marla tellez joins us live with the latest on that investigation g. morning, marla. >> reporter: good morning, these suspicious fires were set within walking distance of each other in a duplex area in south san jose off 85 and blossom hill road. this is where one of two suspicious fires. here is a look at the damage. they were both called in as garbage can fires. you can see the debris. the scene has been cleared. firefighters are gone but again, a look at the damage. we just talked to a family who has been displaced. the fire spread up here. fortunately the flames did not make it to where they lived, but they were rushed out of their home just after midnight. we just talked to the teenage daughter. this is what she had to say. >> you don't have a home up there? >> no, because it destroyed the whole electricity panel so we have no lights or gas and like our food is going to get spoiled up there. the red cross came and helped us. >> reporter: as you heard from jocelyn, the red cross is here. jocelyn and her parents are on their way to a nearby hotel. th

marla tellez with a look at this unique election coming up. marla, good morning. >> reporter: good morning. it is unique because we're using a whole new system when it comes to state offices, you can forget about majority rules. this new system is called the top two primary. this means the two candidates with the most votes will face off in november even if one gains an outright majority today. now, this also means your ballot includes all candidates of all parties for state legislative house and u.s. senate office so you can expect a longer list of candidates. also new for the first time in california independent voters can vote in the june primary. now, when it comes to the issue statewide, prop 29 is a big one. it's $1 tax on a pack of cigarettes. that would help fund cancer research. a political analyst we spoke to said independents could be a game changer for this specific proposition. >> i tend to think a lot of the independents in this state would've voted for it and they're not, again, they're not acclimated to voting in these cycles. i

"today in the bay's" marla tellez is in our newsroom with the latest. good morning. >> good morning. this is a case of william lynch versus father lindner accused of beating the retired priest. he says he did it out of retaliation, claiming lindner molested him and his brother more than 30 years ago. the judge is expected to rule on a request for a mistrial. this all happened on friday when lynch's attorneys claimed misconduct from prosecutors. in opening statements one week ago, the prosecutor told the jury the priest would likely lie under oath and deny the allegations. father lindner did take the stand and say the molestation charges are false despite the fact that the church paid a settlement to lynch and others. they claim that the prosecutors broke the law by putting acknowledged lies before the jury. it's now in the judge's hands, he will announce his decision when the trial resumes at superior court at 8:30 this morning. laura. >> thank you for the update, marla. it's 9 -- it's 4:33. that clock is wrong. u.s. supreme court could rule as early as

." >>> good morning to you, it is 4:30, i'm marla tellez in for jon kelley. >> and i'm laura garcia-cannon, lots to get to this morning. breaking news we're following this morning, there has been a killing in san jose. he joins us now with the very latest on this deadly shooting. good morning. >> reporter: good morning, laura. looked like this happened about two hours ago in san jose right across the street from the big costco store. we have some video, the investigators are here at the scene. the crime scene investigations unit just arrived about 15 minutes ago. so in cases like this, they'll be here for another six, maybe seven hours. all we know at this point, witnesses tell me that there seems to be a fight outside a karaoke bar on center road. that fight apparently erupted into gunfire. we do have a deceased 24-year-old victim. he was dead here on the scene when police arrived. he received the 911 call at 2:34 this morning, he was pronounced dead at about 2:54, again, just about an hour and a half ago here. we do not know if the suspect is still at large. we're waiting for word from t

it's 6:00, i'm marla tellez in for jon kelley. >> and i'm laura garcia-cannon. we begin with breaking news this morning. right now police at the scene of a deadly early-morning shooting in san jose. good morning. >> good morning, laura. it appears a coroner has arrived here in the 2,100 block of center road. this is a trs is a strip mall, industrial area. the shooting happened at about 2:34 this morning and police arrived, pronounced the victim dead at about 2:53 this morning. all we know is that he is a 24-year-old male. he was outside of a karaoke bar. one witness told me that he heard there was a fight outside that karaoke bar, and then the shooting. i did go out to the parking lot area and there is the body still lying out in that parking lot area. however, the coroner has arrived and so the crime scene should be cleared, i would say within the next hour or so. they have not identified the victim. they are still waiting to notify kin before they do that. but i asked one of the commanders out here if the suspect was still at large or if he was in custody. all

. >> and i'm marla tellez in for jon kelley. we are following breaking news out of berkeley where a house fire has killed one person. >> firefighters are still at the scene at the home. stephanie chuang is live in berkeley. good morning. >> reporter: good morning. yes, sadly, one young woman who lived in one of the upper floors of the house, died in the fire that started around 2:30 this morning. right now firefighters are on scene actually pulling some of the hoses out but waiting for the building to vent out a little before they can go back in and check for hot spots. this is where eight people were sleeping inside when flames ignited in this three-story victorian home. so far investigators believe it did start in the back. that's where people tell us flames were shooting out, dozens of berkeley firefighters responded within minutes. they tried to make rescues, everyone made it out except that young woman. neighbors tried to save any one but hit a wall of smoke and were forced out. one man was calling to his girlfriend but the

i'm marla tellez in for jon kelley. >> i'm laura garcia-cannon.eaking news in berkeley. firefighters still combing through the charred debris on lorina street where stephanie chuang joins us live. neighbors are describing a frightening scene. they did what they could to help. >> reporter: it was frightening for them. they woke up to the smell of smoke and some of them did try to save whoever was inside. so far the last hour, hour and a half, investigators, have been going in and around the home focused on the back. you can see that's where the flames were shooting out. they had to smash through a skylight. you see the back of the house, the roof collapsed there. that's where the flames were shooting out. >> nearly three dozen responded. everyone was able to make it out except for one young woman. five made it out without injuries. neighbors say they ran in to try to save any one but hit a wall of smoke and forced out. they recall one man was calling to his girlfriend but there was no response. as flames grew bigger. >> the house is 30 to 40 feet h

"today in the bay's" marla tellez live at san jose's municipal stadium, the panda recuperating from surgeryning, marla. >> reporter: good morning. certainly has been a tough month for pablo sandoval who has you mentioned has been recovering from an injury. he had surgery on his left hand at the beginning of may and as you also mentioned, he's now in the minor leagues playing with the san jose giants. now he is being investigated for sexual assault. now a woman is claiming that sandoval sexually assaulted her friday morning at the beach resort. santa cruz sheriff deputies say the two met thursday night. sandoval voluntarily met with investigators on friday to talk about a "consensual personal relationship of a sexual nature that took place earlier that day." now, before the cameras, sandoval is keeping it together, seemingly unfazed by these allegations. >> right now i'm happy because i'm playing the game. you know, i'm happy, having fun, like a little kid playing baseball. >> now, as for his team in san francisco, giants manager is more focused on sandoval's process than his personal issues

. >> and i'm marla tellez in for jon kelley.olice in san jose on the scene of a deadly shooting at a karaoke bar. live at the scene where police are investigating the city's 18th homicide of the year. damian, good morning. >> reporter: good morning, marla, we are in the 2100 block of center road here in san jose across the street from the big costco store. not much new information that police are revealing at this point. we did -- we do have some video we shot just a short while ago. police taking away a witness here from the karaoke bar. he was led out to the san jose police department for more questioning to find out exactly what happened here at the karaoke bar. i did hear from one witness who told me there was a fight outside of that karaoke bar at about 2:30 this morning. that fight apparently erupted into gunfire. i do see a body still lying on the ground here in the parking lot of that karaoke bar. we do know that the victim is 24-year-old male at this point. the call came in at 2:34, he was pronounced dead here at the sc

it is straight up 5:00 tgif, i'm marla tellez. >> i'm jon kelley. we start off with breaking news this morning. firefighters dousing two separate fires at the san jose high school in the past few hours. live at the scene right now and all the latest developments. what do you see? >> well, the fires are out. thank goodness for fire and smoke alarms because the fire set beyond that gate there against the wall might have done more serious damage to the building. the library here. the fire department believes it was intentionally set because it happened overnight and not the only one. there was a second fire set in that dumpster not far from the other fire. fortunately, the fire alarm did alert the fire department. this was a little after 2:30 this morning. san jose firefighters were able to distinguish both fires fairly fast. the dumpster fire didn't threaten any structures. but the other, it was a pile of debris outside the library. it did scorch the wall. it started to get up on ton of the ceiling, but we understand that it is superficial damage. and

i'm marla tellez. >> i'm laura garcia-cannon in for jon kelley. prevention and protection. after a spike in homicides, the city of san jose is rolling out a new strategy to stop gang violence. nbc bay area's damian trujillo is live in san jose with details of a new plan unveiled this morning. good morning, damian. >> reporter: good morning, laura. for the last six hours the city leaders have been talking about how to address the growing gang problem. today they heard first hand from a grieving family right here in san jose, how difficult it's been for them. a family met with me outside of city hall before the news conference today. their son, alberto reyes, was beaten to death at roseville park a couple months ago. he was playing a game of pickup basketball with family members when he was attacked by gang members. police say the 14-year-old was not a gang member and was attacked for no reason. the family told me they're even afraid to return to the crime scene, roosevelt park, to drop off flowers or light a candle fearing for their lives. of the 19 san jose homicides this y

i'm marla tellez in for jon kelley. >> i'm laura garcia-cannon. let's check the forecast with meteorologist christina loren. good morning. >> good morning. oh, how the weather is changing. oddly enough we have showers on the radar so basically what that means for the day is you probably want to grab some sort of protection when it comes to rain gear. we expect rain showers over the greater bay area, however, they will be light, they will be isolated. i'll pinpoint which have the best chance. cool conditions, in the 50s to start, breaking into the 60s and 70s so another cool day and this wet pattern expanding into the weekend so your full forecast around the corner. that's coming up. let's check your drive. >> we'll take you to west of 880 and south of highway 84 we have the traffic flowing pretty nicely but there is an accident so watch that surface street. a major off ramp through fremont. it's not necessarily a cut through to 84. we're looking at smooth drive on 84, the dumbarton bridge, no problems over the water. 880 north, a smooth drive even
