tara moriarty joins us live from the scene. you've been out there for several hours and tara, it's been windy the whole time. >> reporter: very windy and extremely dry not the most favorable conditions. i just spoke to the manager of the apartment building that was evacuated. there are two. one is called strata. the other one is venue, the white one is strata. there are 200 units there. what she had told me, they weren't being allowed back in yet. she was going to get an update from firefighters in about 15 minutes. she said even if they were given the clear, that they would literally have to go through every single apartment building to make sure that it was safe before they would let people back in. now, venue, which is next door, is only at 40% capacity. so what that means is that if some of those apartment buildings in strata are not looking good or deemed safe, folks from there will be able to go to venue and stay there until they can get, you know, somewhere else to be relocated or until they can get the apartments back i

tara moriarty joined us live. >> reporter: good afternoon. lynn spauld's attorney did file the name yesterday. this is it. it's 23 pages long. he expects the city attorney's office will reject it. the next thing you can expect to see is a lawsuit filed. typically with hospital claims, if one you can receive a $250,000 payout. , but she's been filed as a dependent adult under the civil protection act. what that means is the $250,000 cap would not apply. this claim is, of course, fallout from the incident in san francisco general hospital last fall in which she taliban -- in which she vanished from her room. an investigation determined that both the sheriff's department and hospital shared the blame. >> the only thing that lynn spaulding's family has seen come out of this is the reassignment of sheriff adeputy -- sheriff's deputies. we do not think that reassigning a few deputies is a full enough price to pay. >> reporter: 2 investigates obtained documents. and the sheriff's deputy was understaffed and did not proper conducted searches because
