spicer: thanks. i think the president's been very clear that as part of an overall comprehensive energy solution, we've got to utilize the resources that we have, that the federal government owns. whether that's the forests or natural resources or minerals that exist above and below the ground. we have too infrequently looked at our own resources and counted too much on foreign sources of energy. we're going to continue, as congressman zinkes goes through the process, to head up the interior department, and governor perry goes through his confirmation process, to get those individuals through, but then working together in areas where they have overlap and also areas where they will act individually, to realize, to look at those natural resources that we have, figure out how to best utilize them, to benefit not just our energy, but also economic growth opportunities with that. daniel. reporter: executive orders. you haven't really explained why the president's using executive orders in the manner that

spicer: we're not. the treasury department, from what i understand, is a fairly common practice for the treasury department, after sanctions are put in place, to go back and look at whether or not there needs to be specific carve-outs for different -- either industries or products and services that need to be going back and forth. i would refer you back to the treasury department on that one. reporter: the language on the treasury department website suggests that you are in fact easing sanctions and authorizing certain transactions with the federal securities service. does that not suggest a shift from what took place -- mr. spicer: regular course of action, the treasury does quite often, when there are sanctions imposed. i would refer you back to the treasury department. reporter: could i ask you to -- [inaudible] -- between the australian prime minister and the president. and also outline the president's concerns about the refugee questions. i asked you this earlier this week, but could you clarify wh

sean spicer denied it. said they were exchanging holiday greetings and other topics but not sanctions. then the vice president went on morning shows mid-january and said it was coincidental but they did not discuss sanctions. fast forward january 26th we have learned that the department of justice acting attorney general sally yates alerted white house counsel that flynn was in fact was misleading them and that phone conversation, that in fact there were discussions about russian sanctions, we were told today that the white house counsel immediately met with trump and a small number of senior advisors to discuss this and president trump at the time asked if there was anything illegal done. apparently there was a fast investigation and within several days done mcgahn said this wasn't illegal. you heard sean spicer today talk about doj' role in this actually pointing a finger to the department of justice even though it one until nearly three weeks later that donald trump asked for michael flynn's resignation

spicer: thank you. i think the president has been very clear from the beginning that there is no tax if companies manufactured in the united states. we are only a handful of countries that doesn't tax the imports that come into our country. almost every other country operates their tax code under that system. so what happens is we have a system by which companies abroad can send their products, tax our products going into the country and institute and import tax, -- and import tax. and then their products come into the united states with no import tax. which basically gives them a disincentive to companies to stay in the united states, to manufacture in the united states, to hire in the united states. it tilts the field against the american worker. and so the president is looking at tax policy that encourages manufacturing and job creation in the united states. reporter: but where is he on the tax, where is he on the tax specifically? mr. spicer: i understand that. and i think what is doing is he -- wha

i pressed on spicer on one component of it. remember in the first version of that executive order it called for indefinitely banning syrian refuse of are of geez. based on my reporting that language might be a little bit different in this second go around. i asked sean spicer about that. take a look. can you tell us what the language might look like as it relates to syrian refugees? >> i appreciate the effort but when we have it ready we'll get it out. and i think part of the this. >> is there a ban on syrian refugees? >> again, i appreciate the second try. we are not ready to announce it. part of it is we are making sure that it is completely ready to go. and so when we have that, we will get it out to you. i just -- i -- that -- the reason we haven't announced it is it's not ready to be announced. >> based on my reporting, jacob, a draft order would halt travel from those same seven countries that were targeted initially, iraq, iran, yemen and others. so, again, the language still coming together, sean spicer not prepared to

spicer jumped over that. another big contradiction, spicer says they learned about -- they learned about the existence of the transcripts 17 days ago but they were not able to determine that it was a breach of trust until now. two minutes later, he said mcgahn in the counsel's office was almost, quote, unquote, immediately able to determine tlnt an legal issue. so why did we have the 17 days? and finally, i think most importantly, the question is, he said, spicer said it was mcgahn who determined that it was an issue of trust. he actually said that, that the counsel determined it was not a legal issue but an issue of trust. white house counsels don't traffic in trust. they give legal opinions to presidents. so that is abrogating some of that responsibility to the president. it is a very, very sloppy and implausible time line. and i think it just beg as lot of questions and will require a lot of reporting. up with last thing. when spicer comes on there and talks about leaks, it is entirely likely that general
