sergio quintana at the san mateo medical center with the details. >> reporter: charley cody was rushed here to the emergency room at the san mateo medical center and his wife tells me doctors were able to treat him for a short time before they told her he wasn't going to make it. juliet said her husband was a big guy with a big personality. on christmas day he started coughing and his symptoms got really bad. >> he was dehydrated i kept bringing him juice and he would drink it and go back to sleep. >> three days after getting sick he took a turn for the worse. >> i thought he had a stroke, that's what i called. i called an ambulance. >> reporter: he was rushed to the emergency room and died that night. he is one of the 127 deadly flu cases this year. cody was 54 years old. >> we've had a busy, bad bad flu season that started around christmas time. >> reporter: it started across the bay area. at john muir they're seeing about 400 patients a day. jew juliet is still in shock. >> it's serious. take it seriously. >>> let's go to the east bay now. the fire is out but we are getting answers.

sergio quintana spoke with one of the passengers and the operator of the boat now apologizing for whatled "the osprey" had just left the berkeley marina around 2:00 this afternoon. one of the passengers aboard says they were ten minutes into the ride when they all felt a violent jolt as it got hung up on the reef. just before sunset, you could see "the osprey" with a rescue boat. the operator of the tour boat says they made a mistake on the water when they went over the berkeley reef at low tide. the reef well known, clearly marked. >> right out of the gate our operator made a bad decision in terms of where he was running the vessel for the day. >> reporter: i was able to talk to nancy levine who was aboard when they hit the reef. >> the jolt shook up pretty much everyone, a number of people -- some bodies went flying, chairs went flying. >> reporter: the first concern was major damage to the boat. >> initially there was question about whether water was going to start coming into the boat. right away we put on life preservers. >> reporter: this is video of "the osprey" when it launched
