we're live here right on senter road. this is a very large crime scene area but the area is collapsing at this time as they are opening parts of this perimeter and allowing some people -- allowing them back into their homes at this time. so san jose police confirm that the suspect was found dead at 3:20 this morning. his name is 57-year-old scott dunham. he died from at least one gunshot wound. the s.w.a.t. team breached a wall of his home with explosives then went in with a robot and so-called pole camera. the suspect was apparently found dead on the balcony area. this began about 7:00 last night when police got a call a drunken suicidal man on the 2600 block of senter road near lewis. three officers responded to the call. here's chief esquivel to explain what happened next. >> the suspect was despondent intoxicated and possibly had access to weapons including a rifle. officers responded on scene. as they approached the residence, still on the sidewalk approaching the residence, the suspect fired at the officers from his

this all started about 7:00 last night when police were called to an apartment complex on senter road in east san jose. they were met with gunfire. officer michael johnson was killed. people were evacuated from the area overnight. a family member called police to report that the suspects was despondent, intoxicated and might have access to weapons. when officers arrived on the scene they spotted a man on the balcony. moments later, shots were fired hitting officer johnson. he died at the scene. san jose police say the gunman, 57-year-old scott dunham, is dead. police found his body at about 3:20 this morning. it is not clear whether he was hit by the return fire from police or whether he took his own life. a witness described what happened last night. >> third or second floor, but shot down so he is on one of them floors on the patio. >> reporter: can you tell me whattist condition was like? >> yeah. -- can you tell me what the shooting was like? >> yeah. he died instantly. i know he died instantly. >> this has been san jose's darkest hour. our hearts go out to the friend, family and
