day he said joe biden legitimately won the election. so while mcconnell is not part of this investigation, he seems to be watching it closely, and it's

leigh ann, democrats have been down this road several times before and been unsuccessful.ve things are now going to be different? >> reporter: well, jose, when president biden just said if they can get it done in that clip you just played, if is the critical word here because it's going to be very difficult. all 50 democrats agree on the voting rights legislation but what they don't agree on is that the rules of the senate have to change in order to pass that voting rights legislation because they don't have the republican support in order to get 60 votes to pass it. there are these negotiations that are going on between senator manchin, a big critic of changing the senate rules with other people with senator tester, senator cain and senator king as well and other people having separate conversations to try to come up with a way to pass these voting rights through the senate rule process. senator kirsten gillibrand put a hamper on negotiations when her person put out a statement she believes the 60-vote threshold in the senate should remain and so it's unclear how they'll

i want to bring in leigh ann caldwell.about will happen in the next 24 hours when it comes to mark meadows' request to congress, shall we say. >> reporter: they are going to send it to the full house of representatives. this is a step they've taken two times before in the past couple months. we saw that with steve bannon and we also saw it with jeffrey clark, a trump administration justice official. it comes on the heels of a 51-page contempt report which you referenced which really lays out a case saying mark meadows was instrumental in the lead-up to january 6 and on that day. it says they want to ask him many questions about the information that they have received from meadows himself in the few weeks that meadows was cooperating with the committee, he turned over 9,000 pages of documents. so this 51-page report is just the committee's side of things. it doesn't seem like we're going to get mark meadows' side as he is not cooperating, of course, the reason for this contempt referral. meadows' attorney, however, released

. >>> first, to nbc news capitol hill correspondent leigh ann caldwell. leigh ann, these text messages to mark meadows are pretty explosive. >> reporter: yeah, katy, what we found out from meadow's attorney is there have already been documents and text messages that meadows has provided to the committee and a lot of them were explosive and it gave them a lot of insight into what happened and where meadows was on the entire issue on january 6th leading up to it and the days after. so those were received by the committee in the short amount of time that meadows was cooperating. now we know that meadows is not cooperating, so that the committee has indicated to meadows' attorney that they are going to move forward with these criminal contempt proceedings and a referral to the department of justice. but in speaking with members of the committee as well, the leader of the committee, bennie thompson, indicated that another option perhaps is providing meadows immunity in case he was to plead the fifth, if he does decide to cooperate. so there are some options th

leigh ann, what's going on?esn't have the votes to pass the build back better plan just yet. senator joe manchin remains noncommitted to voting for the legislation. and he needs all 50 democrats to support it in order for it to pass. they're also running out of time here. there are still negotiations going on between members on the state and local tax deduction. they still have to go through the process with the senate parliamentarian to make sure every line of the bill complies with senate rules. and these things still need to be done before they can even bring it to the floor. the reality is until they get senator joe manchin to commit to voting for this legislation, they don't have the votes. so they're going to punt until most -- most likely, anyway, until next year, and i'm hearing perhaps not until march or april, katy. >> that's a long time off. what about voting rights, do they expect to have any better chances on that? >> reporter: i'm hearing more optimism from senate democrats on voting rights than th

with me now is nbc news capitol hill correspondent, leigh ann caldwell. leigh ann, good morning.e point of all of this drama? >> reporter: drama, jose. welcome to congress. well, the point of it, for most senators, republicans and democrats, was that there was no point of it. republicans, most of them, did not support this effort, even though they supported the idea of defunding the joe biden's vaccine mandate. but there was a small group of republican senators who said that the vaccine mandate is unconstitutional and that they believed that they needed to do everything in their power to try to stop it. even though that they are in the seniority and it was never going to reach the president's desk. ultimately, an agreement was made between the leadership. they were able to vote on this measure to defund the vaccine mandate. it failed along party lines, and ultimately, they were able to move on to government funding and it passed. so the government will be funded until february 18th. jose? >> leigh ann caldwell, thank you so much. and with me now to continue our conversation is ca

how would this play out, leigh ann? >> it's going to be very difficult.ry unlikely still, but there does seem to be momentum in the senate to try to get this done before they leave. they know that they're not going to build back better before they leave town, and so they need a big win for democrats, and they also say that they note that redistricting is going to continue in january and that it's going to be detrimental for minorities and for the democratic party and the redistricting process. and so that is the last-minute push of why they're trying to do something. there are big obstacles. senator manchin is one of the four involved in these negotiations with senators tester, kaine, and king. it's about are rule change. that's an important distinction. if they can come to an agreement, they have to come together with sinema who's not part of the negotiations who said yesterday she wants to keep that 60-vote threshold, and so without getting that, it's hard to sigh how the voting right passes. >> nbc's leigh ann caldwell. i know you have a busy day. ing

with me now is nbc news capitol hill correspondent leigh ann caldwell. how likely is it the government will get a funding bill through the senate? >> reporter: good morning, jose. that's still the question. it was big news this morning, the fact that republican and democratic leadership came to an agreement to pass a short term government funding bill through february 18th. so that is the first step. but in this senate, there's other problems, that is like you mentioned senator mike lee and senator marshall of kansas want to hold up the process because they are opposed to funding vaccine mandate, and so they can delay this process, right. so what could essentially happen the government could shut down through the weekend. it would just take more time for the senate to override their opposition. they can't kill government funding but they can just delay it, so we could very well be looking at a shutdown heading into the weekend that would last a couple days, probably no big major effect on the economy or most people, but it will just play into this level

we want to bring in leigh ann caldwell.t action unfolding in 40 minutes with voting rights action happening from senator senator warknock. you spoke with him for nbc. tell us about it. >> he is linking these. let me explain last week the senate had to vote to change the rule for the senate today to lift the limit with a majority of votes, democrats would do it, so senator war knock on the floor previewed what he's going to say saying the senate is hypocritical. they have been trying to parks democrats anyway, changes to voting rights, and they haven't been able to do it because they only have 50 votes, and they need the support of 60 because of senate rules that means they would need ten republicans. so he said that he struggled all weekend, and he actually considered sinking the debt limit because of this hypocrisy. listen to how he explained it to me earlier today. >> we think it's so important that we change the rule to get there. in order to save the economy. well, the warning lights on our democracy are blinking right

joining me now is capitol hill correspondent leigh ann caldwell.emo, it's really fascinating. >> it is, katy. it's 36 pages long, written by two top officials at the dc national guard, saying that all of the public testimony and the inspector general report done by the pentagon inspector general was filled with lies and mistruths about what actually happened on january 6th as it relates to top officials over at the pentagon. there is one really damning quote in this memo that says, quote, peyott and flynn, a different flynn, these are two top officials at the pentagon at the time, literally changed facts and recollections overnight. the end product, a revisionist tract worthy of the best stalinist or north korea propagandist, was close held. they are saying that while the pentagon is saying they acted expeditiously and effectively to deploy national guard troops to the capitol on january 6th, these two top national guard officials say that was in fact not the case. members of the national guard sat and watched in awe, wanting to come to the capitol

let's bring in leigh ann caldwell. where does build back better go from here? the last payments went out this week. and at a time when inflation is flaring, you're going to have millions of families without that cushion come january 1st. what do we know about that and tell us about this new focus on voting rights. >> yeah, stephanie. so build back better is effectively stalled. they are going to keep negotiating, going to keep right to get things something done, but i'm told that it might not be until march that they're able come back to this piece of legislation. they still have to work with senator joe manchin and try to get him onboard on some of these key policies, incoming the child tax credit. so, simultaneously, while they are continuing to work on that in the background, they are also refocusing their efforts on this shall of voting rights. there is an increased urgency on the issue as redistricting underway in states across the country. and president biden, vice president harris, as you mentioned, held a zoom call with a group of key senators yesterday

. >>> joining us now, capitol hill correspondent leigh ann caldwell. great to see you. go from here? as we go to the house, do we actually anticipate it will get to the floor and, therefore, republicans can try to knock it down? what's going to happen? >> the way this works, this was an attempt to roll back a bind administration rule. so it goes through special rules in congress. in the senate because a republican brought it up and started the process, it automatically has to come to the floor. there's not many things in the senate that work that way. so that's why it got a vote. this was a republican measure. it now goes to the house where there's different rules in the house, and speaker pelosi does not have to bring this up, so this might not see the light of day. the only way it could reach the house floor is if a republican force as vote, which a republican has said that he would do. but in order to bring it to the floor, it has to have the support of 218 members. that means it would need at least the support of five democrats in order to trigger this to come to th

. >> joining me now is nbc news capitol hill correspondent leigh ann caldwell.wyers have the right to do so because he's not the president right now. that being said, it seems like this was triggered by the select committee going and subpoenaing telecom records. can you tell us what they were looking for with meadows? >> well, what's unclear, katy, is if this was a new subpoena or something previously. we know that the committee has already asked these media companies, telecom companies, these third parties for thousands and thousands of pages of documents. the committee specifically is not responding and saying exactly what it is. but they are, you know, what meadows is saying is that this is this was something that was unacceptable to him. that there is things that would fall under that subpoena that would violate this executive privilege guard rail that he had put up. now, when meadow said last week that he was going to cooperate with the committee, he noted that there was going, he was going to do it within the confines of what he thought would not fall unde
