scott mcgrew says even if the ban has the best intentions legally it's a loser. >> it really has.f the supreme court were the heavyweight championship of the world boxing match, the california law at the center is a fighter that has never won. in fact, it's been knocked out in the first round every time. every court that has dealt with this law has struck it down. specifically, the law which never took effect bans the sale of video games with egregious violence to children. parents can buy the games, of course. so would call of duty qualify? that's one of the problems. what does and doesn't qualify as too much violence and who gets to decide that. the other problem is the law specifics video games. not book, tv, movies. that's very tough to defend. the video games somehow have a special class. there is some history in this. in 1952 the supreme court considered a similar law after new york state tried to make this film illegal. certain movies that were considered religiously blasphemous. this was an italian film. it wanted to ban immoral or indecent material. this tries to attack v

scott mcgrew joins us for that. >> starting to feel a little bubbly, a lot of tech companies talkingillions of dollars. the latest is zynga which could raise $2 billion in its initial offer of stock. our friends at cnbc who work on the other side of the newsroom report they could file paperwork as early as this morning. zynga makes games like farmville making money off players who buy things like virtual cows. homeaway.com, which helps you rent a house or apartment for vacation use also getting ready to start selling stock as soon as this morning. they will trade under the symbol away. the price they are proposing would make the website worth about a fourth of the size of hewlett-packard. sacramento fits in, all those people making money off stock pay tax. though california doesn't have a capital gains tax the way the fed does, they consider capital gains to be income, so it's taxed that way. all this frothy moneymaking on wall street is a major part of the money that lawmakers are counting on to balance the budget. so when we talk about sacramento anticipating more tax money, it's n

but scott mcgrew says it's far greener than you might expect. >> you would certainly think. my first reaction when i saw the study from the economist calling san francisco the greenest city in the united states was, well, duh. but you drill down into the numbers and it's actually really quite impressive. did you know that san franciscans use half the electricity other people in other cities do? not total. that's per capita. the average person uses half the power. now the economist and a company called siemens put this together. 25 gigajewels per person we use or sfransans use as far as power use. it is half as much as the average person uses in the united states. we have more public transportation than the city of new york does as well. vancouver does better than us in several categories. but when it comes to purely the united states itself, san francisco is number one. and by just ludicrous margins. >> i lived in new mexico the last three years before moving back here and public transportation is like a foreign thing there. >> oh, absolutely. >> and so it's like, wow. >> i
