mr. bagley there, it's hard to tell. i believe his family has said that his hands were partial -- this is the video in slow motion, we can show it. yeah. >> it's really hard to see there if his hands are up before he's shot. which would be the key moment, right? he's standing there -- >> and we don't have audio from this angle, so we can tell when the shot took place. >> that's right. that's right. you know, and at the end of the day, from the legal perspective, the issue of qualified immunity, which has been discussed a lot lately, in terms of in the context of these police use of force issues, at the end of the day, it's a very high standard to be able to pierce that qualified immunity and hold someone criminally responsible or -- responsible for the use of an active force. it goes back to the standard of the grand standard from 1989, supreme court case and it's basically an analysis that's conducted from the perspective of, a, reasonable police officer who, under the same circumstances, the exact same place, would the

bagley's brother. i spoke to them both just before airtime. >> mr. suggs, can you share with us, seeing this body camera video that you've been waiting for, what stuck out to you? >> what stuck out to me was probably just how everything went. my initial response to the body cam footage was confusion followed by anger and that's just from not understanding why did a domestic call turn deadly, not understanding that everyone tied on with pain. but i prepared myself for that as much as i could. but you can't compare -- you can't prepare yourself for something like that, when you see that. >> did it answer questions for you? it all happens it seems in the video so fast. did you get answers from it? >> i did get answers that had a question. i think at this point, the only thing i'm wondering is just the procedure, the procedure, why did it happen like it happened. but, yes, i did get the answers that i wanted, and it was tough. it's still tough. it still is painful. again, it's not easy. none of this has been easy. but in all of it, i am learning as i go,

mr. bagley in any way was a danger to the officer. d when there isn't imminent harm. >> it's -- running away does not mean you're a threat. alonzo bagley you mentioned he was killed after police responded to a domestic disturbance call. he fled and police chased after him. the body camera footage which we have not seen, he says it shows that bagley's hands were up in the air in the split second after the shot was fired. there is a view, though it is obstructed, that the officer -- the way the officer is turned. but does this affect how the case might be prosecuted? and i'm sure this video will certainly be used in court, whether by both sides or at least the prosecution? >> absolutely. to the extent that that body cam video we haven't seen yet shows that mr. bagley's hands were in the air it's going to be difficult to make the claim he posed any threat to the officers. and the initial question i had, he ran and we've seen so many of these cases, black men run from police because they are afraid. they've seen cases where they don't run

mr. bagley was unarmed.deo we can't show you just yet because we are redacting parts of it, because it is he very graphic, you can see when the officers arrive there's a discussion and then mr. bagley jumps from a second-story balcony and there's a foot pursuit. well, what we've noticed in this video is that officer tyler had his weapon drawn and at some point they meet where the two almost kind of bump into each other and the officer opens fire. it's one single shot. and i can tell you with the video there's a lot of discussion about where the hands were of plp bagley. his hands were empty. were they up? were they down? that's been a part of the discussion. but for this family they've also been torn to pieces. take a listen to mr. bagley's brother. >> i'm looking at alexander tyler like dude, why is your gun drawn in the first place? why do you feel so threatening in the first place about this? he could have -- he could have wrestled him down. he could have, you know, yelled, anything. but you chose to take

mr. bagley's hand were when that shot was fired. the officer is sort of turned and the camera view is obstructed for a second. but the lsp investigator was saying, basically, when the shot hits mr. bagley it looks like his hands are up. that is something they'll go back and forth over in court. the mayor for his part actually apologized to the family yesterday saying he didn't reach out in a fast enough time. the police chief tells us, also, he is reviewing all of the policies of this police department and they will move forward also with an administrative look at what happened to see if they can calm some of the city leaders down. obviously a lot of questions especially from community leaders who want to know how can they move forward as a city together when there is video out like this that makes so many people question what actually happened that night. >> so many questions. ryan young, thanks very much for that reporting. >>> with us to talk more about these two cases we have criminal defense attorney and former prosecutor berna

mr. bagley fled to the back of the bedroom, grabbed an object off the night stand, which officers were not aware what that was. jumped off the balcony and took off running. the testimony further showed that the officers gave chase, lost sight of him. when officer tyler engages mr. bagley again, as the state police investigator testified, it was almost simultaneously in a close encounter with less than one second to make a split decision. officer tyler was placed in a situation where he had to make that call. it's a tragic situation for all involved. however, that's the position we're placed in today with having to defend these charges. >> you say that there was something grabbed from the dresser in the bedroom. we watched the body camera video, but between that moment where you say there was something grabbed, bagley jumps off the balcony. your client runs out of the apartment, down the stairs, around the building, and then in the direction of bagley. does your client claim that there was something in his hand at the time he fired that shot? >> again, commenting just strictly from what the

mr. bagley. they are obviously still very upset after having to watch this video yesterday. to them right after they came out of watching that video. they were heartbroken but they did actually thank the lsp for doing this investigation as fast as they did and moving forward with charges. the mayor for this city who is a new mayor has apologized to the family for not getting in touch with them as soon as possible after this shooting, and the police chief tells me that he's actually doing a review not only of this video, but all the administrative procedures moving forward because they still have to decide what's going to happen to the officer after he faces these charges. so many questions still left to be answered, but you can understand why this community was taking a deep breath yesterday, especially after this video was released. so hard to listen to. >> listen, it's stomach turning, you are watching a man die there and the image of this hands up prior, goodness, just shocking. ryan young, such an important story. we appreciate you bringing it to us. >>> minutes from now
