we begin with an interesting turn in the case against jared loughner. the young man charged with shooting arizona congresswoman gabrielle giffords along with nearly two dozen others. he's been receiving antipsychotic medication in jail and he doesn't want him to take it. his lawyers have asked for them to stop forcing him to take it. jeffrey toobin joins me. the judge seemed to say this is in the hands of his doctors primarily. how does it work? can prison doctors hold loughner down and force this medication into home? >> the important thing to recognize is the background here. the defense has one goal. it's to keep jared loughner from getting executed. that's their only goal here. at the moment he's been found not fit to stand trial. the status quo is actually pretty satisfactory to the defense. the problem here, is that the medical authorities are trying to get loughner better. >> right. >> they are giving him drugs, treating him the way any severely mentally patient would be treated and that might get him sane enough for trial, thus execution. >> the

loughner is being held at a federal mental hospital.rs argue that prosecutors wanted to medicate their client merely to make him able to stand trial rather than to keep him safe. their argument worked. but it also means a very sick man is not getting treatment that he obviously needs. i talked earlier with sunny hostin, legal contributor for "in session" on trutv and dr. drew pinsky, host of hln's "doctor drew". >> from a medical ethics standpoint are you comfortable with this ruling? >> well, i'm not -- i'm uncomfortable with most of this entire situation. i mean, the fact is the physicians that are involved in this case are in a double bind on almost every front. on one hand they have a gentleman who is dangerous, who has been a killer, who is acting out dangerously and they can't treat him. he is diagnosed with schizophrenia and they can't give him the routine medications you would give somebody to frankly make them feel and be better and also make it possible to keep them from endangering themselves or other people on the unit. they

loughner's lawyer hired doctors. the doctors agreed this guy is not competent to stand trial, and the judge agreed. so he put him in jail until he gets better. the prison system decides we can get him better by giving him these drugs. the appeals court said we're going to stop you now but give you a final rule anything a week or so. gretchen: it's sitting before the ninth circuit court of appeals of san francisco, and we know that is a left-leaning court. what does that say in an issue like this? >> it tells me that they will probably distinguish the supreme court ruling that lets jailers forcibly medicate prisoners by saying that ruling and the cases on which it is based all occurred when the person being medicated had been convicted of a crime. but a not guilty person, and under the law he's not guilty, has the right to decide for himself or his guardian in this case has the right to decide for him whether or not to take the medication. prediction? the ninth circuit will not force him to get medication against -- g

sonny, the government hoped medications would make loughner competent to stand trial.y is the court letting him off the hook here? >> well, it's interesting. the court found him incompetent to stand trial on may 25th, and a private administrative hearing was held inside the prison without a lawyer and that hearing found loughner was a danger to himself and others and thus needed to be medicated. and defense said that was a rouse and it was to try and make him stand trial. now the federal court of appeals says we will extend the injunction, and we're not going to force him to take the meds and let the legal process, that challenge to the alleged rouse take its course. i will say this does not mean that loughner will not be forced to take medication to make him competent, it just means the legal challenge has to take its course. >> what do we expect to see in the case? will he eventually face justice? >> i think so. there are two ways to force somebody to take medications, and one is the administrative hearing and the other is to have a court hearing. what the federal ap
