more than half of teenagers admit to sexting and about a third of those who do admit to sexting sendexually explicit images. it's common. >> we've heard the phrase epidemic of sexting. isn't there an epidemic of teenagers doing sexual things with each other, like before there was sexting? we talk about it, like, you know, teenagers are sitting around doing nothing, then the cell phone, smartphone came along and they started sexting. >> yeah, i mean, i think that's true. teenagers have been dating and going steady for years. it's just a little easier for them to communicate with each other via instagram or snap chat or tindr or what have you. it just makes it more of a public demonstration of some of these things that might have been going on before in private. >> i guess i still fail to see the legal logic of why it should be illegal. >> yeah, and i think a lot of states actually don't necessarily think that the remedy is to criminalize this behavior. i mean, child pornography laws are intended to protect children. so when you use them to prosecute children, it seems like a bit of a

then we hear about the sexting. we hear that he was searching age of consent in georgia, because one of the people that he was searching for and sort of sharing these explicit pictures was under age. and so when you have those sort of themes all together, i think that combination is really significant. >> okay. so that's your combination. danny cevallos, what did you see? what was your takeaway? >> my takeaway was the most shocking piece of evidence was at the same time the least legally relevant piece of evidence to me. and that was obviously the scandalous sexting allegations. from a moral perspective, they're shocking. the -- whether it be the allegations it was an underage child he was sexting with. but from the perspective of the prosecution making their case in chief, that really falls into the -- into the category and the defense attorney made this point -- of character evidence. now, the prosecution is going to say that goes to motive. but what the prosecution has to prove is that he intended to kill the chi

>> first, what was most shocking was the sexting evidence.it may not have been as significant as some of the other evidence. evidence that largely flew under the radar. for example, the fact that the defendant was only 30 seconds away from where he had last buckled in the child to when he arrived at work. that was a bad one. there was evidence that the police used a mannequin, a mannequin that was smaller than the 22-month-old child, put it in the car seat, the top of the mannequin's head was still visible, given this was a smaller mannequin. why is that significant? it's all evidence that this could not have been a mistake, and rather, it goes to his intent. the other evidence, the sexting, the internet searches, those largely go to motive. which, although it's evidence of intent, by itself it's not intent. it's actually evidence that the defense attorney argued, and i think there was some support for this, that it was improper character evidence. but reasonable minds could easily differ and the judge erred on the side of letting it in. bott

he sexts people, may have sexted somebody underainge.f bad things, the defense team that he has will say none of that is relevant, none of that is relevant. it leaves an unsavory taste in our mouth, considering the fact the man's wife is sitting in the courtroom listening to her husband's indiscretions. what is the work now that the defense has cut out for them? >> the defense has a lot of work. now that the case has been held over by the judge, they have to review all this discovery that we heard about at the preliminary hearing and i have to say the prosecution has done a lot of really strategic moves. first of all, charging felony murder. this is a complicated thing. felony murder is an unintentional killing, it's almost illegal fiction. doesn't make sense to call it murder. they use the child neglect which is oops i made a terrible mistake but in georgia, when a killing results as from an inherently dangerous felony, then you can be charged with felony murder, which is the highest degree of murder. georgia doesn't have degrees of mur
