cnn justice correspondent jessica schneider has more on the ruling.sica, what does this mean for trump? >> well, wolf, it means the gag order against donald trump will, in fact, be in place moving forward, but the appeals court today saying the original gag order from district court judge tanya chutkan was too broad. specifically, the appeals court is removing restrictions when it comes to trump talking about special counsel jack smith. the appeals court really explained that jack smith is part of the justice department, that trump should be allowed to criticize public officials, and he should be able to express his views that this prosecution is politically motivated. so the appeals court here really trying to walk this fine line of protecting donald trump's first amendment free speech right, but also limiting just how far he can go in attacking witnesses and other court staffers and personnel as we have seen him already do. this is how the gag order will play out. trump will not be able to make public statements about potential witnesses in this cas

cnn justice correspondent jessica schneider is following this all for us. jessica, what can we expect in the days ahead? >> reporter: we're waiting for the special counsel to file arguments in this federal appeals court in d.c. it's due by saturday, so sometime saturday. they had a loss late last week in the supreme court. jack smith urged the high court to take up the immunity issue instead of waiting for this appeals process to play out. but the supreme court shut him down late on friday. so now this will have to go through at least a few more weeks of pause and waiting. donald trump's team, they filed their arguments over the weekend. they are arguing that donald trump is immune from criminal prosecution because, as they put it, he was acting within his official duties on and around january 6th. so we will see the special counsel's reply sometime saturday. then the appeals court will hear the arguments on this issue the second week of january, january 9th. they could decide on this issue fairly quickly after that, but really, since all the proceedings in

jessica schneider joins us again. timing here, it seems like we're all waiting with baited breath.o we know when the court will weigh in? >> we don't know. it could be at any moment. we're expecting it could be today before the christmas break. the supreme court could decide at any time if they'll quickly hear this immunity case. they'll eventually decide it, but what the special counsel is asking is they take this case up now instead of waiting for this appeals process to play out. truch's team has been arguing the former president is immune because they say he was operating within his official duties on and around january 6th. they say, therefore, he can't be prosecuted. they are also arguing he's immune because he was acquitted by the senate in his impeachment trial. the lower court here, the district judge said trump is not immune. trump's team is now appealing this to the intermediate circuit court of appeals. the special counsel saying, supreme court, you're eventually going to weigh in so just weigh in now rather than waiting for the appeals process to play out. really spinn

jessica schneider joins us with more on all of this. tell us more about what the colorado republican party just did, this appeal. >> reporter: the colorado gop, they're a party in this case, so they say they just appealed to the u.s. supreme court. we do expect donald trump's legal team to follow suit soon, probably in the coming days. what this filing guarantees in the short-term is it guarantees that donald trump's name will, in fact, be on the primary ballot in colorado. because, remember, the state supreme court here ruled that he should be taken off the ballot for the engaging in insurrection, but they paused their ruling to give time to the u.s. supreme court to consider whether to hear this case. the supreme court will likely hear this case. but since primary ballots have to be certified january 5th, next friday, this appeal guarantees the ballots will have to be printed with trump's name on it. now the question becomes, does the supreme court hear this case? they likely will because of this major constitutional question. but how
