pete williams joins me live. pete, i understand it was in february the attorney general indicated he would step down this year. what else can you tell us? >> reporter: this has been an open secret that eric holder would probably leave before the end of his second term, and the only real question was when. and the really strong betting here has been that he would leave before mid term elections, and the only question is when, what day, and what time. now we know the answer. today, this evening at a white house event, he will formally announce this. we are told by justice department officials that he talks about this with the president over the labor day weekend. had an hour-long conversation. that's when the attorney general told the president of his plans and the president agreed. i thinkde it is fair to say the was a time when eric holder was ready to go. but i think the supreme court's decision in the voting rights act case, gutting that voting rights act was one of the most important civil rights laws passed.

pete, should we be setting up for more volatility ahead? >> i think we are going to see some swings. the volatility index, the fact that it got as high as it did yesterday before it started to sell off. it got underneath 15. are we overly concerned? no. is it something to watch? absolutely yes. we are over the 50 in the 200-day moving average? the volume has increased. september has been a monster month in the options world. a lot of this volatility we are seeing, the movement. these triple digit moves require the fact that we would expect to see volatility trading. >> we have talked about this on this desk and you have been pretty clear with that message. >> if volatility has rallied roughly 15%-20%. based upon the market, it was to sell at this point. would you be selling volatility here? >> i absolutely would be. i think we are going to go down. that also is because of the fact that it is predicated upon, i'm far more bullish in the market. i see some of the opportunities out there in some of the sectors. because of that, i think the vol

pete what are you seeing? you look at this chart you can see this stock has not performed recently very well at all. it's actually down about 4%. but when you look at this name when they had earnings in july they beat on earnings but they were short on revenue. but at the options today did start to trigger maybe there is something coming forward. the november 28 calls were active right out of the gate. 10,000 traded. twice the open interest. these are wait out of the money calls. stock as you can see trading around 24. so the 28s, do i think these will kick in be in the money? i don't. but they can perform as long as the stock moves to the upside. i'm not so sure whether gold is ready to make that kind of move. but certainly the option is trickling for us. >> are you in any of these. >> i'm not right now because i'm not a gold bug and i don't believe in the story. but the stock did make a move off this out of the gate so i think folks are saying hey there is an opportunity for the trade. >> and are you know ho

pete? >> mr.y general, can you give us a little more extra on why you decided to launch this investigation? your own conversations there, you talk about review of documented allegations. give us the universe of what went into this. >> we looked at a number of things in our initial and preliminary assessment of whether or not to open this investigation. it included not only discussions that the attorney general had with residents of ferguson two weeks ago but also other meetings at the civil rights division and community service leaders have had with residents. we've looked at public records and other pieces of information that are available to make an assessment that this was indeed an appropriate opening for a pattern and practices investigation. the civil rights division met with city leaders in ferguson yesterday and expressed a strong willingness to assist us and were open to this investigation. we will have cooperation from our local residents. >> what local documents are you talking about? >
