cnn legal analyst lisa bloom had an exclusive look at the preliminary draft of the motion. sa joins us now. lisa, what did you see in that document? >> erica, this is a detailed, thorough, powerful, one-two constitutional punch on the biggest issue in the case, whether kathleen's statements should come in. the arguments are number one, this is an ex-post facto law. there was a a law, called drew's law, changing the rules of evidence, allowing in what would be hearsay evidence from kathleen savio into the trial. the defense says this is an ex-post facto law. unconstitutional under the federal constitution to target a particular case to change the rules of evidence in the middle of the game. the second argument is under the confrontation clause of the sixth amendment of the u.s. constitution that drew peterson like everybody else has the right to confront and cross examine witnesses against him. allowing in this kind of statement from somebody, even if she's a murder victim and can't come to testify means he can't cross examine her and therefore that would be unconstitutional.

lisa bloom. dr. jorge rodriguez, board certified in internal medicine.r, let me ask you, possible at all what the family is claiming? diabetes, a mystery bump in the leg, a problem with her tooth. a stroke. could any of this have possibly driven this in some way? >> let me tell you from what i've seen from the autopsy reports, i don't think that's possible. you can't ignore the evidence of there was 2 1/2 legal limits of alcohol in this woman's blood. more compelling, there was approximately six grams of alcohol in her stomach which meant she must have consumed alcohol at least within half an hour to one hour of the accident and otherwise there was no sign of stroke. an autopsy in the brain. there was no hemorrhaging in the brain. diabetes, even if you have low blood sugar, you probably wouldn't have gone for two miles driving on the wrong side of the road. the evidence i've seen, campbell, does not coincide with anything other than alcohol use. >> not to mention what was in her blood or what was in her stomach, howard, as dr. rodriguez just said, but al

joining us in los angeles is lisa bloom, cbs news legal analyst, from washington wendy murphy and author understand y i'm going to start you off. child protective services announced they're looking into daniel schuler here. where does this come from? how does this affect, i guess, this case? >> that's a good question. was he a neglectful parent for allowing his children to get into that car. child protective services has jurisdiction to ask that question. they have a reason to be concerned if, indeed, he knew his wife either was drinking, was drunk, was high at the time she drove away with his children in the car, or that she had a propensity, a problem, if you will, with alcohol and he knew about it. then he could be held reckless under child protective services standards and potentially lose custody of the remaining 5-year-old child who survived if, indeed, that's the finding they make. >> we did hear daniel say in that piece, he's been saying it all week, his wife was not an alcoholic and he never saw his wife take a drink or be drunk in his presence. >> the lawyers representing the t
