nbc bay area's terry mcsweeney joins us from levi's stadium with the details. terry, how'd this happen? >> reporter: county agencies are going to have to million to the 49ers and they're going to have to forget about $6 million per year that they were anticipating, all because levi's stadium, it has been determined, is not as valuable to the 49ers as previously thought. the santa clara county assessment appeals board has cut levi's stadium assessed value to the 49ers in half. so the team is being assessed really only during football season though it makes some money from concerts and controls the events year-round. >> if i controlled all of the events that happened in the stadium outside football, i have a value. okay? and that's what i think the assessment appeals board ignored. >> reporter: $36 million has to be refunded to the team from the county this year. 13 million of that from schools, which also lose out on $2.5 million annually going forward. the district says no programs will be cut. >> fortunately, santa clara unified has very prudent fiscal policie

abc 7 news reporter david louie is life outside levi's stadium with the fans. david? >> well, you know, normally we see a lot of smoke coming from the parking lot before the games from all the tailgating parties. the only smoke we're seeing right now is residue left over from the fireworks they just set off at the game. a lot of fans had to make due with cold cut sandwiches. they seemed to be a lot hungrier for a national title. you could easily make out the alabama boosters from the clemson fans, but they did have one thing in common. cold food for their tailgate parties. what would you be eating if you had a tailgate at home? >> barbecue. it's all barbecue. >> buying deli sandwich trays and beer substituted for other hot food since these fans mostly hail from out of state. so bringing along a grill just wasn't possible. they already spent a lot of money to come for this national championship game. young james miller knows it was a lot of money. >> about 4,000, maybe something dollars. i don't. but it was lot of money. but we all combined it i guess. >> it's worth it

the put this tax on levi stadium. they explained what this will mean to public services in schools. >> the county of santa clara will pay the bulk of this $36 million tax refund to the 49ers after the appeals board agreed with the team that they were overpaying in taxes for events at levi stadium. they don't own the stadium, the city does but the team does pay property taxes. the 49ers argued that they should only be paying taxes during football season. but the assessor said other stadium events like concerts should also be included. in a decision yesterday, the appeals board agreed with the 49ers and said they were paying too much. now the team will get a refund and going forward their taxes will drop from $12 million per year to $6 million. >> they just made a bad conclusion. it is a bad decision that they came to. it is hard to follow. where would this money come from . >> here is a list of government entities that will pay the most, the school district, west valley community college, and the city of santa clara. >
