mr. scott's pickup truck and you see mr. nd then shot by police officers and he falls to the ground. the police officers then defend on to, well, descend on mr. scott as he's on the ground, patting him down and that's what the dash cam shows from our perspective. >> okay. so what, when did you see a gun that you're describing as a colt mustang handgun? where was that gun seen? >> well, we've seen it in photos. seen it just off to the left leg of mr. scott but in this video as the police chief has indicated, it's not distinctive. you can't distinctly see it's a weapon but to be clear about it, this is a very small handgun. you can't explicitly see he has a weapon in his hand. this body cam footage is pretty shaky as well. you could see mr. scott is wearing a black t-shirt on the ground here in the video i'm looking at right now. he's having his hands put behind his back. one of his hands, his left hand appears to show blood on the fingers as he's being restrained by officers lying on the ground. but the gun clearly, you can't,

some of the headlines out of it, they said that the moment when mr. scott was shot and killed they do not believe that they view him in any way walking aggressively towards officers. you heard the brother of keith scott's wife addressing questions that came to him and the family about the character of keith scott. he said he was an american citizen that deserved better. you also heard charles monet talking about the traumatic brain injury saying that there are many other people they will encounter with this kind of brain injury and they need to be prepared on how to deal with it. they said "are there training problems here?" some of those questions raised. we'll have full analysis of this after the break. on the other side we will show you for the first time the second video from charlotte police that is the body camera foota footage, that is next. to like . how is it? perfect! who's this? you don't always use it to share something. he's doing it! but when it matters most, you count on tracfone to keep you connected, for less. can you send that to me? yea.

mr. scott's experience, and certainly when you talk about what the police are experiencing later, but mr. scott's experiencing, he's not facing the cars arriving, the unmarked police cars, and they arrive first. and, you know, can you imagine, you're not committing a crime. you're not doing anything wrong. you're just sitting there waiting for someone and these unmarked vehicles pull up behind you. and maybe you think you're being robbed. possibly he's confused. what's going on here. and that might explain why he got out with a gun and the officers see that. it takes the marked car. the marked car doesn't arrive first. it looks like the unmarked cars arrive first. then you see the marked unit arrive and a uniformed officer gets out. that's a few seconds into it. it doesn't all happen with the marked car in the front. so it looks like a van and an another unmarked suv. >> we have a shot up on the screen now that, in your analysis, you identified that for us as it looks like a police officer holding a gun, with a gun extended toward mr. scott. >> right, lawrence. that's about 27 seconds int

you hear officers given commands to mr. scott in his vehicle and you see mr. scott stepping out of his vehicle, again, from an non aggressive point. >> reporter: from what vantage point? >> from the left of the vehicle, facing the driver's seat. he steps out and did not make any motions in terms of jerking his head or anything that would lead you to believe that he's arguing. you don't hear anything but you don't hear him saying anything of the video that his wife shot. you see him. >> reporter: that's a big mystery at this point. what exactly keith said to the officers. >> absolutely. >> reporter: why do you think the officer saying repeatedly dropping the gun. and being able to say that we give this man a warning. what's your explanation for that, why would they say drop the gun, drop the gun. >> you are correct, they did give multiple commands. i believe somebody counted it maybe 12, to drop the gun, i cannot speculate. i have not seen any piece of evidence verifies that he did in fact have a gun in his hand. what i have seen in the evidence that i am aware

mr. scott's feet. police claim that keith lamont scott was armed and threatening when he was shot by, but his family members and witnesses claim he was carrying nothing more than a book as he waited for his son to be dropped off. the police chief announced he would honor the request to view the police shooting of the video. that is though, not being released to the public. and what the police department will offer to the public. chief legal correspondent, ari melber. it's an interesting set-up they have in north carolina. i think a lot of people when these body cameras assume that the press would get it and in a situation like this, two days of violence, for transparency, it would be made public. we understand, we would be watching the death of an individual, but it could perhaps put to rest some of these concerns. >> you're putting your finger on the issue there. there's evidence and transparency. they are two different things. the police are generally much more on the side of saying, fine, we'll colle

they believe that mr. scott was holding a gun, but he would not say what that evidence is, that he believes leads them to that. also, just a short time ago, the mayor said that the motion in the video and the obscured views made the key moment unclear, that video that everyone is calling for, and this is a quote, when you have body camera in motion and things in the way and obscured views, it is not clear, she told anderson. she said that she would be leaning towards releasing this footage to the public, but she has to remain mindful of the ongoing independent investigation into the scott shooting while considering her position and as we spoke to the governor of north carolina last night, he was saying -- and it is his belief as it has been all along because he proposed legislati legislation, which is going to take effect on october 1, there should be body cameras, but that body camera video should be released, or the dashcam video should be released limited -- should be limitedly released only to family members

chiefly here the debate is was mr. scott carrying a book? was mr. scott carrying a gun? very big difference any day. earlier on our air, correspondent gabe gutierrez interviewed justin bamberg, attorney for the scott family. >> te >> reporter: tell me, you just saw the body cam footage and the dash cam footage the family had been asking to see, correct? >> yes, sir. >> reporter: what did you see? >> let me start off by saying it was painful to watch, not just see him get shot and killed, but to see the reactions on his loved ones' faces. what i see in that video is an individual who was sitting in a car, who gets out in a calm, peaceful manner. he never appears to be aggressive. it seems like he's a tad confused. i don't know if he's getting yelled at from too many directions. his hands are down. there does appear to be some object in his hand, but you can't make out what it is. at the moment he is shot. he's actually stepping backwards. >> reporter: did he have a gun? >> as far as i know, i don't know. we know that law enforcement is saying that he had a gun. i have not

the police stress, however, that it was mr. scott as you've been reporting, it was mr. scott that refused to obey commands and refused to drop the weapon. many of these protesters, they don't see it that way. they see another african american man shot by police. and they are demanding answer. again, this evening started very peacefully, people walking from marshall park downtown. and it quickly devolved into chaos some time around 8:30, 9:00 we start to see these clashes with police. and tammy, it's been describing as we've been seeing, they sent a flare every few minutes. the situation at least right now near the omni hotel is much calmer than it was a few hours ago. >> gabe gutierrez, thank you for that report. we will get back to you as the situation develops. we're joined now from downtown charlotte by cleave woodson. he is a "washington post" reporter. he was there. apparently when that civilian was fatally shot tonight. cleave, what did you see? >> well, the protester that came out of the epicenter, it's an entertainment complex with a movie theater, bar, and stuff

not only with the death of mr. scott, but that, you know, not knowing exactly what happened, was there a gun, wasn't there a gun? we heard those initial narrative about perhaps mr. scott had a book, then it was a gun. then we saw still images that purported to be a gun by his feet. now we have this video released by the family. folks were already upset in that vacuum of transparency demanding that the city, the police chief release the video from the police dash cam video or the body cam. they said so far they will not be doing that. now after the family viewed that video and their lawyer came out and said that he seemed to be -- mr. scott seemed to be dazed and stepping backwards. now we have this new video. and that anguish, that pain that certainly will play as the sound track for tonight's protest already here in what had been the epicenter of protests, we already see national guardsmen gathering. groups of individuals who we presume to be protesters are already starting to mill about. still quiet, still very early.

mr. scott's family and the scott family said after they saw those videos that they would like them to be released to the public. police and local authorities insist they will not do that. last night was the third straight night of protests in charlotte. the mayor, as we reported late last night, signed a midnight curfew ahead of midnight last night in the 9:00 p.m. hour and when midnight rolled around charlotte authorities decided they would not clear the streets despite the curfew. they would allow the protests to continue as long as they were peaceful. protests by and large were entirely peaceful and they went on late into the night and well past midnight. now today has been a new day of further dramatic and in some cases upsetting developments in the same case. today nbc news obtained video of the shooting of keith lamont scott, and it's a harrowing video. one of the most harrowing things about it is that the video was taken by mr. scott's wife, and you can hear her clearly talking to her husband, talking to the police throughout her recording. >> don't shoot him! don't shoot him. don

i guess the bigger question is, is this so much about this, mr. scottscott, as much as it is about walter scott, as much as it is about michael brown? there are so many to name. is that what last night is more about or is last night more about their local friend who they believe they've lost? >> i think it's a disappointment in the system. we've seen what happened to walter scott. they cut the check immediately. the family received $5 million. checks are being cut over and over for the lives of african-american males. it's too much. mr. gray in baltimore, you know, eric garner, $5.5 million. america is cutting checks for the blood of african-american men. you do not cut a check for $5 million unless somebody did something wrong. >> is it for the blood of african-american men or is it for the healing of the families who had nothing to do with that? >> i think it's for the blood of african-american men but more importantly when it comes to african-american men, we see no justice. we see a paycheck and officer goes free. and that's the saddest situation. a

i spoke to people who know mr. scott. heard from every single person that i spoke with personally is in contradiction to the story that we are hearing. i don't think that the video in and of itself is going to change the narrative. what it will take away is the sense that there is a coverup even on that part. so i'm very much in favor of us being able as a community to see the video, especially because, and i think this is a critical point, the family has seen the video and now the family is asking that the community see it. so the concern previously for their feelings and for their privacy, now that they have made this request, i think it's especially important for us all as a community and as a nation that's looking in on this story to be able to see what transpired and the interaction between mr. scott and the police officers. >> we'll see what happens later today. thanks for joining me once again. >>> coming up next, the gloves set to come off monday night as hillary clinton and donald trump face off for the very firs
