i want to go to tara moriarty who has been out there this morning for the past hour and tara, what can you tell us about what is going on there thousand? >> reporter: swat teams have just arrived and we are not going to be able to show you the actual scene because police have asked us not to. we know the suspect is hold up inside of his home and this has been going on now this standoff for therely nine hour -- for nearly nine hours. it started off as a domestic violence dispute. the man whom they believe is in his 30s made threats against his girlfriend. she did get out safely but the suspect barricaded himself inside the home. during the night he did come out on the balcony and yelled at officers. he could be armed and that is why police are taking such precautions. it's believed he may have held a hostage at some point. we did meet three men that lived across the street from the suspect and they were evacuated from the homes. they have not been able to get inside their house all night. they slept in the car and left for work about an hour and a half ago. police quarantined off the bl

ktvu fox 2 tara moriarty joining us in santa clara with investigation underway what's the latest charge? >> reporter: well, officers arrested him on suspicion of violating a restraining order but mcdonald says he didn't know that order was in place. let's take a look at video from monday this is following his arrest for domestic violence and child endangerment, he allegedly attacked a woman while she was holding a baby, the chicago bears released him after less than three months on the team, then yesterday he showed up at a home in santa clara shortly before 3:00 in the afternoon, he was gone by the time officers arrived but they found him an hour and a half later at a nearby togo's sandwich shop, booked in to jail on $5,000 bail his attorney says neither he nor his client had been thoeufed about this restraining -- notified about this restraining order, back in august he was arrested on suspicion of felony domestic violence against his then fiancee, but charged not filed and it's you be clear if that woman is the same woman in this current incident, also in november san jose police inv
