dissent in strickland. to recap, the majority of the court upheld washington's death sentence and denied his inhe fkive assistance of counsel claim. brennan actually agreed with the court's analysis of the ineffective assistance of counsel issue but dissented from the outcome because he wrote that in his view, the death penalty was simply constitutionally forbidden in all cases so he would have vacated the death penalty on that basis and brennan along with justice marshall dissented on this basis in almost 2,000 cases over the years in what some scholars have called a kind of silent vigil over the death penalty. any time this case came to court regardless of the legal issue they were asked to decide, they would write these dissents that say i think the death penalty is in all circumstances cruel and unusual punishment. brennan also has this footnote in strickland that goes further than that where he really criticizes not only the court's jurisprudence but after its behavior, noting that beginning with gregg

the fact that strickland are pretty brutal. just a few months after the supreme court handed down gregg, david leroy washington launched of attacksek frenzy and murders. when politicians try on public fears of crime, these are like the poster type frames -- type crimes. although washington had no criminal history before this, the reason for his crimes became industry. washington would soon find himself one of the first defendant sentenced to death under florida's new greg-approved sentencing scheme. he was the seventh person to be executed in florida after gregg. after executed in 1984 the united states supreme court rejected his final constitutional challenge to his sentence. challenge the not death penalty itself as unconstitutional, which would have been a smart thing to do just after gregg. hisrgued that court-appointed lawyer had shirked his duties here in i shirked his-- duties. i should note that the supreme court rejected his claim but there was a lot to the claim. his lawyer did not take a lot of basic steps to prepare

i'm darci strickland. we begin in lexington county where a man has been charged in connection with a fatal collision. the accident happened around 4:40 a.m. this morning on highway 321 near the lexington industrial park. investigators say a car was traveling the wrong way and crashed into another vehicle. the driver of one of the vehicles died at the scene. and the other driver was taken to the hospital with minor injuries. the other driver has been identified as 21-year-old derious sutton. the highway patrol tells us that derious sutton was charged with felony dui resulting in death. troopers had to close the northbound lanes of highway 321 while investigating the accident. >>> certainly a chilly start to our friday morning. colder than the last several days. we have been warming up. slowly. most of us are in the 40s. a few 50s. saluda, 50. aiken, 50. we will be cooler when we get to winnsboro and newberry -- each at 45. right now columbia, a lot of sunshine. wind out of the north at 10 miles per hour. th

i'm darci strickland. developing story coming into our information center. columbia police have arrested a suspect in a sexual assault case carolina. more. you had a chance to speak with the suspect's attorney. what did he have to say? >> that is right. he had no comment at the moment. 23-year-old carlos hernandez turned himself into columbia police headquarters around this morning. charged with criminal sexual conduct and first-degree kidnapping. he is currently being held at the richland county detention center with a $300,000 security bond and has -- if you post that bond, he would be required to wear an electronic monitoring and has been ordered to have no contact with the victim. according to investigators, the crime took place this saturday between 3:15 a.m. and 3:30 a.m. around on wall street and columbia. the usc division of law enforcement and safety says the victim has been talking -- was talking to the man when she was forced to a nearby area where he sexually assaulted her. the suspect's attorney had no comment. we're working to get more details

. >> and i'm darci strickland. troopers found donnie myers car crash into a utility pole but he was not inside. he was later found at home and arrested for dui. colby gallagher has more. >> reporter: we've had the story online since early this morning and the biggest question we're getting is why he remains in office. he was charged with dui in north carolina in 2005 and years later troopers pulled him over for driving down the middle of the road andesiteed him for open container. in a statute it say, "any state or county officer indicted in any court for any crime, may governor, be suspended by the governor who shall appoint another until he is acquitted. the evidence will be submitted to a grand jury and if he's indicted only then can he be suspended by governor haley. his office has not returned our requests for a statement. we did reach out to many midlands lawyers and ethics experts but they declineed to go on camera. >> colby, thank you. richland county deputies are looking for a man and woman for shop liftin

i'm darci strickland. we start off with a story that has gripped the community's attention. bond was set for the restaurant owner charged with murdering his wife's lover on valentine's day. this morning, a judge set a $500,000 in bonds -- with several conditions including that he had no contact with his wife. he will be required to surrender his passport and cannot have any type of deadly weapon. if bond is posted, he must live with his parents and will be greg leon is charged in a sunday night shooting in lexington county. police say he opened the door of the victim's car and shot at him and killed him. investigators say he also attended to murder his wife who was also in the car. but the bullet missed her. at the hearing today, his wife says she is not afraid of him and said that she wants him released on bail to take care of his restaurant and support their family. >>> also, bond was set for a kershaw county man charged in the shooting death of a teenager. a judge set bond at $200,000 for 49-year-old jimmy joe massey. he was charged with voluntary manslaughter after killi
