this all started about 7:00 last night when police were called to an apartment complex on senter road in east san jose. they were met with gunfire. officer michael johnson was killed. people were evacuated from the area overnight. a family member called police to report that the suspects was despondent, intoxicated and might have access to weapons. when officers arrived on the scene they spotted a man on the balcony. moments later, shots were fired hitting officer johnson. he died at the scene. san jose police say the gunman, 57-year-old scott dunham, is dead. police found his body at about 3:20 this morning. it is not clear whether he was hit by the return fire from police or whether he took his own life. a witness described what happened last night. >> third or second floor, but shot down so he is on one of them floors on the patio. >> reporter: can you tell me whattist condition was like? >> yeah. -- can you tell me what the shooting was like? >> yeah. he died instantly. i know he died instantly. >> this has been san jose's darkest hour. our hearts go out to the friend, family and
